The sub-committee met at Pittwood House, Scunthorpe.

852  CHAIR – Resolved – That Councillor Davison be and she was hereby appointed chair for the meeting.

Councillor Davison thereupon took the chair.

854  (38)  LICENSING ACT 2003 – APPLICATION FOR THE VARIATION OF A PREMISES LICENCE, BEST KEBAB, 1 DONCASTER ROAD, SCUNTHORPE – The Service Director Neighbourhood and Environment submitted a report advising members of an application to vary the premises licence at Best Kebab, 1 Doncaster Road, Scunthorpe.

Details of the application were outlined in the report, together with the variation application form as well as documents submitted by Humberside Police objecting to the variation application.

There was no application to vary the procedure.  However, Humberside Police, following agreement from all parties, submitted additional papers for consideration by the sub-committee.  It was at this point the meeting was adjourned for ten minutes to allow all parties to familiarise themselves with the additional representations.

Once the meeting was reconvened, the Premises Licence Holder and their representative as well as a representative of Humberside Police addressed the sub-committee and responded to questions.

The Service Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

  • To modify the conditions of the licence;
  • To reject the whole or part of the application

Following the summary of the case of the applicant as well as Humberside Police, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows: –

Resolved – The Sub-Committee resolved to modify the conditions of the licence as applied for, as they were satisfied that allowing the premises to open longer would not add to any cumulative impact being experienced in the area.

  1. Condition

That the premises licence holder implement a dispersal policy, to include asking patrons to leave quietly when exiting the premises.

The condition relates to the following Licensing Objectives:

The prevention of public nuisance Yes
The protection of children from harm No

Reason

To protect the local residents.

That the premises licence holder employ an SIA registered door supervisor between the period of 04:00 and 05:00 hours
