(i)  Application for the grant of a premises licence, Applegreen Brumby (Service Station), Ashby Road, Scunthorpe.

PRESENT:  Councillors Wells, Glover and Carlile. The sub-committee met at the Civic Centre, Scunthorpe.

978  CHAIRMAN – Resolved – That Councillor Wells be and he is hereby appointed chairman for the meeting.

Councillor Wells thereupon took the chair.

979  DECLARATIONS OF PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND SIGNIFICANT CONTACT WITH APPLICANTS, OBJECTORS OR THIRD PARTIES (LOBBYING) – There were no declarations of personal or personal and prejudicial interests or declarations of significant contact with applicants, objectors or third parties.

980  (21)  LICENSING (ACTIVITIES) SUB-COMMITTEE – APPLICATION FOR THE GRANT OF A PREMISES LICENCE, APPLEGREEN BRUMBY (SERVICE STATION), ASHBY ROAD, SCUNTHORPE.- The Director of Neighbourhood and Environmental Services submitted a report advising members of an application to grant a premises licence at Applegreen Brumby (Service Station), Ashby Road, Scunthorpe.

Details of the application were outlined in the report, together with a copy of the premises licence.

The applicant for the review’s representative addressed the sub-committee and responded to questions.

The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

  • To refuse to grant the licence
  • To grant the licence with additional conditions
  • To grant the licence without additional conditions
  • To grant the licence but restrict the licensable activities
  • To grant the licence with restricted times

Following the summary of the case of the applicant, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows: –

Resolved – The Sub-Committee resolved unanimously to modify the conditions of the licence, namely –

The Sub-Committee resolved unanimously to the following –

  1. Condition

That all conditions previously agreed between Humberside Police and Trading Standards by the applicant, and which the committee has had sight of today, be applied to the premises license with the exception of condition 6 (the requirement for a security guard) as the Sub-Committee deems this as not necessary to promote the licensing objectives.

The condition relates to the following licensing objectives –

The Protection of Children from harm Yes

Reason

The sub-committee believes that the conditions agreed are sufficient and necessary in order to promote all four licensing objectives.
