PRESENT: Councillors Clark and Eckhardt.

The sub-committee met at Pittwood House, Scunthorpe.

918 CHAIR – Resolved – That Councillor Eckhardt be and he was hereby appointed chair for the meeting.

Councillor Eckhardt thereupon took the chair.

919 DECLARATIONS OF PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND SIGNIFICANT CONTACT WITH APPLICANTS, OBJECTORS OR THIRD PARTIES (LOBBYING) – There were no declarations of personal or personal and prejudicial interests.

920 (1) LICENSING ACT 2003 – APPLICATION FOR THE GRANT OF A PREMISES LICENCE, AM PM EXPRESS, 72 OSWALD ROAD, SCUNTHORPE – The Director of Neighbourhood and Environmental Services submitted a report advising members of an application for the grant of a premises licence by AM PM Express, 72 Oswald Road, Scunthorpe.

Details of the application were outlined in the report, together with the application form and supporting papers submitted by the applicant, a copy of an objection and subsequent mediation between the applicant and Humberside Police and two letters of objection from local residents.

There was no application to vary the procedure.

The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

  • To refuse to grant the licence
  • To grant the licence with additional conditions
  • To grant the licence without additional conditions
  • To grant the licence but restrict the licensable activities
  • To grant the licence with restricted times.

The applicant and their representative and two objectors addressed the sub-committee and responded to questions.

Following the summary of the case, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows:

Resolved – The Sub-Committee resolved unanimously to grant the premises license, with the following conditions:

1. Condition

The premises shall operate from 6am to 10pm Monday to Sunday inclusive.

2. Condition

All doors and windows shall be fitted with metal roller security shutters, which shall be closed and locked when the premises are not open to the public.

To discourage crime and anti social behaviour in the area.

3. Condition

A full monitored intruder alarm system, covering all areas of the premises shall be installed and maintained. A licensed security company shall monitor the alarm system

4. Condition

A full CCTV system shall be in operation at the premises in accordance with the Humberside Police Codes of practice. This shall cover the internal areas so that persons purchasing alcohol can be easily identified. The front forecourt area and the shared access at the side of the premises shall also be covered

5. Condition

A challenge 21 policy shall be in place and brought to the customer’s attention by way of point of sale material where the alcohol is displayed and at the checkout.

All tills shall have a prompt system for alcohol sales.

Anyone who appears to be under 21 shall be asked to produce recognised photographic proof of age document. Acceptable forms of identification shall be ‘passport’, ‘photocard driving licence’ or ‘pass’ approved and hologrammed identification.

A refusals book or electronic log shall be kept recording the details of refused alcohol sales, which shall be audited by the DPS or duly appointed key member of staff to assess employees compliance with the company’s policy on refusing alcohol sales

To discourage the sale of alcohol to under age persons

6. Condition

Staff training shall take place every six months with regard to the company’s policy on alcohol sales. The DPS or duly appointed key member of staff shall maintain a written record of all training, which employees shall be required to sign

To ensure that staff are appropriately trained to adhere to the four licensing objectives.7. Condition

The premises shall employ a uniformed SIA licensed security guard two hours prior to and one hour after any professional football matches played at Glanford Park.
