(i)  Application for the review of a premises licence at CRE8 (formerly known as Charlie Roberts, now known as Lord Roberts), Wells Street, Scunthorpe, DN15 6HJ

4.  Any other items which the Chairman decides are urgent by reason of special circumstances which must be specified.

MINUTES

PRESENT:  Councillors Carlile, Eckhardt and P Vickers.

The sub-committee met at the Civic Centre, Scunthorpe.

Councillor Clark attended the meeting in accordance with the provisions of Procedure Rule 1.36 (b).

1023  CHAIRMAN – Resolved – That Councillor Eckhardt be and he is hereby appointed chairman for the meeting.

Councillor Eckhardt thereupon took the chair.

1024  DECLARATIONS OF DISCLOSABLE PECUNIARY INTERESTS AND PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS, SIGNIFICANT CONTACT WITH APPLICANTS OR THIRD PARTIES (LOBBYING) AND WHIPPING ARRANGEMENTS (IF ANY) – There were no declarations of disclosable pecuniary interests and personal or personal and prejudicial interests.

1025  (11)  LICENSING ACT 2003 – APPLICATION FOR THE REVIEW OF A PREMISES LICENCE AT CRE8 (FORMERLY KNOWN AS CHARLIE ROBERTS, NOW KNOWN AS LORD ROBERTS), WELLS STREET, SCUNTHORPE – The Director of Places submitted a report advising members of an application to review the premises licence at CRE8 (formerly known as Charlie Roberts, now known as Lord Roberts), Wells Street, Scunthope.

Details of the application were outlined in the report, together with the review application form and a copy of the premises licence.

The applicant for the review as well as the Premises Licence Holder addressed the sub-committee and responded to questions.

The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

  • To modify the conditions of the licence
  • To exclude a licensable activity from the scope of the licence
  • To remove the Designated Premises Supervisor
  • To suspend the licence for a period not exceeding three months
  • To revoke the licence

Following the summary of the case of the applicant for the review as well as the Premises Licence Holder, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows: –

Resolved – The Sub-Committee resolved unanimously to modify the conditions of the licence, namely –

  1. Condition

That the current Designated Premises Supervisor be removed.

This condition related to the following Licensing objectives –

The Protection of Children from Harm Yes

Reason

The day-to-day management at the premises was the responsibility of the Designated Premises Supervisor who has showed a clear lack of management and supervisory skills which has led to a breach of all four licensing objectives.

  1. Condition

That a personal licence holder be on the premises every Thursday, Friday, Saturday, all public holidays and Sundays preceding a public holiday including Christmas and New Years Eve, and also at any time when regulated entertainment is taking place

This condition related to the following Licensing objectives –

Reason

Due to the clear failure in management and the obvious breaches of the Licensing objectives it was felt that a personal licence holder was required at peak times to ensure the proper management of the premises and compliance with the licensing objectives.

  1. Condition

That a CCTV monitor be located in the bar and clearly signed as being present to ensure that patrons are aware of CCTV operations.  The CCTV system shall be in operation at the premises in accordance with the Humberside Police Codes of practice.

And also the CCTV monitoring equipment to be located in the room directly to the rear of the bar, and kept in clear working order, in accordance with the Humberside Police Codes of Practice for CCTV.

Reason

The CCTV was deemed necessary to monitor crime and disorder and assist in the proper management of the premises.

  1. Condition

That a paginated numbered log be maintained of all incidents and all faults to lighting, fixtures and fittings and all action taken to remedy the same.  The log must be made available to an authorised officer of the council – Humberside Police or Humberside Fire and Rescue Services.

This condition related to the following Licensing objectives –

Reason

The log was deemed necessary to monitor the safety of the premises and to assist the management in regulating the premises in accordance with the public safety licensing objective.
