MINUTES

PRESENT:  Councillors Armitage, Glover and K Vickers.

The sub-committee met at the Civic Centre, Scunthorpe.

1034  CHAIRMAN – Resolved – That Councillor K Vickers be and he is hereby appointed chairman for the meeting.

Councillor K Vickers thereupon took the chair.

1035  DECLARATIONS OF DISCLOSABLE PECUNIARY INTERESTS, PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND SIGNIFICANT CONTACT WITH APPLICANTS, OBJECTORS OR THIRD PARTIES (LOBBYING) – Councillor Armitage declared a personal interest as a personal licence holder.

1036  (16)  LICENSING (ACTIVITIES) SUB-COMMITTEE – APPLICATION FOR THE GRANT OF A PREMISES LICENCE, 84-86 FRODINGHAM ROAD, SCUNTHORPE – The Director of Places submitted a report advising members of an application to grant a premises licence at 84-86 Frodingham Road, Scunthorpe.

Details of the application were outlined in the report, together with the application form and supporting papers submitted by the applicant.  Also included was a copy of an objection received from NHS North Lincolnshire, a number of e-mails exchanged between the Licensing Authority and the applicants solicitor and two letters of objection from representatives of Scunthorpe Mosque, 107 West Street, Scunthorpe.

There was no application to vary the procedure.

The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

  • To refuse to grant the licence
  • To grant the licence with additional conditions
  • To grant the licence without additional conditions
  • To grant the licence but restrict the licensable activities
  • To grant the licence with restricted times

The applicant, a representative of NHS North Lincolnshire and the Licensing Authority addressed the sub-committee and responded to questions.

Following the summary of the case, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows: –

Resolved – That the premises license be granted with the following conditions –

  1. Condition

All staff authorisation to sell alcohol will be by the Designated Premises Supervisor in writing.  The Designated Premises Supervisor will ensure that all staff will be trained in the following –

  • Age appearance testing and the general responsibility of underage sales.
  • The Challenge 21 scheme where staff will only accept photo identification clearly showing the age of the customer.
  • Training in the keeping of a refusals book which will be available for inspection by an authorised officer.
  • All staff to receive regular refresher training on all aspects of alcohol sales and underage sales.

Reason

To promote all four licensing objectives and to deter the sale of alcohol to under age customers.

  1. Condition

That a CCTV system be in operation at the premises in accordance with the Humberside Police Codes of practice.
