1154  SUB-COMMITTEE PROCEEDINGSResolved – That the minutes of the Licensing (Miscellaneous) Sub-Committee held on 5 December 2013, 30 January and 20 March 2014 be received, subject to minute 1149 of the meeting held on 30 January 2014 in the last sentence to read ‘(Councillor Armitage and Ellerby wished to be recorded as dissenting against the above decision, minute 1149 refers)’.

1156  (24)  SCRAP METAL DEALERS ACT, 2013 – Further to minute 1138, the Director of Places submitted a report presenting the council’s draft policy on ‘Scrap Metal Dealers’ following consultation with interested parties.

The report explained that the new Scrap Metal Dealers Act 2013 had introduced a number of changes to the way that scrap metal businesses were regulated. The new Act repealed the Scrap Metal Dealers Act 1964 (and associated legislation) and Part 1 of Vehicles (Crime) Act 2001, creating a revised regulatory and combined regime for scrap metal recycling and vehicle dismantling industries.

The report explained that there was no statutory obligation for the council to have a policy in relation to scrap metal, however, in order to determine applications a consistent approach was needed. This policy would enable such an approach to be adopted, albeit that each application would need to be determined on its own merits.

A copy of the draft policy was attached as appendix A of the report, which included comments received from the British Metals Recycling Association. This response was also attached as appendix B.

Recommended to Council – That the Scrap Metal Dealers Policy, incorporating minor amendments suggested by the committee, be approved and adopted.
