The sub-committee met at the Civic Centre, Scunthorpe.

1228   CHAIRMAN – Resolved – That Councillor K Vickers be and he is hereby appointed chairman for the meeting.

Councillor K Vickers thereupon took the chair.

1229   DECLARATIONS OF DISCLOSABLE PECUNIARY INTERESTS, PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND SIGNIFICANT CONTACT WITH APPLICANTS, OBJECTORS OR THIRD PARTIES (LOBBYING) – There were no declarations of pecuniary interests or personal or personal and prejudicial interests.

1230   (1)      LICENSING ACT 2003 – APPLICATION FOR THE GRANT OF A premises licence, First and Last Hotel, 11A Station Road, Kirton-in-Lindsey, DN21 4BB- The Director of Places submitted a report advising members of an application for the grant of a premises licence at the First and Last Hotel, 11A Station Road, Kirton-in-Lindsey, DN21 4BB.

Details of the application were outlined in the report, together with the application for the grant of the premises licence, comments received from Humberside Fire and Rescue Service, a letter from the Licensing Authority, a letter from Humberside Police, seven letters of objection from Interested Parties, an e mail between the applicant and the Licensing Authority, agreeing to the conditions suggested by the Licensing Authority and a location map.

The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

To refuse to grant the licence

  • To grant the licence with additional conditions
  • To grant the licence without additional conditions
  • To grant the licence but restrict the licensable activities
  • To grant the licence with restricted times

The applicant, Humberside Police Licensing Officer, a representative of the Licensing Authority and three Interested Persons addressed the sub-committee and responded to questions.

Following the summary of the case, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows: –

Resolved – That the licence be granted as applied for, subject to the following conditions –

Condition 1

That the conditions agreed to by the applicant and the Licensing Authority, contained within Appendix D of the agenda bundle, be attached to the licence.

This was to adhere to the Prevention of Crime and Disorder, Prevention of Public Nuisance and Protection of Children from Harm licensing objectives.

This is to protect the amenities of local residents and to assist the safety of patrons frequenting the premises.

Condition 2

That the conditions agreed to by the applicant and Humberside Police, contained within Appendix E of the agenda bundle, be attached to the licence, with the requirement for a minimum 15 inch screen monitor.

This was to adhere to the Prevention of Crime and Disorder, Prevention of Public Nuisance and Protection of Children from Harm licensing objectives.

This was to protect the amenities of local residents and to assist the safety of patrons frequenting the premises.

Condition 3

That the applicant be required to display clear signage at main exit points requesting that patrons leave the premises in a quiet and orderly manner.

This was to adhere to the Prevention of Public Nuisance licensing objective.

This was to protect the amenities of local residents.

Condition 4

That the applicant ensures that the CCTV cameras monitor the smoking area and the front entrance of the premises.

This was to adhere to the Prevention of Crime and Disorder Licensing Objectives.

This was to ensure that the safety of patrons and local residents.

Condition 5

That the applicant refuse entry to new patrons after the hours of 23:00 hours on Fridays and Saturdays.

This was to adhere to the Prevention of Public Nuisance and Public Safety Licensing Objective

This was to ensure the safety of patrons frequenting the premises.
