PRESENT: –  Councillors Glover, K Vickers and Wilson.

The sub-committee met at the Civic Centre, Scunthorpe.

1295  CHAIRMAN – Resolved – That Councillor K Vickers be and he is hereby appointed chairman for the meeting.

Councillor K Vickers thereupon took the chair.

1296   DECLARATIONS OF DISCLOSABLE PECUNIARY INTERESTS, PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND SIGNIFICANT CONTACT WITH APPLICANTS, OBJECTORS OR THIRD PARTIES (LOBBYING) – Councillor Wilson declared a personal interest as he knew the owner of the Schnapps.

1297   (29)    LICENSING ACT 2003 – APPLICATION FOR A TEMPORARY EVENT NOTICE, SCHNAPPS, 89-93 FRODINGHAM ROAD, SCUNTHORPE, DN15 7JU The Director of Places submitted a report advising members of an application for a Temporary Event Notice at the Schnapps, 89-93 Frodingham Road, Scunthorpe.

Details of the application were outlined in the report, together with the application for a Temporary Event Notice, a letter of objection from Environmental Health (Commercial) and a location map.

The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

  • To issue a Counter Notice.
  • Not to issue a Counter Notice.
  • Impose relevant conditions (only where the event has an existing premises licence)

A representative from Environmental Health, (Commercial) and the applicant addressed the sub-committee and responded to questions.

Following the summary of the case, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows: –

Resolved – That the sub-committee agrees to accept the notice, which includes extending the conditions on the premises licence and applying these to the Temporary Event Notice as per Appendix A, page 6, point 5 of the agenda documentation.

This is to protect the amenities of local residents and to adhere to the public nuisance licensing objective.
