7 REQUESTS TO SPEAK – STANDING ORDER 38(b) – Five persons had given notice under Standing Order 38(b) of their wish to address the sub-committee. The chair briefly outlined the procedure, indicating that they would be given the opportunity to speak prior to consideration of the respective applications.

8 MINUTES – Resolved – That the minutes of the proceedings of this sub-committee of 28 April 2000, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

9 APPLICATIONS DEFERRED FROM PREVIOUS MEETING FOR SITE VISITS – (minute 2903 refers) – In accordance with the decisions at the last meeting, members had undertaken site visits earlier in the day. The Director of Environment and Public Protection submitted reports and updated them orally where appropriate.

(2) 00/0122 by Mrs S E Dawson for retention of a boundary fence and creation of a vehicular access at 18 College Close, Alkborough.

Resolved – (a) That permission be refused in accordance with the recommendation contained in the report; and (b) That authority be given (i) for any necessary enforcement action to be taken to secure the removal of the unauthorised building works and (ii) to issue instructions to take proceedings in the Magistrates’ Court in the event that any notice served in pursuance of (i) or any requisition served under Section 330 of the Town and Country Planning Act 1990 or Section 16 of the Local Government (Miscellaneous Provisions) act 1976 is not complied with, subject to the Assistant Director (Legal and Administration) being satisfied as to the evidence available to support such action.

10 (3) 00/0127 by M J Robertson for change of use of retail premises to a public house, 49-50 Bridge Street, Brigg.

Prior to consideration of this application an objector and a representative of the applicants addressed the sub-committee.

The objector argued that there was inadequate provision of off-street parking in the vicinity, that existing traffic congestion would be made worse, and could cause problems for the emergency services, and that there were already sufficient licensed premises in Brigg.

The applicant’s representative stated that car parking space would be provided for staff and there was a large public car park close by. The proposal would generate employment and help to maintain jobs at nearby breweries which would supply the proposed public house. The property had previously been a brewery tap.

The Director of Environment and Public Protection advised members that some of the issues raised by the speakers were not relevant to consideration of the application. He considered that there were no grounds to justify refusal.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

11 (4) 00/0053 by Mr and Mrs M Williams for removal of condition 3 from permission 97/0528 relating to the layout of a footway to the site frontage at 30 Gainsborough Lane, Scawby.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

12 (5) HISTORIC BUILDING AND IMAGE IMPROVEMENT GRANTS – The Director of Environment and Public Protection submitted reports on the following applications for grant aid. Each report set out the background to the application, details of the proposed works and resource and environmental implications.

13 (6) PLANNING APPLICATIONS – The Director of Environment and Public Protection submitted a report incorporating a schedule containing details of applications for determination by the sub-committee, including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. Officers updated the schedule orally in respect of late representations and other significant developments since its preparation.

Resolved – That the following applications be approved in accordance with the recommendations contained in the reports.

(i) 99/1215 by Bassindale Mason Development Limited for erection of 12 lock-up garages on land adjacent to 5 Maple Avenue, Crowle.

(ii) 00/1227 by Mr D I Boyall for change of use of retail premises to residential at 5 High Street, Barton-upon-Humber.

(iii) 00/0233 by DFS Northern Upholstery for consent to display an illuminated sign at DFS Furniture Co., Scawby Road, Scawby Brook, Broughton.

(iv) 00/0269 by Martin H Dunn Ltd for construction of an extension to an existing building to provide retail and storage areas plus a toilet with disabled facility and removal of condition 4 of permission 7/359/92 at Glebe Farm, Clarkes Road, North Killingholme.

(Note: Mr Broome having previously declared an interest in the following application 00/0286, took no part in the discussion thereof).

(v) 00/0286 by Brigg Preparatory School for change of use of a living room to a classroom with internal alterations at the White House, Bigby Street, Brigg.

(Prior to consideration of the foregoing application, the Director of Environment and Public Protection reported a letter received from the local MP requesting that consideration of the application be deferred for a site visit).

(vi) 00/0302 by Mr L Fox for change of use of land for open storage and distribution of sand and gravel on Plot 52A, Colin Road, Scunthorpe.

(vii) 00/0313 by Mr and Mrs M Boyle for erection of a detached house on land between 3 and 4 South Street, Owston Ferry.

(viii) 00/0331 by North Lincolnshire Council, Directorate of Education and Personal Development for outline permission for erection of a 120 place secondary school (siting and means of access not reserved for subsequent approval) at St Hugh’s School, Bushfield Road, Scunthorpe.

(Prior to consideration of this application, an objector addressed the sub-committee claiming that the proposal would create additional traffic and could cause a problem for emergency services in an area which already experienced congestion at school arrival and leaving times).

(ix) 00/0355 by Mr P Aumenier for change of use of former shop (A1) to a restaurant (A3) at 24 Oswald Road, Scunthorpe.

(x) 00/0372 by North Lincolnshire Council for change of use of a GP’s surgery to a Joint Community Mental Health Team Resource Centre at 344 Ashby Road, Scunthorpe.

(Note: Councillor P Kirk having previously declared an interest in the following application, 00/0375, left the meeting during the discussion and voting thereon).

(xi) 00/0375 by Mr and Mrs P Kirk for erection of a ground floor extension to form two additional en suite bathrooms at Kirks Korner, 12 Scotter Road, Scunthorpe.

(iv) 00/0306 by Kirton Plastering for renewal of permission 7/253/95 for erection of ground floor offices and storage with first floor flats on land west of 1 Gainsthorpe Road, Hibaldstow.

(v) 00/0325 by J N Wall and Son for change of use to allow wood storage and the unloading of lorries at Manor Farm, Old Village Street, Gunness.

(vi) 00/0352 by Gocar and Associates for consent to retain six hoarding signs at Gocar and Associates, Mannaberg Way, Scunthorpe.

(and the Assistant Director : (Legal and Administration) be authorised to take legal proceedings in respect of the unauthorised signs, subject to him being satisfied as to the evidence available to support such action).

(vii) 00/0407 by Mrs C A Lane for erection of 31 two-bedroomed bungalows, 16 three-bedroomed bungalows, 8 one-bedroomed houses, 23 three-bedroomed houses and 12 one-bedroomed flats (total 90 dwellings) – renewal of permission 7/375/95 on land rear of Greengate Lane and St Denys Close, South Killingholme.

15 98/1532 by Mrs E Watson for outline permission to erect a dwelling on site north-east of fishing pond, off Chafer Lane, Stather Road, Burton-upon-Stather.

Resolved – That consideration of this application be deferred to enable officers to seek further information.

16 00/0237 by Mr M Steer for change of use of a former shop (A1) to a hot food takeaway (A3) at 30 Queens Road, Barnetby.

Prior to consideration of this application, the applicant addressed the sub-committee, indicating that he would be prepared to amend the proposal so as to restrict it to preparation and delivery of food.

Resolved – That consideration of this application be deferred.

17 Resolved – That consideration of the following applications be deferred until the next meeting and that members visit the site prior to that meeting.

(i) 00/0262 by Mr D A and Mrs S A Able for outline permission to erect a detached bungalow on land adjacent to Oberland, Station Road, Scawby.

(ii) 00/0410 by Ben Bailey Homes Ltd, for erection of 17 houses and 3 bungalows on land at Mulberry Drive, Crowle.

18 (7) CONSULTATION BY OTHER AUTHORITY – 99/1229 by Conoco Global Power Developments Ltd – Form B application to erect a combined heat and power plant west of Rosper Road, South Killingholme – The Director of Environment and Public Protection submitted a report on this application to the Secretary of State on which the Council had been consulted.

Resolved – That the Secretary of State be advised that the Council has considered the application and the environmental information submitted with it and (a) does not object to the development in principle, and (b) requests that any permission deemed to be granted by the Secretary of State should include conditions relating to the matters set out in Appendix 2 to the report.

19 (8) ENFORCEMENT UPDATE – The Director of Environment and Public Protection submitted a schedule giving details of progress in respect of matters on which the sub-committee had authorised enforcement action.

Resolved – That the report be noted.

20 (9) TREE PRESERVATION (MAIN STREET, NORMANBY) ORDER – The Director of Environment and Public Protection submitted a report inviting members to consider confirmation of a Tree Preservation Order (TPO) in Main Street, Normanby.

An objection had been received from the landowner following which the Council’s Environment Officer (Trees and Landscape) had re-examined the trees. He had confirmed that the trees met the relevant criteria for a TPO in a conservation area and it was therefore recommended that the Order be confirmed.

Resolved – That the Order be confirmed.

21 (10) TRAINING FOR TOWN AND PARISH COUNCILS IN DEVELOPMENT CONTROL – The Director of Environment and Public Protection submitted a report informing members about recent training events that had been held and seeking authority for a future event.

The report contained an analysis of evaluation forms received following the training sessions which showed that they had been generally well received.

Resolved – (a) That those parish and town councils who took part in the training be thanked for their interest; (b) that copies of the presentation notes be made available to other town and parish councils on request, and (c) that a future event be organised in 2000/2001, taking account of the feedback received and dealing in depth with some more specialised topics.

22 EXCLUSION OF THE PUBLIC – Resolved – That the public be excluded from the meeting for consideration of the following item (minute 23 refers) on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 13 of Part 1 of Schedule 12A of the Local Government Act 1972.

23 (11) TYRE DUMP : HIBALDSTOW AIRFIELD – The Director of Corporate Affairs submitted a report informing the sub-committee of the current situation and outlining the legal remedies available.

Resolved – That the Director of Environment and Public Protection brings a further report to the Environment and Public Protection Committee.
