127 DECLARATIONS OF INTEREST – Councillor Regan declared a non-pecuniary interest in application 00/0775 (Minute 131 refers).

128 REQUESTS TO SPEAK – STANDING ORDER 38(b) – It was reported that five requests to speak had been received in accordance with Standing Order 38(b). The chair briefly outlined the procedure, indicating that they would be given the opportunity to speak prior to consideration of the respective applications.

129 MINUTES – Resolved –That the minutes of the proceedings of this sub-committee of 11 August 2000, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

130 APPLICATIONS DEFERRED FROM PREVIOUS MEETING FOR SITE VISITS – (minute 120 refers) – In accordance with the decisions at the last meeting, members had undertaken site visits earlier in the day. The Director of Environment and Public Protection submitted reports and updated them orally where appropriate.

(83) 00/0242 by Singleton Birch Limited for extension of existing quarry and its subsequent restoration by landfilling at Melton Ross Quarries, B1211, Melton Ross – The Director of Environment and Public Protection reported a late representation from the Environment Agency in respect of the effect of the proposal on an underground aquifer and requested that the application be deferred to enable officers to discuss an appropriate condition to protect the aquifer with the applicants and the Environment Agency.

Resolved – That consideration of the application be deferred accordingly.

131 (84) 00/0775 by Mr & Mrs Murgatroyd, for increase in the number of touring caravan sites from 20 to 35 at Brookside Caravan and Camping Park, Stather Road, Burton-Upon-Stather.

Prior to consideration of this application the applicant and an objector addressed the Sub-Committee.

The applicant referred to the decision of the inspector in respect of an appeal on the site. With regard to the objections in respect of the access, the inspector had stated that he was not persuaded that other users of the bridleway would be subject to inconvenience or risk as a result of the proposal for 20 pitches. The access had subsequently been improved. The present users of the site were split roughly equally between contractors and holiday-makers, both of whom spent money in the local shops and pubs. There had been no complaints made to the licensing authority about the running of the site.

The objector claimed to own the access road and that this had been sprayed with weed killer by the applicant, thus spoiling what was a country lane. He alleged that there had been more than the permitted 20 caravans on site for some time and that the increase in use of the site had led to an increase in the number of vehicle movements. This was causing damage to the environment, a potential traffic hazard at the junction of the access and Stather Road and distress to the objector’s livestock.

The Director of Environment and Public Protection updated the report in respect of several late representations including a petition of approximately 50 objectors. In respect of the bridleway, the surface was owned by the Council as Highway Authority and any alterations to that surface required its consent. Members were minded to grant permission but were concerned at the potentially dangerous junction of Stather Road and the access road and wished to see a condition imposed requiring the provision of a warning sign.

Resolved – That the Assistant Director of Environment and Public Protection (Planning and Environment) be authorised to grant permission subject to the conditions contained in the report and, if appropriate, to a further condition requiring the provision of a warning sign in respect of the junction of Stather Road with the access to the site, following discussions with the applicant.

132 (85) 00/0735 by Mr & Mrs J W & E V Johnson for erection of a detached bungalow and garage incorporating severely disabled person’s facilities on land adjacent to 74 Butterwick Road, Messingham.

Prior to consideration of this application a representative of the applicant addressed the Sub-Committee arguing that the personal circumstances of the applicants should outweigh the policy objections to it. The applicants had a physically and mentally handicapped daughter living with them. Their present home had been adapted as far as possible but was too small to allow their daughter to have a satisfactory quality of life.

Councillor England, attending the meeting under the provisions of Standing Order 40(b), spoke in support of the application. The Messingham Local Plan which remained the adopted development plan for the area, stated that development outside the development boundary should not normally be permitted except where there was an overriding local need. This was a case of such an overriding need.

The Director of Environment and Public Protection informed members that the applicants had sought advice from his officers prior to purchasing the property and had been advised that any application for residential development would be recommended for refusal on policy grounds.

That permission be refused in accordance with the recommendation contained in the report.

133 (86) HISTORIC BUILDING GRANTS – The Director of Environment and Public Protection submitted reports on the following applications for grant aid. Each report set out the background to the application, details of the proposed works and resource and environmental implications.

134 (87) TREE PRESERVATION (LAND EAST OF LUNEBURG WAY SCUNTHORPE) ORDER – The Director of Environment and Public Protection submitted a report inviting members to consider confirmation of a Tree Preservation Order (TPO) relating to Land East of Luneburg Way, Scunthorpe.

An objection had been received from the landowner following which the Council’s Environment Officer (Trees and Landscape) had re-examined the trees. He confirmed that the trees met the relevant criteria for a TPO in a conservation area and it was therefore recommended that the Order be confirmed, subject to some replotting of the plan and a change in the title of the Order to remove a clerical error.

Resolved – That the Order be confirmed as recommended.

135 (88) PLANNING APPLICATIONS – The Director of Environment and Public Protection submitted a report incorporating a schedule containing details of applications for determination by the sub-committee, including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. Officers updated the schedule orally in respect of late representations and other significant developments since its preparation.

(xi) 00/0927 by M R Chantry for change of use of a workshop and open – fronted shed from agricultural to private use at Highfield House, Northfield Road, Messingham.

(xii) 00/0947 by Mr & Mrs P Stanley for consent to fell 2 Birch Trees, a Poplar Tree, a Plum Tree and an Acacia Tree at 14 The Dell, Scunthorpe.

(xiii) 00/0986 by Mr M Edwards for erection of a detached bungalow and garage on land at West Hale Farm, West Carr, Epworth.

(the Director of Environment and Public Protection reported a late letter from the Environment Agency asking for a condition to be placed on the permission requiring any bats or water voles on the site to be protected. The Director informed members that there was no evidence of either species on the site.)

138 7/594/92 by North Lincolnshire Council for the tipping and restoration of land for the reclamation of Normanby Park Steelworks – request to import material from Waters’ Edge, Barton-Upon-Humber at Conesby Quarry, off Normanby Road, Scunthorpe.

Resolved – That written permission be given for the co-disposal as described in the written particulars submitted to proceed.

139 00/0740 by North Lincolnshire Council for listed building consent to carry out works to the council chamber and roof at Pittwood House, Scunthorpe.

Resolved – That the application be referred to the Secretary of State with a request that he grants consent for the reasons and subject to the conditions set out in the report.

140 00/0754 by Mr & Mrs Austin for extension of a bakery to house an additional oven at Mount Pleasant Mill, North Cliff Road, Kirton-in-Lindsey.

Prior to consideration of this application, the Director of Environment and Public Protection informed members of a late letter from an objector re-affirming his earlier objection and requesting that conditions be imposed restricting emissions, noise and hours.

Resolved – That the Assistant Director of Environment and Public Protection (Planning and Environment) be authorised to grant permission subject to the conditions contained in the report and, if appropriate, to further conditions addressing the issues raised by the objector, following further discussions with the applicant.

141 00/0809 by Keigar Homes Limited for erection of 15 dwellings with garages and associated access/parking together with the installation of roads and sewers, also to include a garage for 37 North Street at land rear of 35 and 37 North Street, Winterton.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

142 (89)APPLICATION FOR APPROVAL OF RESERVED MATTERS FOLLOWING THE GRANT OF OUTLINE PLANNING PERMISSION – 00/0888 by Brinkley Homes for reserved matters, pursuant to outline planning permissions 97/0686 and 97/0687, granted on 14 July 1997 for the erection of 12 detached houses and garages on land adjacent Sunnydene, 24 Sandtoft Road, Belton.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

143 (90) APPEAL(S) – The Director of Environment and Public Protection submitted a report informing members of the outcome of the following appeals:-

(i) Against refusal of outline planning permission for the erection of residential development on land rear of Manor Farm, 68 High Street, Messingham – Application reference 98/1546 – Appeal dismissed.

(ii) Against refusal of outline planning permission for the erection of a detached dwelling – High Street, Luddington – Application reference 99/1058 – Appeal dismissed.

(iii) Against refusal for the erection of a detached five bedroomed house with garage – Beckside House, High Street, East Butterwick – Application reference 00/0173 – Appeal allowed subject to conditions.

(iv) Against refusal for the erection of two dwellings at Brackenhill Road, East Lound – Application reference 99/0834 – Appeal dismissed.

144 (91) ENFORCEMENT – The Director of Environment and Public Protection submitted reports on the following alleged breaches of planning control. Each report set out the planning history of the site; the nature of the alleged breach; details of attempts to secure a cessation of the breach or the submission of a planning application, and the reasons why it was considered expedient to take enforcement action.

145 (92) UNAUTHORISED DEVELOPMENT – Change of use of former hotel garage to retail sale of carpets – former Wortley House Hotel, Rowland Road, Scunthorpe.
