The committee met at Pittwood House, Scunthorpe.

244 DECLARATIONS OF PREJUDICIAL AND NON-PREJUDICIAL PERSONAL INTERESTS AND DECLARATIONS OF SIGNIFICANT CONTACT WITH APPLICANTS OR THIRD PARTIES (LOBBYING) – The following member declared a non-prejudicial interest in the following matter:

245 REQUESTS TO SPEAK – PROCEDURE RULE 36(e) – It was reported that thirteen requests to speak had been received in accordance with Procedure Rule 36(e). The chair stated that the speakers would be able to address the committee prior to consideration of the respective items.

246 MINUTES – Resolved – That the minutes of the proceedings of the meeting held on 26 July 2002, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

247 APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decisions at the previous meeting, members had undertaken site visits earlier in the day. The Director of Environment and Public Protection submitted reports and updated them orally.

(25) 02/0501 by Mr I A Proctor for Outline Permission for erection of a dwelling at Outgate, Ealand

The Committee had, at its last meeting, resolved that it was minded to grant permission and deferred a decision to this meeting in order to enable officers to request a flood risk assessment and to prepare a report on appropriate conditions.

Resolved – That permission be granted, subject to conditions as advised in the report.

248 (26) 02/0798 by Mr and Mrs Owen for erection of a 3-bedroom house at Swinster Lane, East Halton

Prior to consideration of this application, an objector and one of the applicants addressed the committee in accordance with the provisions of Procedure Rule 36 (e).

The objector stated that she had no objection to bungalows on the site in accordance with an existing permission but the proposed house, being on land elevated above neighbouring properties, would overlook Plot 2 and properties across the road.

The applicant stated that the proposed dwelling would not lead to any problems with overlooking. It would be in keeping with its surroundings. The floor level would be the same as the new bungalow on the adjoining plot.

The Director of Environment and Public Protection advised members that the application previously approved had been for single-storey dwellings. It had not been the council’s decision to restrict the height of the buildings. He considered that there would be no loss of privacy to Plot 2 as the proposed elevation facing that plot contained no windows. The issue was whether or not the proposed development would be in keeping with the surrounding properties. In his opinion it would be.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

249 (27) PLANNING APPLICATIONS – The Director of Environment and Public Protection submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. Officers updated the schedule orally in respect of late representations and other significant developments since its preparation.

Resolved – That the following applications be approved in accordance with the recommendations contained in the reports.

(i) 01/1167 by Loversall Estates Ltd. for the erection of 12 dwellings (amended house types) with associated revised road layout (amendment to approved house type, Plot 7) on site south of Beechwood Farm, East Street, Hibaldstow.

(ii) 02/0475 by Mr and Mrs G Read for the erection of a detached dwelling (design and siting not reserved for subsequent approval) at 12 Green Lane, Barton – upon – Humber.

(iii) 02/0518 for the erection of a detached house with integral garage in connection with an existing equestrian business on plot of land, Riverside Stables, Ferry Road, Goxhill.

(Prior to consideration of this application, one of the applicants addressed the committee in accordance with the provisions of Procedure Rule 36 (e).

The Director of Environment and Public Protection advised members that an earlier application for a similar use had been refused, however the applicant had now submitted information which satisfied him that the business on the site was viable and that the accommodation was required in connection with the business. Therefore the proposal met the criteria set out in Policy RD10 of the North Lincolnshire Revised Deposit Draft Local Plan).

(iv) 02/0709 by Mr and Mrs H Thomas for the erection of a dormer bungalow with integral garage on plot 5, Coach House Gardens, Scawby.

(Prior to consideration of this application, one of the applicants addressed the committee in accordance with the provisions of Procedure Rule 36(e). He agreed with the assessment of the application contained in the report).

(v) 02/0711 by Hutchinson 3G UK for erection of a 20 m high replacement dual-purpose floodlight and telecommunications tower with associated cabinets at Brigg Town Football Club, Hawthorn Avenue, Brigg.

(vi) 02/0789 by New Home for the erection of a detached house and garage on building plot between 11 and 17 New Street, Elsham

(Prior to consideration of this application, an objector addressed the committee in accordance with the provisions of Procedure Rule 36(e). He stated that the proposal was not in keeping with the character of the immediate area, would be too close to his own boundary and would lead to overlooking of his property.

The Director of Environment and Public Protection advised members that Elsham was a village with a mix of old properties interspersed with newer ones. The present proposal was not considered to be out of keeping with its surroundings. He felt that the conditions to be imposed would address the points made by the objector).

(vii) 02/0811 by Mr G Withers for demolition of an existing dwelling and associated buildings and erection of a replacement two – storey dwelling and stable block, including associated works at Belwood House, Woodhouse Lane, Belton.

(Subject to the deletion of recommended condition 8 and the substitution therefor of a condition requiring the recommendations contained in the flood risk assessment to be implemented)

(Prior to consideration of this application, the applicant’s agent addressed the committee in accordance with the provisions of Procedure Rule 36 (e). He stated that, whilst the Parish Council had objected on the basis that the building would be too large for the site and out of keeping with the locality, in fact it was of a similar size to existing properties to the east).

(viii) 02/0848 by Mr J Meagher for the erection of a four-bedroom detached house with integral garage on Plot 8, The Steadings, High Street, Flixborough.

(subject to additional conditions removing “permitted development rights” in respect of any future extensions to the dwelling and prohibiting windows from being placed in the northern, western or eastern elevations).

(ix) 02/0897 by Mrs E Wright for consent to fell Leylandii trees protected by a Tree Preservation Order at Mayfield Orchard, Thorn Lane, Goxhill.

(subject to a condition requiring a scheme for planting replacement trees of a size, position and species to be agreed in writing with the Local Planning Authority prior to the removal of the trees)

(Prior to consideration of this application, an objector addressed the committee in accordance with the provisions of Procedure Rule 36 (e). He suggested that the trees should be retained and pollarded. Removing the trees would damage the environment for wildlife. The Director of Environment and Public Protection informed members that the trees were part of a large group on the site the subject of an order made in 1984. The trees in question had an overbearing effect on the locality. Granting consent would not permit the felling or any other works to other trees covered by the order).

(x) 02/0949 by Mr and Mrs RJH Sumpter for erection of a dwelling and garage on land opposite Holme Farm, Front Street, Alkborough.

(subject to an additional condition as requested by the Archaeological Unit).

250 02/0721 by Mr and Mrs A Jenman for erection of one detached dwelling on land adjacent to 24 Brethergate, Westwoodside.

Resolved – That this application be refused in accordance with the recommendation contained in the report.

251 02/0584 by Ms L Brooks for outline permission to erect a two- storey house and garage on land to the rear of 2 North Cliff Road, Kirton – in – Lindsey.

That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

254 (28) APPEALS – The Director of Environment and Public Protection submitted a report informing members of the outcome of the following appeal: –

(i) Against the refusal of permission to retain a sectional double garage at 28 O’Hanlon Avenue, Brigg (01/1114) – Appeal Dismissed

255 (29) ENFORCEMENT UPDATE – The Director of Environment and Public Protection submitted a schedule giving details of progress in respect of matters on which the committee had authorised enforcement action.
