Councillor Holgate attended the meeting in accordance with the provisions of Procedure Rule 37(b).

735 MINUTESResolved – That the minutes of the proceedings of the meeting held on 9 September (Policy Meeting) and 14 September 2005 having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman, subject to the addition to Minute 724 the words “There were no declarations of personal interests.”

736 (31) APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decisions at the previous meeting, members had undertaken site visits earlier in the day. The Head of Planning and Regeneration submitted reports and updated them orally.

(i) 2005/1220 by Mr J Spittlehouse for outline permission to demolish existing farm buildings and erect a new dwelling at the farmyard opposite Spittlehouse, Gunthorpe, Owston Ferry.

Prior to consideration of this application the applicant’s agent addressed the committee in accordance with Procedure Rule 35 (e).

She explained that her client wished to retire from farming and suggested that the application would be in accordance with PPG 7.

Councillor Holgate, attending the meeting under the provisions of Procedure Rule 37(b) spoke in support of the application.

The Head of Planning and Regeneration advised the committee that the site was in open countryside as defined in the Local Plan. It was currently in agricultural use and was therefore not “brownfield.”

The committee, however, considered that the site was ideal for housing; was within the boundary of the village, would complete the street scene, was a brownfield site and the development complied with Policies H1 and H3 of the North Lincolnshire Local Plan.

Resolved – That permission be granted subject to the standard outline conditions, a condition requiring a flood risk assessment to be carried out and any conditions requested by the Highways Team.

(ii) 05/1103 by Mr and Mrs Shepherd for the erection of a two-storey extension and double garage on land rear of 27 Low Street. Haxey

Councillor Holgate, attending the meeting under the provisions of Procedure Rule 37(b) spoke on the application. He was concerned about the potential impact on the neighbouring property.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

736 (32) PLANNING APPLICATIONS – The Head of Planning and Regeneration submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 05/0213 by Mr R J Raynor for the erection of 13 town houses, including the demolition of an existing building at The Gables, 195 Ashby Road, Scunthorpe.

Resolved – That consideration of this application be deferred to enable further consultations to be carried out.

(ii) 05/0707 by Mr D Oades for the erection of single-storey 5-bedroom accommodation on land to the rear of The Cross Keys, 5 King Street, Winterton.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(iii) 05/1020 by Chartdale Homes Ltd for residential development consisting of 34 units and associated garages/parking (resubmission of 2004/2149) on land at The Meadows, Messingham.

Prior to consideration of this application an objector addressed the committee in accordance with Procedure Rule 35 (e). He stated that he had no objection in principle to the development of the site. However he was concerned that houses would back onto existing bungalows causing overlooking. There was a discrepancy between the density figures quoted by the applicants and by the officers. The council had a duty of care to preserve existing amenities.

The Head of Planning and Regeneration reported that the Strategic Health Authority had now advised it had no objections to the proposal. Messingham Parish Council had now reconsidered the issue of the provision of public open space. The separation distances between the existing and proposed properties were considered to be acceptable.

Resolved – (a) That the committee is minded to grant planning permission , subject to an amendment to the layout to show the provision of a footpath link from the site to an existing area of public open space;(b) that the decision to grant planning permission be delegated to the Head of Planning and Regeneration and that permission be granted subject to the conditions set out in the report and on completion of a formal agreement under Section 106 of the Town and Country Planning Act 1990 providing for a contribution under Policy C1 of the North Lincolnshire Local Plan to enable education accommodation to be provided at primary and secondary level and in accordance with policy H10 of the North Lincolnshire Local Plan a commuted sum in lieu of the provision of an area of open space, and (c) that if the obligation is not completed by 31 December 2005, the Head of Planning and Regeneration be authorised to refuse the application on the grounds of non -compliance with policy C1 and SPG 8 of the North Lincolnshire Local Plan.

(iv) 05/1063 by Humberside police Authority for a new liquid petroleum gas (LPG) refuelling station on land adjacent to Providence House, Holydyke, Barton-on–Humber.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(v) 05/1140 by Mr J Wright for the conversion of existing office buildings to 4 flats at The Old School House, Thorn Lane, Goxhill.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vi) 05/1211 by Mr R C Edley for outline permission for the erection of dwellings at Scotter Road South, Bottesford.

The Head of Planning and Regeneration reported on a late representation on behalf of the applicant

Resolved – That permission be refused in accordance with the recommendation contained in the report.

(vii) 05/1213 by Mr C MacAdam for outline permission for residential development on land adjacent to 8 The Slack, Crowle

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(viii) 05/1273 by Mr and Mrs R Barratt for the erection of a 3-storey house on land adjacent to Aliton, 21 Beckside, Hibaldstow

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ix) 05/1305 by Mrs H Mason for the erection of a new dwelling incorporating existing barn (resubmission of 2005/0832 refused 11/07/2005) on land adjacent to Low Paddock, Commonside, Crowle

Prior to consideration of this application an objector and the applicant’s agent addressed the committee in accordance with Procedure Rule 35 (e). The objector was concerned that the dwelling would be within 7 feet of her own kitchen. She was also concerned that the proposal could create a noise nuisance.

The agent indicated that the applicant had taken into account the reasons for an earlier refusal. There would be no loss of privacy or noise. The dwelling would be five metres away from the objector’s property.

The Head of Planning and Regeneration referred to a late submission by objectors relating to car parking. This was not a matter that should be given significant weight. The scheme had been amended to address earlier concerns.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(x) 05/1306 by Mr and Mrs Chappil – Bright for the erection of a bungalow (resubmission of 20056/0577 refused 23/05/2005) on land at 17 Danson Close, Barton-upon-Humber.

Resolved – That permission be granted in accordance with the recommendation contained in the report subject to an amendment to condition 8 to remove “permitted development rights and a condition requiring windows in the southern elevation of the garage to be obscure glazed.

(xi) 05/1318 by Mr and Mrs K Stones for the erection of a replacement dwelling with detached double garage at Laburnum House, Upperthorpe Hill, Westwoodside

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(xii) 05/1341 by Mr G Mann for the erection of an extension at 3 Byre court, Westwoodside, Haxey.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(xiii) 05/1363 by The Pub People Co. for the erection of two dwellings at The Kings Arms, 18 Low Street, Haxey.

Prior to consideration of this application an objector addressed the committee in accordance with Procedure Rule 35 (e). The objector was concerned that the development would lead to overlooking of her property and loss of privacy. It would also lead to a loss of car parking spaces.

The Head of Planning and Regeneration advised that the Highways Team considered that the car parking arrangements were satisfactory, A proposed condition required the dwellings to be dormer bungalows. There would be no windows in rear facing walls.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(xiv) 05/1368 by Mr and Mrs P Taylor for the erection of a dwelling to replace a demolished barn at 6 High Street, Burton-upon-Stather

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(xv) 05/1425 by Mr J Mullen for the conversion of two berdrooms into one and the erection of an extension to form an additional bedroom at The Exchange Coach House Inn, Bigby Street, Brigg.
