800 MINUTES – Resolved – That the minutes of the proceedings of the meeting held on 26 April, 2006 having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman, subject to their correction by the recording of Councillor Holgate, who attended the meeting in accordance with the provisions of Procedure Rule 37 (b), speaking on applications 03/0852, 06/0108 & 06/0219.

801 (1) APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decision at the previous meeting, members had undertaken a site visit the day prior to the meeting. The Head of Planning and Regeneration submitted reports and updated them orally.

(i) 06/0108 by M Daw for the erection of a two – bedroom detached house (resubmission of application 05/1709 dated 20/12/2005) at rear of 22 Mill Road, Crowle.

Prior to consideration of this application, the applicant’s agent addressed the committee. He stated that the application was for a small detached house. The grounds for refusal of a previous application on the site had now been addressed. The only reason for the recommendation of refusal of the present application related to the access. However the access was no worse than that to many other dwellings and would not be detrimental to the amenities of neighbours as cars could already be parked on the site. The council’s Highways Team had not made any objection to the application.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

(ii) 06/0219 by Mr and Mrs Prince for retention of a detached garage on land adjacent to 1 Derrythorpe Road, Crowle Bank Road, Althorpe.

Prior to consideration of this application, the applicant’s agent addressed the committee. He stated that the structure could not be seen from the road. Had it been one metre less in height it would have been “permitted development”. There were a number of other buildings in close proximity to the site.

The Head of Service advised the committee that the site was not within the curtilage of a domestic building and therefore no permitted development rights would apply. The site was in open countryside. Enforcement action had recently been taken in respect of caravans and other structures on the site.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

802 (2) PLANNING APPLICATIONS – The Head of Planning and Regeneration submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(Note: prior to consideration of the following applications, 05/1001 and 05/1002, Councillor Bunyan, having declared a personal and prejudicial interest left the meeting)

(i) 05/1001 by The Hunt Group Ltd for the conversion of an existing dwelling to a hotel, restaurant and function rooms, including associated alterations at Hirst Priory, A161 from A18 to M180, Belton.

Resolved – (a) That the committee is mindful to grant permission for the development; (b) that the Head of Planning and Regeneration be authorised to grant permission subject to the completion of a formal agreement under Section 106 of the Town and Country Planning Act 1990 to ensure the conservatory extension approved under application 2/277/1990 is not implemented (c) that if the obligation is not completed by 1 September, 2006 the Head of Planning and Regeneration be authorised to refuse the application on the grounds that the proposal would be detrimental to the character and appearance of the listed building.

(ii) 05/1001 by The Hunt Group Ltd for Listed Building Consent to make internal and external alterations at Hirst Priory, A161 from A18 to M180, Belton.

Resolved – That consent be granted in accordance with the recommendation contained in the report.

(iii) 05/1304 by Mr T Metcalfe for a commercial fishing pond (resubmission of 05/0214) on land at the rear of The Railway Inn, 28 Kings Road, Barnetby.

Prior to consideration of this application, a supporter of the application addressed the committee. He stated that the proposal would improve the amenity of the area and would provide employment. It would be a facility for people of all ages. The objection from Humberside Airport was on the grounds that the pond would attract wildfowl thus increasing the risk of bird strike. However there were a number of other bird habitats in the vicinity and therefore the pond would not have a significant impact on this respect. In any event Barnetby was a not on a designated flying route and indeed planes were not permitted to overfly the village.

The Head of Planning and Regeneration advised the committee that, as there was an objection from the airport, the committee could not grant permission. Should it be minded to support the application if would have to be referred to the Civil Aviation Authority.

That permission be refused in accordance with the recommendation contained in the report

(iv) 05/1571 by J Jackson Ltd for the discharge of existing agreements originally made under Section 52 of the Town and Country Planning Act 1971 (now Section 106 of the Town and Country Planning Act 1990) relating to the spreading of chicken manure in accordance with a specified scheme of disposal in relation to planning permission references 7/273/87, 7/274/87 and 7/705/87 on land at Messingham Common in the parish of Messingham at White Cottage, Butterwick Road, Messingham Common, Susworth

Resolved – That the legal agreements relating to planning permissions references 7/273/87, 7/274/87 and 7/705/87 be discharged.

(v) 05/1794 by G & W Developments for the demolition of an existing factory and the erection of one block of 55 flats at 44-54 Dunstall, Scunthorpe.

Prior to consideration of this application a representative of the applicants addressed the committee. He stated that the current use as a factory was in a residential area. The flats would have a traditional look.

Resolved – (a) That the committee is mindful to grant permission for the development; (b) that the Head of Planning and Regeneration be authorised to grant permission subject to the completion of a formal agreement under Section 106 of the Town and Country Planning Act 1990 providing for a commuted sum for affordable housing, (c) that if the obligation is not completed by 24 August 2006, the Head of Planning and Regeneration be authorised to refuse the application on the grounds of non – compliance with the provisions of SP9.

(vi) 06/0244 by C & R Build for the erection of a pair of semi –detached houses (resubmission of 2005/1870) on land west of 3 Moorland Way, Epworth.

Prior to consideration of this application, an objector addressed the committee. She lived next door to the site. She stated that the development would be only two and a half metres from her kitchen window. It would lead to a loss of light to her garden, There was inadequate car parking provision for the development.

Councillor Holgate, speaking in accordance with the provisions of Procedure Rule 37 (b) spoke on this application. He was concerned that the development could have an overbearing impact on the vicinity.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(vii) 06/0253 by Mr C M Herring for the conversion of an existing pumping station into a dwelling with farm office and garages and associated alterations at Scotney pumping station, access road to Scotney Farm, Roxby

Prior to consideration of this application, the applicant addressed the committee. He stated that he and his wife currently had a tenancy which would terminate on his death. Thus his wife had no security of tenure. He wished to convert the pumping station into a dwelling to provide a home for his wife should he pre – decease her.

(viii) 06/0268 by Joy Dibdin for the demolition of an existing lean–to extension and erection of a new single – storey extension at 23 Hillcrest Drive, Burton–upon–Stather.

Prior to consideration of this application, an objector and the applicant addressed the committee.

The objector was concerned that demolition of the extension would create an opening for future development on the site and asked for a condition to placed on any permission to prohibit such development.

The applicant indicated that the concerns expressed by the objector had been addressed by the planning officer in his report.

The Head of Planning and Regeneration advised that the demolition in itself did not require consent as it was neither a single residential unit or within a conservation area.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

In the absence of the chairman and vice –chairman Councillor Grant was elected Chair for the following items only. (Minutes 802 (ix) and (x) refer).

(ix) 06/0338 by Castle Building Lincoln Ltd.for the demolition of existing buildings and erection of 10 residential units at The Garage, Barton Lane, Barrow–upon–Humber.

The Head of Planning and Regeneration updated the committee by advising that the objection by English Heritage had now been withdrawn.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(x) 06/0339 by Castle Building Lincoln Ltd. for Conservation Area Consent for the demolition of existing buildings and erection of 10 residential units at The Garage, Barton Lane, Barrow–upon–Humber.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

Councillors Bunyan, England, Glover, Long, Rowson and Wardle returned to the meeting at this point.

(xi) 06/0343 by Green Acres Nursing Home for the retention of a boundary fence at Greenacres Nursing Home, Fieldside, Crowle

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(xii) 06/0408 by Mrs H Burnett for the erection of a detached bungalow with integral garage and widening of access on land east of 2 Moorwell Road, Bottesford.

Prior to consideration of this application the applicant addressed the committee. She referred to the objection by the town council and pointed out that there had been no objections raised by the council’s Highways Team.

Councillor Swift, speaking in accordance with the provisions of Procedure Rule 37 (b) spoke on this application.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(xiii) 06/0476 by Mr and Mrs R Stone for consent to carry out works to trees including the felling of T1, T2 and T3 on land at Brookhouse Farm, Church Street, Hibaldstow.

Resolved – (a) That consent be granted, subject to the conditions contained in the report, and (b) that the Tree Preservation (land off Church Street, Hibaldstow) Order 2003 be annotated to show the extent of the approved works and that a new order be made to protect newly planted trees in the interests of public amenity.

Councillor Collinson returned to the meeting at this point.

(xiv) 06/0511 by Centrica Brigg Ltd for the erection of temporary stores building and the carrying out of modifications to pumping station 3 at Glanford Generating Station, access roads to power station, Scawby Brook, Scawby.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(Note: Councillor Bunyan, having declared a personal and prejudicial interest in the following application, 06/0524, left the meeting at this point)

(xv) 06/0524 by North Lincolnshire Council (Neighbourhood and Environmental Services) for the change of use of public open space to garden land to be incorporated into existing adjacent gardens at Blackthorn Close, Flixborough.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(xvi) 06/0534 by Mr D White for the erection of a single – storey extension and detached domestic garage to the front of the property and a two – storey extension to the rear of Eastlea, 10 East Street, Hibaldstow.

Prior to consideration of this application, an objector and the applicant addressed the committee.

The objector stated that the development would be an over intensive use of the site and would have an overbearing impact on his own property. If permission was to be granted there should be no windows in the west facing wall.

The applicant stated that the development would fit in with the existing development. It would be thirty metres away from the neighbour’s property.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(xvii) 06/0535 by D G O’Leary for the change of use of land from open space to garden area on land adjacent to 41 Maple Avenue, Crowle.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

803 (3) ENFORCEMENT UPDATE – The Head of Planning and Regeneration submitted a schedule giving details of progress in respect of matters on which he had taken enforcement action under delegated authority.
