983 MINUTESResolved – That the minutes of the proceedings of the meeting held on 5 December 2007 having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

984 (52) APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decisions at the previous meeting, members had undertaken site visits on the morning of the meeting. The Service Director Highways and Planning submitted reports and updated them orally.

(i) 07/1667 by Mr RJ and Mrs JA Bottomley for the conversion of a stable block into 2 holiday cottages at The Stable Block, Low Road, Worlaby.

Resolved – That permission be granted in accordance with the recommendations contained in the report subject to additional conditions relating to mitigation measures in relation to bats and nesting birds and to the retention of an existing timber fence running north-west/south-east across the former crewyard.

(ii) 07/1667 by Mr RJ and Mrs JA Bottomley for Listed Building Consent to convert stable block into 2 holiday cottages (re-submission of PA/2007/1155) at The Stable Block, Low Road, Worlaby.

Resolved – That consent be granted

(iii) 07/1354 by Mrs S Brydon for outline permission for the erection of 2 detached dwellings with detached domestic garages (access and siting not reserved for subsequent approval) to replace existing dwelling to be demolished (re-submission of application no. PA/2007/0164) at 85 High Street, Belton.

Resolved – That permission be granted in accordance with the recommendations contained in the report subject to an additional condition relating to no vehicular access to the front of the plot from High Street.

(iv) 07/1702 by B A Wright & Son for the erection of an apartment block consisting of 6 apartments (resubmission of application PA/2007/1337) on land south of 36 Burnham Road, Epworth.

Resolved – That permission be granted in accordance with the recommendations contained in the report.

(v) 07/1658 by Mr J Everatt for conversion of a church hall into 3 dwellings at St Oswald’s Church Hall, Church Street, Crowle.

985 (53) PLANNING APPLICATIONS – The Head of Planning submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 07/1612 by Mr and Mrs M F Milner for the retention of a ménage at The Mortons, Ling Street, East Halton

Resolved – That permission be granted in accordance with the recommendations contained in the report.

(ii) 07/1690 by Mr S Humphries for the retention of a barn and use of land for keeping horses at Shaw Nook Lane, Belton

Resolved – That permission be granted in accordance with the recommendations contained in the report.

(iii) 07/1724 by Mrs M Drury for the change of use of a residential bungalow into a day care nursery and erection of a conservatory to the south elevation at 2 Wesley Road, Brigg.

Prior to consideration of this application, the applicant addressed the committee. She stated that there was a need for the facility. Issues relating to parking were being addressed.

(iv) 07/1726 by Mrs M Drury for advertisement consent to display a non-illuminated hoarding sign (re-submission of PA/2007/1091) at Roselea, 2 Wesley Road, Brigg.

(v) 07/1742 by Mr M Cray for the erection of a detached dwelling and detached double garage on land adjacent to Coppa Vista, Stothards Lane, Goxhill

Resolved – That permission be granted in accordance with the recommendations contained in the report.

(vi) 07/1844 by Mr G Hodge for outline permission to erect a two-storey dwelling with access not reserved for subsequent approval at Holme Farm, Main Street, Gunthorpe. Owston Ferry

Prior to consideration of this application, the applicant’s agent addressed the committee. She stated that, whilst the site was designated as open countryside in the local plan, it was within the “village envelope” There had been a dwelling on the site previously.

Resolved – That consideration of this application be deferred and that members undertake a site visit

986 (54) APPLICATION FOR APPROVAL OF RESERVED MATTERS FOLLOWING THE GRANT OF OUTLINE PERMISSION – 07/1621 by Keigar Homes Ltd in respect of Outline Permission 06/1278 dated 03/10/2006 for the erection of 3 detached 5-bedroomed houses and garages with associated accesses at The Orchard, Thorn Lane, Goxhill – The Head of Planning submitted a report informing members about this application for approval of reserved matters which was ready for determination. Outline planning permission had already been granted and the development had therefore been agreed in principle.

Consideration was now required to the details of the siting, design, external appearance, means of access and landscaping of the developments (excluding any of these matters which were expressly approved at the time outline permission had been granted).

Resolved – That approval be granted in accordance with the recommendations contained in the report.

987 (55) ENFORCEMENT UPDATE – The Service Director Highways and Planning submitted a schedule giving details of progress in respect of matters on which he had taken enforcement action under delegated authority.

Resolved – That the report be noted.

988 (56) PUBLIC FOOTPATH 5, ALKBOROUGH – The Service Director Highways and Planning submitted a report inviting members to decide what stance to take in submitting a disputed definitive map modification order to the Secretary of State. The committee had agreed in March 2007 (Minute 902 refers) to make two orders to delete the line of the path currently shown on the definitive map and to add the correct line of the path. The order to add had been made first and advertised and had attracted four objections, none of which had subsequently been withdrawn.

The council was now required to send the order to the Secretary of State for confirmation.

There was nothing in any of the objections that had not been raised, either during the informal stage of consultation or by speakers at previous meetings of the committee, in the way of evidence to indicate that the order should not be confirmed.

Resolved – (a) That the Definitive Map Modification (Public Footpath 5, Alkborough) Order 2007 (1) be sent to the Secretary of State for Environment, Food and Rural Affairs; (b) that the Secretary of State be requested to confirm the order as made, and (c) that the council assist the Secretary of State by participating fully in support of confirmation according to the Secretary of State’s chosen means of arbitration.

989 (57) PROPOSED DIVERSION OF PUBLIC FOOTPATH 214 (2) BROUGHTON – The Service Director Highways and Planning submitted a report seeking approval for the diversion of a section of footpath 214, Broughton.

The section to be diverted ran in a south-easterly direction diagonally over a field. The proposed diversion would take the path out of the field and would follow an existing two-metre wide grass track proceeding firstly in a southerly direction and then in an easterly direction.

The order would be made in the interests of the landowner. However it was considered that the public would also benefit.

Resolved – (a) That an order be made in the interests of the landowner; (b) that the Service Director Highways and Planning be authorised to confirm the order if it is unopposed; (c) that a further order be made under the Wildlife and Countryside Act 1981 to modify the County of Lincoln – Parts of Lindsey (Glanford Brigg) Definitive Map and Statement in consequence of the diversion should the order be confirmed, and (d) that a further report be submitted to this committee should the order be opposed.
