1052 MINUTESResolved – That the minutes of the proceedings of the meeting held on 18 June 2008 having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

1053 (12) APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decisions at the previous meeting, members had undertaken site visits on the morning of the meeting. The Head of Planning submitted reports and updated them orally.

(Councillor Vickers, having declared a personal and prejudicial interest in the following applications. 08/0404 and 08/0530, left the meeting during consideration thereof)

(i) 08/0404 by Mr Keith Ready, Keith Ready and Co for the erection of four link dwellings at rear of 3 to 4 Market Place, Barton-upon-Humber.

Prior to consideration of this application an objector addressed the committee. She stated that the site was not suitable for residential development. She had concerns as to how waste would be collected and the possible storage of building materials on a public right of way. The access to the site and car parking provision was inadequate.

Councillor Mrs Sidell, attending the meeting in accordance with the provisions of Procedure Rule 37 (b) spoke on this application.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ii) 08/0530 by Mr Keith Ready, Keith Ready and Co for the erection of a bin store at 3 to 4 Market Place, Barton-upon-Humber.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

Councillor Vickers returned to the meeting.

(iii) 08/0395 by Mr M Bennett for the erection of 3 two-storey apartments at 1c Dam Road, Barton-upon-Humber.

Prior to consideration of this application the applicant and an objector addressed the committee. The applicant stated that the existing premises were surplus to requirements. The proposal would help to regenerate the area. At the time the application was made the Environment Agency had responded positively to another application across the road from the site. The site was 2 feet above the level required in the flood risk assessment. The Environment Agency had an advisory role only. There were only three small units proposed. If the river breached its defences the current site was only an insignificant part of the area that would be affected.

The objector was concerned about public safety issues. The passageway through which he would obtain access would be too small. The parking area would be too small with no turning circle provided. Vehicles would have to reverse out onto the street. There would be a loss of natural light.

Councillors Appleyard, Mrs Sidell and Vickers attending the meeting in accordance with the provisions of Procedure Rule 37 (b) spoke on this application.

1054 (13) PLANNING APPLICATIONS – The Head of Planning submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 07/1527 by Mr T Kirk for listed building consent to partially demolish the rear part of a house in order to rebuild a two – storey extension and reinstate the main roof to street elevation to its original pitch angle and height, and carry out internal and external alterations at High Street Farm, High Street, Eastoft.

Prior to consideration of this application the applicant addressed the committee. He claimed that he had submitted an application for listed building consent at the same time as the planning permission and that this had been lost. The property had been empty for five years. The development complied with the council criteria for use of empty homes.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(ii) 08/0191 by Mr Henry Burkinshaw for the change of use of a public house to a dwelling at The Crown Inn, Church Side, Church Town, Belton

Prior to consideration of this application an objector addressed the committee. She stated that the issues she had raised previously had not been addressed by the applicants.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

1055 (14) APPLICATION FOR APPROVAL OF RESERVED MATTERS FOLLOWING THE GRANT OF OUTLINE PERMISSION – 08/0515 by Mr R Robinson for approval of reserved matters following the grant of outline planning permission 06/1334 dated 22/09/2006 for the erection of two semi – detached dwellings, on land south of Humberlea, Barrow Road, New Haven

The Head of Planning submitted a report informing members about an application for approval of reserved matters which was ready for determination. Outline planning permission had already been granted and the developments had therefore been agreed in principle.

Consideration was now required to the details of the siting, design, external appearance, means of access and landscaping of the developments (excluding any of these matters which were expressly approved at the time outline permission had been granted).

Resolved – That approval be granted in accordance with the recommendation contained in the report.

1056 (15) ENFORCEMENT UPDATE – The Head of Planning submitted a schedule giving details of progress in respect of matters on which he had taken enforcement action under delegated authority.

Resolved – That the report be noted.

1057 (16) RESIDENTIAL DEVELOPMENT IN GOXHILL – Further to Minute 1049, the Head of Planning submitted a report incorporating the results of consultation with Anglian Water and with Goxhill Parish Council.

Anglian Water had no objections to the lifting of the moratorium in line with the contents of the report. It would give an update on timings etc as soon as the following year’s financial programme has been agreed. More details should be available in late August.

Goxhill Parish Council had considered this matter at its meeting held on 3 July and had resolved that the moratorium should not be lifted until such time as there is a firm conclusion and commitment from Anglian Water to carry out the necessary improvements to the sewerage system within the village.

Resolved – (a) That the moratorium be kept in place pending further discussions with Anglian Water, and (b) that the situation be reviewed in six months time.

1058 (17) PLANNING POLICY STATEMENT (PPS) 12: LOCAL SPATIAL PLANNING – The Head of Strategic Regeneration, Housing and Development submitted a report informing Members about the Government’s policy on preparing Local Development Frameworks set out in Planning Policy Statement (PPS) 12: Local Spatial Planning, issued on 5 June 2008.

The key points in the document were: –

  • Stronger emphasis on the Core Strategy being the crucial document at the heart of the Local Development Framework and having life span of 15 years from the date of adoption
  • The Core Strategy could allocate strategic sites should the need arise as well as have a greater emphasis on the provision of infrastructure to support development.
  • Streamlined consultation procedures by removing the Preferred Options stage from the pre-submission consultation stage.
  • The Tests of Soundness used by Planning Inspectors to examine Development Plan Documents had been simplified to three more easily understandable tests.
