1087 MINUTESResolved – That the minutes of the proceedings of the meeting held on 8 October 2008 having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

1088 (39) APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decisions at the previous meeting, members had undertaken site visits on the morning of the meeting. The Head of Planning submitted reports and updated them orally.

(i) 08/0044 by Singleton Birch Limited for the erection of an energy generation facility, associated infrastructure, car/vehicle parking and highway access at Singleton Birch, Brigg Road, Melton Ross, Croxton.

Prior to consideration of this application an objector addressed the committee. She praised the council for its record on recycling and suggested that if the proposed facility was to be used to dispose of household waste from North Lincolnshire this would hinder attempts to improve recycling rates. It would move waste down the waste hierarchy when national, regional and local policies encouraged moving waste up the hierarchy. The 2007 National Waste Strategy encouraged anaerobic digestion of food waste and composting. Such waste could be locked into a contract for incineration rather than being recovered. Not enough information had been given about the facility’s emissions of greenhouse gases.

Councillor Smith, attending the meeting in accordance with the provisions of Procedure Rule 37 (b), spoke on this application.

Resolved – That permission be granted in accordance with the recommendation contained in the report subject also to an additional condition relating to deliveries to ensure no loss of amenity.

(ii) 08/0997 by Keigar Homes Ltd for the erection of four dwellings and demolition of an existing dwelling at 24 High Street, Wootton.

Prior to consideration of this application an objector and a representative of the applicants addressed the committee.

The objector said that Policy H5 of the adopted Local Plan allowed for up to 3 dwellings on plots in minimum growth settlements. He did not accept that demolishing one dwelling and building four would amount to a net increase of three dwellings. The proposal was therefore over – development. The proposed dwellings would be out of character with the locality. There was inadequate provision for car parking. The proposal would lead to a loss of privacy and overshadowing of neighbouring properties. Any development should front onto High Street rather than Vicarage Lane.

The applicant’s representative stated that a pre-application meeting had taken place with planning officers. It had been agreed that the dwellings should be built fronting onto Vicarage Lane as the existing building did. This would ensure a larger distance between the dwellings and existing neighbours and would improve visibility for drivers entering High Street from Vicarage Lane.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iii) 08/1214 by Mr A Manley for the retention of amended position for dwelling (re-submission of PA/2007/1901) on Plot 26, Endell Drive, Kirton-in-Lindsey.

Prior to consideration of this application an objector and the applicant’s wife addressed the committee.

The objector stated that the dwelling had been built in accordance with a plan accompanying an earlier application for which permission had been refused. The full width of the garage block was now visible from the objector’s property and caused a loss of privacy.

The applicant’s wife stated that the dwelling had been built in the wrong place but this had not been done deliberately.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iv) 08/1114 by T A White and Sons for the retention of bunds, including landscaping, security gate and cabin at Area A, Sandtoft Industrial Estate, Belton Road, Sandtoft, Belton.

Prior to consideration of this application the applicant’s agent and an objector addressed the committee.

The applicant’s agent stated that the business had created a large number of jobs for local people. The bunds created screening from the M180 and surrounding area and provided security. The Environment Agency had now withdrawn its earlier objection.

The objector stated that the bunds spoilt the visual appearance of the site and screened unlawful activities. The cumulative impact of the gradual expansion of the industrial estate was an increase in road traffic on unsuitable roads.

Cllr Mrs Redfern, attending the meeting in accordance with Procedure Rule 37 (b) spoke on this application.

The Head of Planning confirmed that the Environment Agency had withdrawn its objection.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(v) 08/1115 by T A White and Sons for the retention of a change of use of a former airfield to open storage for timber and railway sleepers at Area A, Sandtoft Industrial Estate, Belton Road, Sandtoft, Belton.

Prior to consideration of this application the applicant’s agent and an objector addressed the committee.

The applicant’s agent stated that the application was for an area of only 0.3 hectares. The applicant was happy to accept a temporary permission.

The objector stated that the development limit should be enforced to protect local people from an incremental expansion of the industrial estate.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vi) 08/1116 by T A White and Sons for the retention of a change of use of a former airfield to open storage of paving stones at Sandtoft Industrial Estate, land off access roads in disused airfield, Sandtoft.

Prior to consideration of this application the applicant’s agent and an objector addressed the committee.

The applicant’s agent stated that the area was well screened. The storage caused no harm and created jobs The site was brownfield.

The objector stated that it was the cumulative impact of development on the airfield that was damaging.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vii) 08/1118 by T A White and Sons for the retention of a change of use of a former warehouse for B8 caravan storage at Sandtoft Industrial Estate, land at Area A, Sandtoft Industrial Estate, Belton Road, Sandtoft, Belton.

Prior to consideration of this application the applicant’s agent and an objector addressed the committee.

The applicant’s agent stated that the storage was within an existing building that had planning permission.

The objector again stated that it was the cumulative impact of development on the airfield that was damaging.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

1089 (40) MAJOR PLANNING APPLICATIONS – The Head of Planning submitted a report incorporating a schedule containing details of major applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 07/0828 by Gallagher Estates Ltd for outline permission for residential development, open space, primary school and associated access and landscaping (access not reserved for subsequent approval) on land rear of Tesco, Doncaster Road, east of A1077, Flixborough, Gunness and Scunthorpe.

The Head of Planning reported that the Environment Agency was now satisfied that the site met the requirements of a sequential test under PPS 25.

Resolved – (a) That the committee is mindful to grant permission for the development; (b) that the Head of Planning be authorised to grant permission subject to the completion of a formal agreement under Section 106 of the Town and Country Planning Act 1990 providing for the submission of a Green Travel Plan, additional works to the landscape mound and commuted sums towards off-site highway works, sport and recreation facilities, a primary school, the provision of affordable housing and the provision of one neighbourhood area of play and two local areas of play, and to the conditions set out in the report, and (c) that if the obligation is not completed by 8 February, 2009, the Head of Planning be authorised to refuse the application on grounds of non – compliance with policies in the North Lincolnshire Local Plan requiring financial contributions and the provision of affordable housing and open spaces.

1090 (41) PLANNING APPLICATIONS – The Head of Planning submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 08/0911 by CJ’s Food to Takeaway for the retention of an LPG tank at 19 Doncaster Road, Gunnness.

Resolved – that permission be refused in accordance with the recommendation contained in the report.

(ii) 08/1191 by Mr L Cheung for the extension of the ground floor to provide a WC and erect a first floor extension to provide living space (re-submission of PA/2008/0814) at 16 Westgate Road, Westgate, Belton.

Prior to consideration of this application the applicant addressed the committee. He sated that the proposal was the most economic way to improve the shop. It would not adversely effect any neighbours and would provide a valuable service for the people of Belton.

Members considered that the business was a valuable amenity

Resolved – That permission be granted subject to conditions relating to standard time limits, removal of permitted development rights for additional windows in the east and west facing walls and the extractor stack.

(iii) 08/1326 by Mr A Clarke for the erection of a two-storey extension (re-submission of PA/2008/1085) at 37 Park Avenue, Bottesford.

Resolved – that permission be granted in accordance with the recommendation contained in the report

1091 (42) ENFORCEMENT UPDATE – The Head of Planning submitted a schedule giving details of progress in respect of matters on which he had taken enforcement action under delegated authority.

Resolved – That the report be noted.

1092 (43) NORTH LINCOLNSHIRE LOCAL DEVELOPMENT FRAMEWORK – LOCAL DEVELOPMENT SCHEME TIMETABLE – Further to minute 1035 the Head of Strategic Regeneration, Housing and Development submitted a report informing members of the issues involved in preparing a revised Local Development Scheme and seeking approval to amend the Draft Local Development Scheme’s timetable.

Following changes to the Local Development Framework system, resulting from the Planning Bill which were a now set out in Planning Policy Statement (PPS) 12: Local Spatial Planning, local authorities had been given dispensation to amend timetables set out in their Local Development Schemes.

Accordingly, a revised Local Development Scheme had been drawn up based on advice from Government Office for Yorkshire and the Humber, setting out the key stages in the preparation of the documents which make up the Local Development Framework.

The window to amend the Local Development Scheme timetable was the final opportunity for local planning authorities to do so. Once agreed the dates set out in the timetable would be used to assess to the level of Housing and Planning Delivery Grant which the council will receive. Therefore it was vital that they were met.

It was considered that this revised Local Development Scheme timetable was achievable and would help to deliver sustainable development in North Lincolnshire.

Recommended to Council – (a) That the report be noted, and (b) that the Local Development Scheme timetable be approved.
