1189  MINUTESResolved – That the minutes of the proceedings of the meeting held on 14 October 2009 having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair, subject to the correction of Minute 1180 (x) by the deletion of ”against” and the substitution therefore of “in favour of”.

1190  (40) APPLICATION DEFERRED FROM PREVIOUS MEETING – In accordance with the decision at the previous meeting, members had undertaken a site visit on the morning of the meeting. The Head of Planning submitted a report and updated it orally.

Prior to consideration of the following application, 09/0982, Councillor Ellerby, having declared a personal and prejudicial interest, left the meeting.

(i)  09/0982 by Mr W Smith for outline permission for the erection of a dwelling at Cottages 1 and 2, The Grove, Trent Side, Amcotts.

Prior to consideration of this application, Councillor J Briggs, attending the meeting in accordance with the provisions of Procedure Rule 1.37 (b) spoke in support of the application.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

1191  (41) MAJOR PLANNING APPLICATIONS – The Head of Planning submitted a report incorporating a schedule containing details of major applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i)  09/0915 by North Lincolnshire Council for the carrying out of alterations and extensions in connection with combining infant and junior schools (re-submission of PA/2009/0304) and installation of an external lighting scheme at Messingham Primary Infant School, Briggate Drive, Messingham.

Prior to consideration of this application, Councillors T Foster and Poole, attending the meeting in accordance with the provisions of Procedure Rule 1.37 (b) spoke against the application

1192  (42) PLANNING AND OTHER APPLICATIONS – The Head of Planning submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i)  08/1577 by Miss S Nothard for the change of use of a former Methodist chapel to a dwelling.

Prior to consideration of this application the applicant addressed the committee. She stated that the site had been marketed for commercial use, but no interest had been shown. The Environment Agency (EA) had required a topographical survey, which was unreasonable for a single dwelling. A statement had been submitted to the EA outlining proposed flood risk measures.

(ii)  09/0772 by Haxey Parish Council for the erection of a multi-games area with associated floodlights (relocation of previously approved area PA/2005/1809) at Westwoodside Playing Field, Akeferry Road, Westwoodside, Haxey.

(iii)  09/0825 by MJH Engineering Ltd for the erection of a pair of semi-detached houses and detached garages on land east of 182 Butts Road, Barton-upon-Humber.

Resolved – That it be noted that this application has been withdrawn.

(iv) 09/0918 by Mr Johnson for outline permission to erect two detached three-bedroomed bungalows with off-road parking to include demolition of an existing dwelling at 38 Brethergate, Westwoodside, Haxey.

(v) 09/0975 by Norman Jackson Farms Ltd. for the retention of UPVC windows, doors and fascias at 2 Risby Road, Appleby.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vii) 09/1003 by North Lincolnshire Council for the change of use of land to two temporary car parks and communal gardens, construction of an access road and erection of brick walls at Market place, High Street and Johnsons Lane (Phase 1 only) at Market Place, Crowle.

Resolved – That the application be referred to the Secretary of State with a request that permission be granted for the reasons set out in the report and subject to the conditions contained in the report.

(viii) 09/1004 by North Lincolnshire Council for conservation area consent to demolish 2 and 4 Johnsons Lane, The George and Dragon public house and flat and associated walls within the site boundary at Market Place, Crowle.

Resolved – That the application be referred to the Secretary of State with a request that permission be granted for the reasons set out in the report and subject to the conditions contained in the report.

(ix) 09/1041 by the Trustees of GSA Ltd Retirement benefit Scheme for retention of a gate at 6 Market Place, Brigg.

Prior to consideration of this application an objector addressed the committee. He stated that Market lane was a thoroughfare and the application was an attempt to seize land  It would lead to the erection of more gates onto the Market Place and would deter people from passing through it even when open.

Resolved – That permission be granted in accordance with the recommendation contained in the report

Prior to consideration of the following application, 09/1091, Councillor Collinson, having declared a personal and prejudicial interest, left the meeting. Councillor Whiteley took the chair for this item only.

(x) 09/1091 by Mr J Kershaw for the change of use of shop to residential at 27 High Street, Kirton-in-Lindsey.

Resolved – That permission be granted in accordance with the recommendation contained in the report

(xi) 09/1118 by Milap Homes for the erection of a detached dwelling on land adjacent to 83 Burnham Road, Epworth

Resolved – That permission be granted in accordance with the recommendation contained in the report, subject to Condition 4 being amended to read “Nothing shall at any time, whether permitted by the Town and Country Planning (General Permitted Development) Order or not, be erected, retained, planted or allowed to grow over 1.05 metres in height above the level of the adjoining carriageway within the area shown hatched on the attached plan.”

(xii) 09/1120 by Ian Fowler and Co. for the change of use of traditional farm buildings to two residential properties and reinstatement of partly demolished building at barns adjacent to Cleatham Hall Farm, B1400 between Cleatham and Messingham, Cleatham, Manton.

Prior to consideration of this application the applicant’s agent addressed the committee. He referred to a previous refusal of an application for three dwellings on the site. Local Plan policies indicated that less than three dwellings could be acceptable in this location. The development would improve the setting of the listed building. In regard to sustainability issues the site was next to a bus stop served by a public bus service and a school bus.

Councillor Poole, attending the meeting in accordance with the provisions of Procedure Rule 1.37 (b) spoke in support of the application.

Resolved – That consideration of this application be deferred until a future meeting and that members visit the site prior to that meeting. The reason for the site visit is to allow members to assess the sustainability of the site.

(xiii) 09/1134 by Mr T Shephardson for the retention of domestic extensions at Poplar View, Soff Lane, Goxhill

Resolved – That permission be granted in accordance with the recommendation contained in the report

(xiv) 09/1137 by Cedar Medical Practice for erection of an extension to an existing medical practice at 275 Ashby Road, Scunthorpe.

Prior to consideration of this application the applicant’s agent and an objector addressed the committee. The agent stated that there was a lack of doctors’ surgeries in the vicinity. The extension would be single-storey with a disabled access, WC and baby changing facilities. It would improve the service given to the local community. It would not have any greater impact on neighbours than the existing building.

The objector was concerned at the size of the proposed extension .He believed that it would adversely affect its setting. It would be very close to his boundary and would cause him a loss of privacy due to overlooking.

Councillor Gosling, attending the meeting in accordance with the provisions of Procedure Rule 1.37 (b) spoke against the application.

Resolved – That consideration of this application be deferred until a future meeting and that members visit the site prior to that meeting. The reason for the site visit is too assess the likely impact of the proposal on neighbouring properties.

1193 (43) ENFORCEMENT UPDATE – The Head of Planning submitted a schedule giving details of progress in respect of matters on which he had taken enforcement action under delegated authority.

1194 (44) GUIDELINES ON PRODUCING TRANSPORT ASSESSMENTS – Resolved – That consideration of this item be deferred to a future meeting.

1195 (45) STATEMENT OF COMMUNITY INVOLVEMENT 2009 – The Head of Strategic Regeneration, Housing and Development submitted a report informing members of the proposed review of the Statement of Community Involvement and highlighting the forthcoming consultation that was due to take place on the Statement of Community Involvement.

The Statement of Community Involvement set out the Council’s policy and standards for involving the community, its businesses, local residents, landowners, statutory agencies and interest groups, in the planning process in North Lincolnshire. It dealt with community involvement both in the preparation and review of the planning policy documents and plans making up the Local Development Framework and in the consideration of planning applications.

Since the examination and subsequent adoption of the North Lincolnshire SCI  ‘The Planning Act 2008’ had streamlined the SCI production process and as such an independent examination was no longer required. Furthermore, the Town and Country Planning (Local Development) (England) (Amendment) Regulations 2008 had come into force on 27 June 2008. Both of these had changed the requirements for consultation on Development Plan Documents (DPDs). The SCI review outlined in the report, reflected these changes and ensured that the SCI remained fit for purpose.

It was proposed that, following consideration by Full Council, the draft Statement of Community Involvement Review would be published for a period of public consultation.

The comments received as a result of the public consultation would be used to produce the final version of the SCI Review which would then be reported to Full Council.
