1846   MINUTES – Resolved – That the minutes of the proceedings of the meeting held on 18 October 2017, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the Chairman.

1847   (53)  APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decisions at the previous meeting, members had undertaken site visits on the morning of the meeting.  The Head of Development Management submitted reports and updated them orally.

(Cllr Ogg having declared a personal and prejudicial interest left the meeting prior to consideration of the following item – Minute 1847(i) refers).

(i)          PA/2017/677 by Mr Chris Taylor, Mr Therm Ltd for planning permission to erect a single-storey front extension, form a new road crossing, including new driveway, and erect a new detached garage at 4 Stather Road, Burton upon Stather, DN15 9DH.

The agent spoke on behalf of the applicant and outlined the details of the application.  He emphasised the need to form a new road crossing and access to the property, and in doing so felt that it would enhance the dwelling and the area generally.

Cllr Marper spoke as a local ward member and thanked the committee for holding a site visit.  She had issues with the planning application, but mainly her concern was the safety with it being positioned on a blind bend, and also the fact that the dwelling was much higher than the footpath and the road, and the road was already problematic.

Cllr J Davison having visited the site also had concerns with the road and in particular the blind bend.  However, he stated that the surround properties access was no worse or different and it could possibly improve the situation in the area.

Resolved – That planning permission be granted in accordance with the recommendations contained within the report.

(At this stage of proceedings Cllr Ogg returned to the meeting).

1848   (54)  MAJOR APPLICATIONS – The Head of Development Management submitted a report containing details of major applications for determination by the committee, including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i)       PA/2017/389 by Mrs Hannah Guy, Larkfleet Homes for planning permission to erect 91 residential dwellings, including associated garages, infrastructure and public open space at land off Station Road, Kirton in Lindsey.

Two objectors addressed the committee and raised a number of concerns.  These included: increased flooding, too many house for the site, infrastructure and local services could not cope with the additional dwellings, the sewage system would not be adequate to cater for the new properties, access would be dangerous, on a major bus route, doesn’t not fit in with the neighbouring estate and would impact on the privacy of existing dwellings.

Cllr Poole as a local ward member raised the same concerns and highlighted the fact that he felt it was an unacceptable high density and was over-development of the site.  It was out of keeping with the area.

Cllr J Davison having visited the site said he had sympathy with the residents, and it was of a high density but not reason enough to refuse the application.  He also felt that the drainage issued would be significantly dealt with as part of the conditions of the planning approval if granted.

Cllr L Foster felt that the site visit had answered his questions, and the conditions would satisfy the concerns with regard to drainage.

Cllr Grant had no objections to the planning application but stated it would have been nice to see some social housing as part of the application.

Resolved – That planning permission be granted in accordance with the recommendations contained within the report.

(ii)         PA/2017/917 by Dean Property Group for outline planning application (all matters reserved except for means of access) for the erection of up to 62 dwellings at land off Enterprise Way, Winterton.

Five objectors spoke against the application.  They shared their views and concerns with the committee and covered areas including:  over 100 letters and a petition had been submitted against the application from local residents, over development of the site, highway and increased traffic concerns, potential for increased risk of flooding, pressure on the local schools and health services, natural spring situated in the centre of the site that could lead to all kinds of flood risk problems, increase in surface water run-off and drainage concerns, safety and traffic congestion issues, adjacent to an industrial estate and the loss of privacy to neighbouring properties.

Cllr Marper spoke as a local ward member and had concerns with the natural spring situated at the centre of the site, the possibility of flood risk, lack of community consultation, contrary to policies and an unsuitable location for the development.

Cllr Ogg said he had no hesitation in refusing the application to the reasons stated by the previous speakers and mainly due to the drainage and flooding issues.

Cllr Collinson said he had taken on board all the concerns received from the objectors and he disagreed with further residential development next to industrial use.  He also had concerns about the access to the site.

It was moved by Cllr Ogg and seconded by Cllr Longcake-

That planning permission be refused for the following reasons:

  1. The submitted Transport Assessment is considered to be inadequate and the applicant has failed to demonstrate that the proposed development would not be to the detriment of highway safety in terms of the proposed vehicular and pedestrian access arrangements. The proposal is therefore contrary to policies T2 and T6 of the North Lincolnshire Local Plan.
  2. Insufficient information has been provided to demonstrate that the proposed development would not lead to an increase in flood risk as an inadequate assessment has been carried out in respect of existing ground, surface and foul water drainage. The proposed development is therefore contrary to policies DS13, DS14 and DS16 of the North Lincolnshire Local Plan.

Motion Carried.

1849   (55) PLANNING AND OTHER APPLICATIONS – The Head of Development Management submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.  The Head of Development Management updated the reports orally where appropriate.  Other officers attending gave advice and answered members’ questions as requested.

(i)  PA/2017/481 by Mr Phil King for planning permission to form a fishing pond at Trentholme, Trentside, Amcotts, DN17 4AX.

The applicant briefly addressed the committee stating he was present to answer any questions or queries if required.  He said the pond was for village activity, and he was a level two coach and had looked at the project carefully before submitting the application.

Resolved – That planning permission be granted in accordance with the recommendations contained within the report.

(ii)  PA/2017/904 by Mr & Mrs Simon Smith for planning permission to retain 1.85 metre high boundary fencing at 8 Pembroke Avenue, Bottesford, DN16 3LN.

An objector spoke on behalf of a number of residents who objected to the boundary fence.  He stated that the fence had dominated the view from properties adjacent to it, and that it did not fit in with the street scene, and was out of keeping with the locality.

The agent spoke on behalf of the applicant and highlighted the fence had been erected for the safety of the children playing in the garden.  He highlighted that the conifers present before the fence was erected were actually higher than the fence, and was similar to fencing on corner plots in the area.

Cllr Armiger spoke as a local ward member and raised concerns about the height of the boundary fence, she felt it obstructed the light into properties opposite, obstructed the view for cars on the corner, and was not in keeping with the street scene.

Resolved – That planning permission be refused in accordance with the recommendations contained within the report.

(iii)  PA/2017/1002 by Mr Martin Phillips, Ongo Homes for planning permission to erect two accessible bungalows with associated boundary treatments and landscaping at land east of 101 Plymouth Road, Scunthorpe, DN17 1SS.

A resident who lived adjacent to the site objected to the application at committee on the grounds that it was the only safe place left in that area for children to play on.  He said it was used on a daily basis by children and would be a great loss of open space.

Cllr L Foster stated that he would be voting against the application as a ward Councillor as it was over development on a small green open space. He said it was the wrong site in the wrong area.

Resolved – That planning permission be granted in accordance with the recommendations contained within the report.

(iv)  PA/2017/1207 by Mr C Bingham for planning permission to erect a detached dwelling at Ashlawn, Brackenhill Road, East Lound, DN9 2LR.

The agent stated that the planning application had been amended in accordance with advice received from the Planning Officer’s, and that the proposal to develop on the land would significantly improve the appearance of the area and be in keeping with the locality.

Resolved – That planning permission be granted in accordance with the recommendations contained within the report.

(v)  PA/2017/1284 by Co-op Food, Food Programme Delivery Orchid Group for advertisement consent to display six signs at The Brocklesby Ox, High Street, Ulceby, DN39 6TG.

Resolved – That planning permission be granted in accordance with the recommendations contained within the report.

(vi)  PA/2017/1323 by Mr Mark Hutton, Trent View Medical Practice for outline planning permission for a residential development with appearance, landscaping and scale reserved for subsequent approval at land adjacent to Trent View Medical Practice, 45 Trent View, Keadby, DN17 3DR.

The agent addressed the committee and indicated that it was the second submission of the application as it was refused on the highway grounds previously.  He stated that lengthy discussions had been held with Highways and amendments and provisions had been put in place to alleviate and concerns.

Cllr Briggs spoke as a local ward member and expressed concerns about the access onto the site, problems with parking at the doctor’s surgery, and the lack of parking provision associated with the application. He suggested a reduction to seven dwellings would be a more suitable option.

It was moved by Cllr Longcake and seconded by Cllr Glover –

That Planning permission be refused for the following reasons –

  1. (vii)  PA/2017/1350 by Mr & Mrs Terry Smith for outline planning permission to erect a one-bedroom bungalow with parking provision at land adjacent to 9 Gainsborough Lane, Scawby, DN20 9DF.

Cllr Glover felt that it was an excellent proposal and supported the application.

It was moved by Cllr Glover and seconded by Cllr L Foster –

That planning permission be granted in accordance with the following conditions-

  1. Approval of the details of the scale and appearance of the building(s) (hereinafter called ‘the reserved matters’) shall be obtained from the local planning authority in writing before any development is commenced.

Reason
The application has been made under Article 5(1) of the Town & Country Planning (Development Management Procedure) (England) Order 2015.

  1. Plans and particulars of the reserved matters referred to in condition 1 above, relating to the scale and appearance of any buildings to be erected, shall be submitted in writing to the local planning authority and shall be carried out as approved.

Reason
The application has been made under Article 5(1) of the Town & Country Planning (Development Management Procedure) (England) Order 2015.

  1. Application for approval of the reserved matters shall be made to the local planning authority before the expiration of three years from the date of this permission.

Reason
To comply with the provisions of Section 92 of the Town and Country Planning Act 1990.

  1. The development hereby permitted shall be begun either before the expiration of five years from the date of this permission, or before the expiration of two years from the date of approval of the last of the reserved matters to be approved, whichever is the later.

To comply with the provisions of Section 92 of the Town and Country Planning Act 1990.

  1. The development hereby permitted shall be carried out in accordance with the following approved plans: TS/17/01 and TS/17/02A.

Reason
For the avoidance of doubt and in the interests of proper planning.

  1. No development shall take place until details have been submitted to and approved in writing by the local planning authority of the make, type and colour of all external facing materials for the development and only the approved materials shall be used.

Reason
To ensure that the building is in keeping with its surroundings in the interests of visual amenity, in accordance with policy DS1 of the North Lincolnshire Local Plan.

  1. No development shall take place until a scheme for the disposal of foul and surface water has been agreed in writing by the local planning authority and none of the dwellings shall be occupied until it is connected to the approved drainage system.

Reason
To ensure satisfactory drainage is provided in accordance with policy DS14 of the North Lincolnshire Local Plan.

  1. No development shall take place until details of:

(i)       the location and layout of the vehicular access; and

(ii)      the number, location and layout of vehicle parking and turning spaces within the curtilage of the site;

have been submitted to and approved in writing by the local planning authority.

In the interests of highway safety and to comply with policies T2 and T19 of the North Lincolnshire Local Plan.

  1. Adequate vehicle access, parking and turning facilities serving the existing dwelling shall be retained in accordance with details to be submitted to and approved in writing by the local planning authority.

In the interests of highway safety and to comply with policies T2 and T19 of the North Lincolnshire Local Plan.

  1. No development shall take place until details showing an effective method of preventing surface water run-off from hard paved areas within the site onto the highway have been submitted to and approved in writing by the local planning authority. These facilities shall be implemented prior to the access and parking facilities being brought into use.

Reason
In the interests of highway safety and to comply with policy T19 of the North Lincolnshire Local Plan.

  1. No loose material shall be placed on any driveway or parking area within 10 metres of the adopted highway unless measures are taken in accordance with details to be submitted to and approved in writing by the local planning authority to prevent the material from spilling onto the highway. Once agreed and implemented these measures shall be retained.

Reason
In the interests of highway safety and to comply with policy T19 of the North Lincolnshire Local Plan.

  1. The dwelling shall not be occupied until the vehicular access to it and the vehicle parking and turning space(s) serving it have been completed and, once provided, the vehicle parking and turning space(s) shall be retained.

Reason
In the interests of highway safety and to comply with policies T2 and T19 of the North Lincolnshire Local Plan.

  1. If, during development, any odorous, discoloured or otherwise visually contaminated material is found to be present at the site then no further development shall be carried out until a written method statement detailing how this contamination shall be dealt with has been submitted to and approved in writing by the local planning authority.

Reason
To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other off-site receptors in accordance with policy DS7 of the North Lincolnshire Local Plan.

(viii)  PA/2017/1436 by Mr & Mrs Altoft for planning permission to erect a bungalow with accommodation in the roof space, construct associated hard standing for vehicle parking, turning and access and relocate existing garage with vehicle parking to the front at 7 Elmdale, Barton upon Humber, DN18 5EB.

An objector raised a number of concerns and they included the detrimental impact it would have on the area, overbearing impact on the area, removal of a number of trees, and that it was contrary to Policy H8 of the North Lincolnshire Local Plan.

Cllr P Vickers spoke as a local ward member expressed his concern at the lack of notification residents had been given to submit their objections, and said it was too late for them to address the Town Council before they made their decision on it.  He highlighted that there had been significant public interest in the application and suggest the committee hold a site visit.

Resolved – That consideration of this application be deferred to a future meeting and that members visit the site prior to the meeting.

(ix)  PA/2017/1470 by Mr Ronald Ogg for planning permission to retain a brick wall at West End Farm, 2 Marsh Lane, Winteringham, DN15 9PA.

Cllr Marper stated that the Parish Council were not happy with the type of brick to be used, and would not be in keeping with the rest of the brickwork and wall in a conservation area.

Resolved – That planning permission be granted in accordance with the recommendations contained within the report.

1850   (56) PLANNING STATISTICS – APRIL TO SEPTEMBER 2017 – The Group Manager – Development & Building Control submitted a report for information that updated the Committee on the planning statistics for April – September 2017.
