Healthier Communities and Older People Scrutiny Panel (Special Meeting) – 29 April 2009

PRESENT:  Councillor Barker in the chair.

Councillors Sidell (vice-chairman), Barkworth, Bunyan, Collinson, Simpson and Wells.

Councillor Carlile attended the meeting as decision maker.

Councillors Briggs, Redfern and Swift attended the meeting in accordance with Procedure Rule 37 (b).

The panel met at Pittwood House, Scunthorpe.

155  DECLARATIONS OF PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND DECLARATIONS OF WHIPPING ARRANGEMENTS (IF ANY) – There were no declarations of personal or personal and prejudicial interests.

No whip was declared.

156  EXCLUSION OF THE PUBLIC – Resolved – That the public be excluded from the meeting for consideration of the following item (Minute 157 refers) on the grounds that it involves the likely disclosure of exempt information as defined in paragraphs 1 and 2 of Part 1 of Schedule 12A of the Local Government Act 1972 (as amended).

157  (24) ITEM REQUESTED FOR CALL-IN IN ACCORDANCE WITH PARAGRAPH 22 OF PART D RULE 5 (OVERVIEW AND SCRUTINY PROCEDURE RULES) OF THE COUNCIL’S CONSTITUTION – Minute 39 of the Adult Services Cabinet Member meeting held on 21 April 2009 – The chair invited a nominee of the members who had requested the call-in to speak on the above decision and question the Adult Services Cabinet Member.  The nominated member outlined areas of concern as reasons for seeking a review of the above decision.  These included: –

(i)  ‘The timing of the taking of this decision had prevented the inclusion of members of the Healthier Communities and Older People Scrutiny Panel from participating in the consultation process.  Resultantly, it had not been possible for members to raise concerns regarding the proposed structure prior to the decision being taken.

(ii)  Examination of the proposals gives rise to a number of structural concerns or queries that necessitate early discussion by members’.

Following discussions on the above issue, the Adult Services Cabinet Member was invited to respond to the concerns and reasons for the decision being called in, and be held to account for the decision taken.  The Service Director Adult Social Care was also invited to comment.

It was then –

Moved by Councillor Sidell and seconded by Councillor Bunyan –

(a) That the above decision (minute 39 refers) be referred back to the decision maker for reconsideration within five working days, and (b) that a further special meeting of this scrutiny panel be held prior to the expiry of the fifth day in order that the Cabinet Member can provide the members with additional information, for example, management structures etc.

Moved by the chair and seconded by Councillor Collinson –

(a) That no further action be taken, and the above decision of the Adult Services Cabinet Member (minute 39 refers) be allowed to be implemented with immediate effect, and (b) that the scrutiny panel be consulted on any additional changes to the service.
