People Scrutiny Panel (Special Meeting) – 28 August 2013

MINUTES

PRESENT:  Councillor Marper in the chair.
Councillors Collinson (Vice-Chair), Clark, L Foster and Wells.

Statutory Co-opted Members:  Mrs D Senior (Parent Governor Representative).

Councillors Briggs, Davison, Grant, Ogg, Poole, Redfern, Rowson and Wilson attended the meeting in accordance with the provisions of Procedure Rule 1.37 (b).

The panel met at the Civic Centre, Scunthorpe.

209  DECLARATIONS OF DISCLOSABLE PECUNIARY INTERESTS AND PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND DECLARATIONS OF WHIPPING ARRANGEMENTS (IF ANY) – There were no declarations of pecuniary or personal and prejudicial interests.

No whip was declared.

210  (4)  ITEM REQUESTED FOR CALL-IN IN ACCORDANCE WITH PARAGRAPH 22 OF PART D RULE 5 (OVERVIEW AND SCRUTINY PROCEDURE RULES) OF THE COUNCIL’S CONSTITUTION – Minute 94 of the People Cabinet Member meeting held on 22 August 2013 – Consultation on the building of an Intermediate Care Facility – The Chairman welcomed everyone to the meeting, and invited a nominee of the members who had requested the call-in to speak on the above decision and question the Cabinet Member.  Members outlined areas of concern as reasons for seeking a review of the above decision.  Namely, the decision –

  • Was not in accordance with the budget,
  • Duplication of facilities
  • Insufficient time for community to explore service delivery or asset transfer,
  • Flawed consultation,
  • No regard to petition hearing, and
  • Failure to account petitioners in consultation.

Following a discussion on the above issues, the People Cabinet Member was invited to respond to the concerns and reasons for the decision being called in, and be held to account for the decision taken.

Following the Cabinet Member response, the Chairman invited members of the public in attendance to question the Cabinet Member.  Councillor Waltham responded accordingly.

The Chairman then invited panel members and other councillors present to question the Cabinet Member on the issues raised at the meeting, before being invited to respond to the concerns and reasons for the decision being called in, and be held to account for the decision taken.  The Director of People was also invited to comment.

It was then –

Moved by Councillor Collinson and seconded by Councillor L Foster –

That the decision be referred to council as members believe it was contrary to the policy framework or contrary to or not wholly consistent with the council’s budget.

Moved by Councillor Wells and seconded by Councillor Clark as an amendment –

That no further action be taken, and the above decision of the People Cabinet Member (minute 94 refers) be implemented with immediate effect.
