3.  Localism Act 2011 – Code of Conduct – To consider two complaints.

25  DECLARATIONS OF DISCLOSABLE PECUNIARY, PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS – There were no declarations of disclosable pecuniary interests, personal or personal and prejudicial interests.

26  EXCLUSION OF THE PUBLIC – Resolved – That the public be excluded from the meeting for consideration of the following item (Minute 12 refers) on the grounds that it involves the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A of the Local Government Act 1972 (as amended).

27  (1)  LOCALISM ACT 2011 – CODE OF CONDUCT – COMPLAINTS  – 13/04 and 13/05 by a member of North Lincolnshire Council against a member of North Lincolnshire Council – In accordance with the Council’s adopted Arrangements, the Panel considered two complaints. In each case the Panel had been provided with the complaint and the response of the subject member.

Mr J Goolden (Independent Person) had submitted his views on whether a departure from the council’s adopted Arrangements might be appropriate, as provided for in Paragraph 12 of the Arrangements. In the circumstances he considered that this would be appropriate and the Chairman indicated that he was minded to exercise his authority to depart from the Arrangements and refer the complaints externally for assessment, having consulted the Independent Person.

Resolved – (a) That the Panel not consider the content of the complaints, and (b) that the Chairman’s proposal that they be referred to North East Lincolnshire Council’s Monitoring Officer and Assessment Panel to consider be endorsed.
