249 MINUTES – Resolved – That the minutes of the meeting held on 23 April 2003, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

APPOINTMENT OF TAXI LICENSING SUB-COMMITTEE MEMBERSResolved – That Councillors Barkworth, Clark, Ellerby, Osborne and Wells be appointed to the Taxi Licensing Sub-Committee.

251 (1) LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1982 – APPLICATION FOR RENEWAL OF A STREET TRADING CONSENT, WENTWORTH ROAD, SOUTH PARK INDUSTRIAL ESTATE, SCUNTHORPE – The Director of Environment and Public Protection submitted a report concerning an application for the renewal of a street trading consent at the above location. Details of the application were outlined in the report.

The Director in his report reminded the committee that the options available to it under the Local Government (Miscellaneous Provisions) Act 1982 when considering such applications were: –

  • To renew the licence as applied for with no additional conditions or restrictions other than those normally applied to such licences.
  • To renew the licence, subject to different terms, conditions or restrictions.
  • To refuse to renew the licence, as applied for.

In the event that members considered that the application should have a fuller hearing the matter might be deferred to a further meeting to which all interested parties would be invited in order to make representations.

Resolved Unanimously – That the licence be renewed with the conditions normally applied to such licences.

(2) LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1982 – STREET TRADING CONSENTS – SPECIAL EVENTS – The Director of Environment and Public Protection submitted a report proposing changes in the way that street trading consents are administered and issued for special events.

Currently, traders attending “special events” are required to submit an application to the council individually to trade. The current fee for an occasional street trading consent is £18.

However, it is proposed that a single application should be made for such events by the organiser. With this application, a schedule should be included providing details of the traders and the streets on which they will trade. This would not include any hot food traders.

Any trader attending the special event, but who isn’t included on the schedule would still be required to apply for an occasional permit as would hot food traders.

The proposed fees for a special events consent are as follows: –

Band 3 Special Event with over 20 traders £72

Special events would be determined by the public events group or by the licensing unit. Arrangements would then be made with the event organiser to prepare the schedule of traders and streets.

Resolved – (a) That the proposed arrangements and fees for street trading consents at special events be approved with immediate effect, and (b) that a further report be brought back to this committee in six months time informing members of the effect of the new fees.

253 (3) HACKNEY CARRIAGE AND PRIVATE HIRE VEHICLE DRIVERS – DECLARATION OF CONVICTIONS – REHABILITATION OF OFFENDERS ACT 1974 – STATUTORY INSTRUMENT 2002 NO 441 – THE REHABILITATION OF OFFENDERS ACT 1974 (EXEMPTIONS)(AMENDMENT) ORDER 2002 – The Director of Environment and Public Protection submitted a report advising members of an amendment to the Rehabilitation of Offenders Act 1974 (Exemptions) Order 1975, in the form of Statutory Instrument 2002 No. 441, which affects the way in which the council considers convictions for hackney carriage and private hire vehicle drivers.

Resolved – That the change in legislation be noted.
