MINUTES

PRESENT: Councillors Davison, Eckhardt and Ellerby

The sub-committee met at Pittwood House, Scunthorpe.

700 CHAIR – Resolved – That Councillor Davison be hereby appointed chair for the meeting.

Councillor Davison thereupon took the chair.

701 DECLARATIONS OF PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND SIGNIFICANT CONTACT WITH APPLICANTS, OBJECTORS OR THIRD PARTIES (LOBBYING) – There were no declarations of personal or personal and prejudicial interests.

702 (4) LICENSING ACT 2003 – APPLICATION FOR GRANT OF A PREMISES LICENCE, THE FRIARY, 66 OLD BRUMBY STREET, SCUNTHORPE – The Service Director Neighbourhood and Environment submitted a report advising members of an application for grant of a premises licence at the Friary, 66 Old Brumby Street, Scunthorpe.

Details of the application were outlined in the report, together with the review application form and supporting documents submitted by Humberside Police, Environmental Protection, the applicant and objectors.

There was no application to vary the procedure.

The Service Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

  • To refuse to grant the licence
  • To grant the licence with additional conditions
  • To grant the licence without additional conditions
  • To grant the licence but restrict the licensable activities
  • To grant the licence with restricted times

The applicant and their representative, interested parties and objectors addressed the sub-committee and responded to questions.

Following the summary of the case, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows: –

Resolved – The Sub-Committee resolved unanimously to grant the premises license, with the following conditions –

1. Condition

That the premises operating hours be restricted to the hours as agreed between the license-holder and Environmental Protection. Namely, Sunday to Thursday until midnight, Friday and Saturday and New Years Day until 1am.

Reason

To reduce noise and public nuisance in unsociable hours

2. Condition

That CCTV be installed on the premises, in consultation with Humberside Police, as expediently as possible, but no later than three months after the appeal process has ended.
