The sub-committee met at Pittwood House, Scunthorpe.

787  CHAIR – Resolved – That Councillor Smith be hereby appointed chair for the meeting.

Councillor L Foster thereupon took the chair.

788  DECLARATIONS OF PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND SIGNIFICANT CONTACT WITH APPLICANTS, OBJECTORS OR THIRD PARTIES (LOBBYING) – There were no declarations of personal or personal and prejudicial interests.

789  (11),LICENSING ACT 2003 – APPLICATION FOR VARIATION OF A CLUB PREMISES LICENCE, ROBERT HOLME HALL SOCIAL CLUB, CHURCH LANE, SCUNTHORPE – The Service Director Neighbourhood and Environment submitted a report advising members of an application for a variation of a club premises licence at Robert Holme Hall Social Club, Church Lane, Scunthorpe.

Details of the application were outlined in the report, together with the application to vary the club remises licence, a copy of the mediation between the applicant and Humberside Police and three letters of objection from interested parties.

There was no application to vary the procedure.

The Service Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

  • To modify the conditions of the certificate; or to
  • To reject the whole or part of the application

The applicant, responsible authorities and the interested parties addressed the sub-committee and responded to questions.

Following the summary of the case, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows: –

Resolved – The Sub-Committee resolved unanimously to modify the conditions of the certificate, with the following conditions –

  1.  Condition

That all licensable activities be granted from 11:00 hours to 23:00 on Sunday to Thursday inclusive, and from 11:00 hours to 24:00 hours on Friday and Saturday, with the exception of up to 12 events per year, where the license may be extended until 01:00 hours the following morning, giving a clear ten day’s notice of these events to the police and licensing authority.  The non-standard timings, including bank holidays, the Christmas period and New Year, to be granted as applied for.

Reason

To prevent excessive noise affecting local residents in accordance with paragraph 65(1) of North Lincolnshire Council’s Licensing Policy.

  1.  Condition

That conditions to be applied as consistent with the club’s Operating Schedule (for reference, on page 34 of the papers)

The condition relates to the following Licensing Objectives –

The Prevention of Public Nuisance No
The Protection of Children from Harm Yes

Reason

To adhere to the three licensing objectives above.

  1.  Condition

That during opening hours, and especially during events, a Steward or relevant committee member make regular checks of the noise levels outside of the premises, and to ensure that all windows and doors are closed during events.
