The sub-committee met at Pittwood House, Scunthorpe.

931  CHAIR – Resolved – That Councillor Clark be and he was hereby appointed chair for the meeting.

Councillor Clark thereupon took the chair.

932  DECLARATIONS OF PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND SIGNIFICANT CONTACT WITH APPLICANTS, OBJECTORS OR THIRD PARTIES (LOBBYING) – There were no declarations of personal or personal and prejudicial interests. 

933  (5)  LICENSING ACT 2003 – APPLICATION FOR THE GRANT OF A PREMISES LICENCE, ‘QUICK STOP’, 39-41 ASHBY HIGH STREET, SCUNTHORPE – The Director of Neighbourhood and Environmental Services submitted a report advising members of an application for the grant of a premises licence at the ‘Quick Stop’, 39-41 Ashby High Street, Scunthorpe.

Details of the application were outlined in the report, together with the application form and supporting papers submitted by the applicant and a copy of an objection received from a Kingsway with Lincoln Gardens Ward Councillor. Three representations received from interested parties against the application, a copy of an email stating conditions Humberside Police would like adding to the licence were it to be granted, and, following successful mediation between the applicant and Humberside Police, a copy of an e mail stating agreement had been reached with the applicant on a condition to be added to the licence and a petition and letter of support for granting the licence, were also included in the Director’s report.

There was no application to vary the procedure.

The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

  • To refuse to grant the licence
  • To grant the licence with additional conditions
  • To grant the licence without additional conditions
  • To grant the licence but restrict the licensable activities
  • To grant the licence with restricted times.

The applicant’s solicitor and an interested party addressed the sub-committee and responded to questions.

Following the summary of the case, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows:  

Resolved – That the premises license be granted with the following conditions: 

1.  Condition

A full CCTV system shall be in operation at the premises in accordance with the Humberside Police Codes of practice. This shall cover the internal areas so that persons purchasing alcohol could be easily identified.

2.  Condition

That external CCTV be installed to the outside perimeter of the premises, monitoring Smithfield Road and Ashby High Street.

3.  Condition

A challenge 21 policy shall be implemented at the premises and brought to the customer’s attention by way of point of sale material where the alcohol was displayed and at the checkout.

4.  Condition 

All tills shall have a prompt system for alcohol sales.

5.  Condition 

Anyone who appeared to be under 21 shall be asked to produce recognised photographic proof of age document. Acceptable forms of identification shall be ‘passport’, ‘photocard driving licence’ or ‘pass’ approved and hologrammed identification.

To ensure that minors are not able to purchase alcohol.

6.  Condition 

A refusals book or electronic log shall be kept recording the details of refused alcohol sales, which shall be audited by the DPS or duly appointed key member of staff to assess employees compliance with the company’s policy on refusing alcohol sales.

7.  Condition

Staff training shall take place every six months with regard to the company’s policy on alcohol sales.  The DPS or duly appointed key member of staff shall maintain a written record of all training, which employees shall be required to sign.
