MINUTES

PRESENT: –  Councillors K Vickers, P Vickers and Whiteley.

The sub-committee met at the Civic Centre, Scunthorpe.

1197   CHAIRMAN – Resolved – That Councillor K Vickers be and he is hereby appointed chairman for the meeting.

Councillor K Vickers thereupon took the chair.

1198   DECLARATIONS OF DISCLOSABLE PECUNIARY INTERESTS, PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND SIGNIFICANT CONTACT WITH APPLICANTS, OBJECTORS OR THIRD PARTIES (LOBBYING) – There were no declarations of disclosable pecuniary interests and personal or personal and prejudicial interests.

1199   (14)    LICENSING ACT 2003 – APPLICATION FOR THE GRANT OF A PREMISES LICENCE CAFÉ INDIPENDENT, 169-173 HIGH STREET, SCUNTHORPE – The Director of Places submitted a report advising members of an application for the grant of a premises licence at Café Indipendent, 169-173 High Street, Scunthorpe.

Details of the application were outlined in the report, together with the application for a premises licence, correspondence received from Humberside Police and the Environmental Health (Commercial) unit at North Lincolnshire Council, and a letter received from an Interested Person.

The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

To refuse to grant the licence;
To grant the licence with additional conditions;
To grant the licence without additional conditions;
To grant the licence but restrict the licensable activities;
To grant the licence with restricted times.

There was no request to vary the procedure.

The applicant, Responsible Authorities (Humberside Police and Trading Standards) and the Interested Person addressed the sub-committee and responded to questions.

Following the summary of the case of the applicant, Responsible Authorities (Humberside Police and Trading Standards) and the Interested Person, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows: – 

Resolved – That the application as applied for be granted, subject to the inclusion of the following additional conditions –

  1. Condition

That the Challenge 25 and CCTV conditions, as outlined by Humberside Police on page 49 of the agenda bundle, be attached to the licence.

Reason

To ensure the welfare and safety of patrons at the premises.

  1. Condition

That windows and doors shall be kept closed whilst any live or recorded music is being played except for immediate access and egress

The Protection of Children from Harm No

 Reason

To protect the amenities of local residents and minimise noise nuisance.

  1. Condition

That a coloured wristband scheme be in operation at all times when alcohol is offered for sale, in accordance with any guidance provided by Humberside Police.
