4.  Any other items which the chairman decides are urgent by reason of special circumstances which must be specified.

MINUTES

PRESENT: –  Councillors Clark, Ellerby and K Vickers.

The sub-committee met at the Civic Centre, Scunthorpe.

1217   CHAIRMAN – Resolved – That Councillor K Vickers be and he is hereby appointed chairman for the meeting.

Councillor K Vickers thereupon took the chair.

1218   DECLARATIONS OF DISCLOSABLE PECUNIARY INTERESTS, PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND SIGNIFICANT CONTACT WITH APPLICANTS, OBJECTORS OR THIRD PARTIES (LOBBYING) – There were no declarations of pecuniary interests or personal or personal and prejudicial interests.

1219   (23)    LICENSING ACT 2003 – APPLICATION FOR THE GRANT OF A PREMISES LICENCE AT THE FERRY BOAT INN AND GRILL, SOUTH STREET, WEST BUTTERWICK – The Director of Places submitted a report advising members of an application for the grant of a premises licence at the Ferry Boat Inn and Grill, South Street, West Butterwick.

Details of the application were outlined in the report, together with the application for the grant of the premises licence, a plan of the premises, a location map, correspondence received from the Environmental Health (Commercial) department and Licensing Authority at North Lincolnshire Council, a letter from Humberside Fire and Rescue Service, a letter from Humberside Police and a letter received from an Interested Person.

The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

To refuse to grant the licence
To grant the licence with additional conditions
To grant the licence without additional conditions
To grant the licence but restrict the licensable activities
To grant the licence with restricted times

The Licensing (Activities) Sub-Committee received a request from the Licensing Authority to dispense with the hearing.  The applicant had successfully mediated with the Licensing Authority, Humberside Police and Environmental Health (Commercial).  In addition, a letter from Humberside Fire and Rescue Service had been received in support of the application.  There was only one objection outstanding, with the Interested Person unable to attend the hearing.

Therefore, it was felt that the hearing could be adjourned without hearing evidence, at which point the sub-committee could consider the application and the agreed conditions against the Interested Persons representation. 

The Chairman invited the council’s legal representative to comment on the request to vary the procedure.

The council’s legal representative informed the meeting that variation of the procedure was at the sub-committee’s discretion and any decision should be based upon whether or not the variation would further assist the sub-committee in reaching a decision.

A short adjournment ensued to allow the sub-committee to discuss the Licensing Authority’s application to vary the procedure, whereby the sub-committee agreed that the hearing would proceed as per the procedure contained within the agenda documentation.

The applicant’s representative, an officer from Environmental Health (Commercial) and the Licensing Authority addressed the sub-committee and responded to questions.

Following the summary of the case of the applicant and Responsible Authorities, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows: – 

Resolved – That the application as applied for be granted, subject to the agreed conditions contained within the agenda bundle at Appendix E, F and G being adhered to and incorporated within the premises licence.
