MINUTES

PRESENT: –  Councillors Armitage, K Vickers and P Vickers.

The sub-committee met at the Civic Centre, Scunthorpe.

1383   CHAIRMAN – Resolved – That Councillor K Vickers be and he is hereby appointed chairman for the meeting.

Councillor Vickers thereupon took the chair.

1384   DECLARATIONS OF DISCLOSABLE PECUNIARY INTERESTS, PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND SIGNIFICANT CONTACT WITH APPLICANTS, OBJECTORS OR THIRD PARTIES (LOBBYING) – The following member declared an interest –

1385   (22)    APPLICATION TO VARY A PREMISES LICENCE, BRITANNIA NEWS AND BOOZE, 11 DONCASTER ROAD, SCUNTHORPE The Director of Places submitted a report advising members of an application for the variation of a premises licence at Britannia News and Booze, 11 Doncaster Road, Scunthorpe.

Details of the application were outlined in the report, together with the application for the variation of a premises licence, a representation from Environmental Health (Commercial), a representation from Humberside Police, a representation from the Licensing Authority, two letters of objection from interested persons and a location map.

The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

  • To refuse to vary the licence.
  • To vary the licence with additional conditions.
  • To vary the licence without additional conditions.
  • To vary the licence but restrict the licensable activities.
  • To vary the licence with restricted times.

The applicant’s legal representative informed the sub-committee that following information he had received prior to the hearing from the Licensing Authority, the applicant wished to withdraw the application.

The Chairman invited the council’s legal representative to comment on the request to withdraw the application.

The council’s legal representative informed the meeting that it was at the applicant’s discretion whether they wished to proceed or withdraw the application.

Resolved – That following the withdrawal of the application, the application not be considered and the meeting be closed.
