1956   MINUTES – Resolved – That the minutes of the proceedings of the meetings held on 3 April and 5 June 2019, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the Chairman.

1957    APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decisions at the previous meeting, members had undertaken site visits on the morning of the meeting.  The Group Manager – Development Management submitted reports and updated them orally.

(i)  PA/2018/1381 by Mr and Mrs R Burnett for planning permission to erect five detached dwellings with private drive and associated external landscaping at 7 Vicarage Lane, Wootton, DN39 6SH.

An objector spoke against the application as he felt there was more suitable land supply available to fulfil the need of the is application, as most residents were not against the proposal, just the location. He stated it was the third attempt on a greenfield site, and was outside the boundary line.

The agent responded and indicated that the application fulfilled the key elements of planning policy, and felt it should be approved and proposed no significant harm to the village, and was in accordance with planning officer recommendations.

Cllr Hannigan spoke as the local ward member and highlighted that Wootton was a peaceful, rural setting and there was a development boundary to protect the environment.  He felt Wootton had already taken its fair share of housing development and the application was contrary to policy.

Cllr Wells stated he was uneasy with the application as it was out of character with the area, and in breach of panning policy being outside the boundary line.

Cllr Evison did not feel there was anything wrong with the proposal in front of him.

It was move by Cllr Evison and seconded by Cllr Glover

That planning permission be granted in accordance with the recommendations contained within the officer’s report.

Moved by Cllr Wells and seconded by Cllr L Foster as an amendment –

That planning permission be refused.

(ii)  PA/2019/326 by Mr Jim Colver for outline planning permission for the erection of one dwelling with all matters reserved (re-submission of PA/2018/248) at land adjacent to Saffron Garth, High Street, Belton, DN9 1NL.

Representing a number of objectors the committee were informed that they objected to the proposal due to it being – back land development, out of character with the area, access dangerous and traffic would increase, and there was already a surplus of dwellings available in the area.

The agent stated that the piece of land was more residential then other areas that had been developed on, and following the application the Highways Department had removed their objections.  He did not believe it was back land development, and it was right on the designated limit for the development boundary.

Resolved – That planning permission be refused in accordance with the reasons contained within the officer’s report.

1958   MAJOR APPLICATIONS – The Group Manager – Development Management submitted a report containing details of major applications for determination by the committee, including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i)   PA/2018/1966 by Mr A Akins for outline planning permission for up to 200 dwellings with appearance, landscaping, layout and scale reserved for subsequent approval at land south of Morrwell Road, Yaddlethorpe, Bottesford.

Two residents spoke against the application.  In doing so they objected to the proposal for the following reasons – it was outside the development boundary, the infrastructure could not cope with the additional dwellings, highway safety impacts from increased traffic, and the loss of wildlife.

Representatives supporting the application addressed some of the concerns raised at the meeting, and stated most of them would be covered within the conditions.  They did not feel traffic would be made any worse by the application, there was a sustainable drainage in place and it was also in a sustainable location.  They indicated a full ecology report had been carried out and it would be an enhancement of the area, along with the benefits from the Section 106 provisions.

The Chairman read out a letter of concerns from the local MP Nick Dakin.

Cllr J Davison as the local ward member was concerned with the application. Firstly because it was outside the boundary limits, and also due to the following reasons – there was a high pressure pipeline running through the proposed development, and a structure should not be built over it. No commitments from Severn Trent water had been received to ease concerns around flooding and foul sewage, traffic would increase on an already very busy road, there was no space at the schools or doctors and it was against planning policy.

Cllr L Foster also raised similar concerns and was worried about the immediate effects on homes in the area, especially with even more increased traffic. He stated he was opposed to the application and it was outside the development boundary.

It was moved by Cllr Longcake and seconded by Cllr Evison –

That planning permission be refused for the following reasons –

1.
The proposal, by virtue of its location, would introduce harmful character impacts upon the open countryside of North Lincolnshire. Furthermore, the proposal would introduce a significant amount of built form on a greenfield site outside the identified settlement of Scunthorpe and Bottesford that would urbanise the existing rural landscape. The proposal is therefore contrary to the aims of policies CS2 of the North Lincolnshire Core Strategy and RD2 of the North Lincolnshire Local Plan.

2.
The proposed access arrangement would intensify the use of the existing highway infrastructure exacerbating existing local highway safety concerns. The proposal would therefore carry highway safety impacts that would put both existing and future users at risk. The proposed development is contrary to the aims of policy T2 of the North Lincolnshire Local Plan.

3.
The proposal would give rise to unacceptable residential amenity concerns by virtue of proximity to access points and the number of vehicular trips this would generate. The proposal is therefore contrary to the aims of policy DS1 of the North Lincolnshire Local Plan.

Motion Carried.

(ii)  PA/2018/2316 by Mr Mark Wilden, Premier Property Acquisitions Limited for outline planning permission for up to 10 dwellings with all matters reserved for subsequent approval at land off Burnside, Broughton, DN20 0HT.

Three objectors addresses the committee. They were against the application for a number of reasons and highlighted that it was the third time it had be submitted and every time it had received the same objections. They had concerns over the highway and the increase in traffic, the drainage and worries about the system not being able to cope, the character of the area would be affected as it was mainly elderly residents, and access would difficult and make passing traffic impossible.

Cllr Mumby-Croft as the local ward member also had concerns about the access road, and stated it was not the dwellings that were the problem but the extra traffic, and access problems.

Cllr Glover stated he was fully aware of the site, and felt alternative access should be sought, and until it was he was against the proposal.

Resolved – That planning permission be granted in accordance with the recommendations contained within the officer’s report.

(iii)  PA/2018/2525 by Mr P Strawson, M F Strawson Limited for outline planning permission to erect 90 dwellings and construct access, with appearance, landscaping, layout and scale reserved for subsequent approval at land at Station Road, Ulceby.

The agent spoke on behalf of the applicant and stated that the developers had spoken with stakeholders in the area, and identified a housing needs also suitable for the elderly.  She indicated that it would also fulfil the councils five year housing supply. She outlined the financial contributions that would be made to the community, and highlighted an extension of the 30MPH speed limit would be enforced.

Cllr Hannigan had received concerns from any Ulceby residents, and urged the committee to refuse the application.  He felt it was not a sustainable development , not within the boundary limits, speeding is a real problem, flood risks, he said the site was unsuitable and against planning policy.

Cllr Wells said it would change the character of the area, change the rural horizon, and was against planning policy.  He said he was also against the application as it was away from the main boundary of the village, it would not be sustainable, and would lead to increase problems with surface water and sewerage problems.

Cllr Collinson did not feel the committee could demonstrate clear reasons enough to refuse the application.

It was moved by Cllr Wells and seconded by Cllr Evison –

That planning permission be refused for the following reasons –

1.

(iv)  PA/2019/320 by Mr Coggon, Coggon Brothers Limited for planning permission to erect a general purpose agricultural building and a potato store, including hard standing and ancillary site works at field 7478, land north-west of North Street, West Butterwick.

The applicant felt the objection by the parish Council was a bit misleading as it was dominated by the motorway and a windfarm, so did not see how it could have an impact on the landscape character.  He stated there had been no complaints from Highways with regard to the access, and stated the historic landscape strips were no longer there.

Resolved – That planning permission be refused in accordance with the reasons stated in the officer’s report.

1959    PLANNING AND OTHER APPLICATIONS – The Group Manager – Development Management submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.  The Head of Development Management updated the reports orally where appropriate.  Other officers attending gave advice and answered members’ questions as requested.

(i)    PA/2018/2330 by Ms Julie Pressler for outline planning permission to erect eight semi-detached dwellings and construct access (scale, appearance and landscaping reserved for subsequent approval) at 21 New Street, Elsham, DN20 0RP.

The committee heard from an objector who highlighted that the application was outside of the development boundary, and that there were no facilities available for new residents. He felt it would be detrimental to the countryside, and would fuel the traffic problems.

Cllr C Sherwood the local ward member indicated that the development was too large for the village of Elsham, and was a big departure from planning policy including a number of planning policies.  It was not in keeping with the character of Elsham and was back land development. He urged the committee to refuse the application.

Cllr Wells stated there was limited access, and narrow roads in Elsham with visibility restricted.  He said the application should be refused as it was contrary to a number of planning policies.

It was moved by Cllr Wells and seconded by Cllr Evison –

That planning permission be refused for the following reason –

The proposed development is contrary to policies RD2 of the North Lincolnshire Local Plan; CS2, CS3 and CS8 of the Core Strategy, and paragraph 11 of the National Planning Policy Framework in that the site is located in an unsustainable settlement that is remote from local services and public transport.

Motion Carried.

(ii)   PA/2019/88 by Mrs Goodhew for outline planning permission to erect one dwelling with appearance, landscaping, layout and scale reserved for subsequent approval at land adjacent to 31 Margrave Lane, Garthorpe, DN17 4RT.

Resolved – That planning permission be granted in accordance with the recommendations contained within the officer’s report.

(iii)     PA/2019/416 by Motor Fuel Limited for planning permission to demolish existing café and erect replacement coffee shop and drive thru facility, including parking at Motorway Services, C121 between Barnetby Top and Elsham, Elsham, DN20 0PA.

Resolved – That planning permission be granted in accordance with the officer’s recommendations with the amendment, and addition of the following conditions –

3.
Within three months of the date of this permission, details of the method of improving the existing access with the highway shall be submitted to and approved in writing by the local planning authority.

7.
Prior to the occupation of the hereby approved building, a scheme for the provision of a rapid electrical vehicle charging point shall be submitted to and approved in writing by the local planning authority. The scheme shall be designed to take account of good practice guidance as set out in the Institute of Air Quality Management Land Use Planning and Development Control http://www.iaqm.co.uk/text/guidance/air-quality-planning-guidance.pdf and contemporaneous electrical standards including:

  • Electrical Requirements of BS7671:2008;

  • IET Code of Practice on Electrical Vehicle Charging Equipment installation 2012 ISBN 978-1-84919-515-7.

The approved scheme shall be installed in full no later than one month after the building is first occupied and shall be retained in perpetuity thereafter.
 
Reason
To facilitate the uptake of low emission vehicles and reduce the emission impact of traffic arising from the development in line with the National Planning Policy Framework (NPPF).

(iv)     PA/2019/460 by Mr Garth Stephenson for outline planning permission with all matters reserved (up to six dwellings) at land west of Kettleby Lane, Wrawby.

Resolved – That planning permission be granted in accordance with the recommendations contained within the officer’s report.

(v)      PA/2019/477 by Mr Phil Garbutt for planning permission to erect a two-storey extension to the front of the dwelling and a single-storey extension to the side at 125 Westgate Road, Westgate, Belton, DN9 1PY.

Resolved – That planning permission be granted in accordance with the recommendations contained within the officer’s report.

(vi)     PA/2019/499 by Miss N Richardson for planning permission to erect a front porch, side extension and boundary walls, with associated works at 5 Darby Road, Burton upon Stather, DN15 9DY.

Speaking against the application an objector stated that it was a retrospective application, and the design had changed following three sets of plans.  She said it was a large foot print, with a high fence that would limit driver’s views, and would lead to a loss of light to their garden.

Resolved – That planning permission be granted in accordance with the recommendations contained within the officer’s report.

(vii)    PA/2019/557 by Raw Carrots Limited for planning permission to convert dwelling to three apartments at 7 Church Street, Epworth, DN9 1ER.

Resolved – That planning permission be granted in accordance with the recommendations contained within the officer’s report.

(viii)    PA/2019/576 by Mr Francis Micallef, Rainham Steel for planning permission to retain a 2.4 metre high galvanised steel palisade security fence to northern and part eastern boundaries at former site of Pet Polymers Limited, Stather Road, Flixborough, DN15 8RR.

Resolved – That planning permission be granted in accordance with the recommendations contained within the officer’s report and with the addition of the following condition –

Within three months of the date of this decision notice, the fence shall be painted green and once painted it shall thereafter be retained.

Reason
To ensure that the appearance of the fence is not detrimental to the character and appearance of the surrounding area, in accordance with policies DS1 of the North Lincolnshire Local Plan and CS5 of the adopted Core Strategy.

(ix)    PA/2019/705 by Mr Sebastian Zegocki, Brit-Pol Limited for planning permission to erect a fuel storage tank at land south of Unit B, access roads in disused airfield, North Killingholme.

Resolved – The application be withdrawn.

(x)      PA/2019/728 by Mr and Mrs Neil Wilkinson for outline planning permission to erect a three/four bedroomed detached dwelling and detached double garage with appearance, landscaping, layout and scale reserved for subsequent approval at land rear of Lovain Villa, Station Road, Ulceby.

An objector addressed the committee and urged them to visit the site before making a decision. He felt there was too many problems with the application, including drainage issues, traffic issues and said the plans were misleading and they needed to visit the site to see the scale of the proposal.

The applicant also spoke on the application and in doing so stated that she did not feel there was any problems with the application.  She informed the committee that there was adequate parking on the site, and there was no traffic issues associated with the application, and drainage had no objections when consulted.

Cllr Wells stated that he thought it would be beneficial to hold a site visit.

Resolved – That the application be deferred to the next meeting to allow the committee to visit the site.

1960 PUBLIC FOOTPATH 6, AMCOTTS, at WHITE HOUSE, TRENTSIDE – The Director: Operations submitted a report for consideration on whether an order should be referred to the Secretary of State for determination on public footpath 6, Amcotts at White House, Trentside.

Resolved – That the ‘Definitive Map Modification (Public Footpath 6, Amcotts) Order 2018 (1) be sent to the Secretary of State for the Environment, Food and Rural Affairs for confirmation as made.

1961 MAP MODIFICATION (RESTRICTED BYWAY 2, BELTON) ORDER 2018 (1) DEFINITIVE – The Director: Operations submitted a report to determine North Lincolnshire Councils stance before referring a duly-contended definitive map modification to the Secretary of State.

The options for consideration by the committee were to (i) seek confirmation be made, (ii) request that c onfirmation be made subject to modifications within the Secretary of State’s ambit or (iii) that it not be confirmed.

A member of the public addressed the committee and spoke against the application.

Resolved – That the “Definitive Map Modification (Restricted Byway 2, Belton) Order 2018(1)” be sent to the Secretary of State for the Environment, Food and Rural Affairs for confirmation as made.
