2029 APPLICATION DEFERRED FROM PREVIOUS MEETING – In accordance with the decision at the previous meeting, members had undertaken site visit prior to the meeting. The Group Manager – Development Management and Building Control submitted reports and updated them orally.
(i) PA/2020/615 by Nasima Begum for planning permission to erect single-storey and two-storey rear extensions at 24 Donnington Gardens, Scunthorpe, DN15 7RJ
Cllr O’Sullivan spoke on behalf of residents in the area, and highlighted the impact the extension would have on them. The concerns were the size of the extension and the impact on neighbouring properties, over development on a small garden, and highway issues on a horse shape road that was already busy. In highlighting the concerns she urged the committee to refuse the application.
Cllr Southern stated that he had been heavily lobbied by residents and received a letter from 20 properties that were against the proposal. He had concerns with the horse shoe shape of the road and the volume of traffic, as well as the over development that would cause loss of sunlight for neighbouring properties.
Cllr Evison felt having looked at the property and the area, there was a lot of extensions in the vicinity. He also felt the lighting situation was not a problem as it was within the parameters, and therefore no planning reason to refuse permission.
Cllr Bainbridge and Grant were against the application as they felt it was too large, and overbearing on neighbouring properties. They also had concerns on the road and traffic issues.
(The votes being equal the Chairman used his second and casting vote in favour of approving the application).
Resolved – That planning permission be granted in accordance with the recommendations contained within the officer’s report.
(ii) PA/2020/685 by Mr Liam Liddy for planning permission to erect four dwellings with associated access and landscaping at land adjacent to 1 Silver Street, Barnetby le Wold, DN38 6HS
The applicant outlined the proposal and in doing so brought the committee’s attention to the concerns raise to cars parking on the street. He stated that the development was at the beginning of the road, with off street parking provisions and site frontage with drop kerbs to alleviate any problems.
Cllr C Sherwood spoke as the local ward member against the application with concerns around the on street parking and the street scene. He stated it was a small site on a long busy road and the proposal had already been approved for three dwellings, and four was just too large for the area.
Cllr Waltham also spoke against the application as a ward member due to the concerns of highway safety on a very busy road that was used on a regular basis by pedestrians and cars visiting the local amenities situated at the bottom of the road. He said it was over development for the site, and that the agreed proposal for three dwellings was more than adequate.
Cllr Evison having visited the site also felt it was over development for the area, and was happy with the approval for three properties but not for the development of four.
It was moved by Cllr Evison and seconded by Cllr J Davidson –
That planning permission be refused for the following reasons –
The proposal for the erection of four dwellings would be an over-development of the site resulting in a cramped appearance to the detriment of the street scene along Silver Street and the character and appearance of the area. The proposal is therefore contrary to policies DS1 and H5 of the North Lincolnshire Local Plan and CS5 of the North Lincolnshire Core Strategy.
The proposed development would result in additional traffic generation and the loss of existing on-street parking, which would exacerbate existing concerns of on-street parking and prevent the free and safe flow of vehicles along Silver Street. The proposal would therefore have an unacceptable impact on highway safety and be contrary to policies T2 and H5 of the North Lincolnshire Local Plan.
2030 MAJOR APPLICATIONS – The Group Manager – Development Management submitted a report containing details of major applications for determination by the committee, including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.
(i) PA/2019/2119 by Amy Schoenmaker application for modification of a planning obligation attached to PA/2018/999 at land off West Street, Scunthorpe, DN15 6HT
Cllrs Ali and Yeadon addressed the committee with great concerns over the removal of the S106 agreement for the contribution to a recreational play area. She felt it would be detrimental to the area, a big loss and have an adverse impact on the residents.
It was moved by Cllr Evison and seconded by Cllr J Davidson-
That the planning permission to modify be refused for the following reason-
The contributions open space and highways are necessary to mitigate the impacts of the proposed development and make it acceptable in planning terms. Insufficient evidence has been provided to demonstrate that these contributions would make the scheme unviable.
(ii) PA/2020/546 by Lincolnshire Estates Ltd for outline planning permission to erect up to 90 dwellings and two retail units, with public open space incorporating new green infrastructure, SuDS features, a local equipped area for play (LEAP), woodland planting and biodiversity enhancements, with appearance, landscaping, layout and scale reserved for subsequent consideration at land south of High Street (access off Swallow Lane), Wootton
Resolved – The application was withdrawn by the applicant.
2031 PLANNING AND OTHER APPLICATIONS – The Group Manager – Development Management submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. The Head of Development Management updated the reports orally where appropriate. Other officers attending gave advice and answered members’ questions as requested.
(i) PA/2020/57 by Mr Darren Shafer for planning permission for the change of use from retail (A1) to hot food takeaway (A5) at 336-338, Ashby Road, Scunthorpe, DN16 2RS
An objector spoke on behalf on a number of residents and in doing so urged the committee to refuse permission. Highlighting the anti-social behaviour already in the area, they felt it would only add to the problems. She stated it was no appropriate for the street scene and they were already saturated with take-aways within the vicinity,
The developer felt the take away would bring something different to the area that was not already available, and tried to ease concerns around, noise parking, litter etc and said these would not cause a problem and staff would regularly monitor all the area.
Cllr Gosling addressed the committee as the local ward member with a number of concerns, and urging the committee to refuse the application. The concerns covered the following areas; detrimental impact on the area and the residential properties, already a number of take-aways in the vicinity, noise and smell pollution and food waste on the environment.
The Chairman read out a letter of objection received from the local MP Holly Mumby-Croft.
Cllr J Davidson had seen overwhelming evidence that residents were against this application, and he felt he had to support them. He was against take-away outlets being situated next to residential properties, and the possible environmental impacts it could have of the residents.
It was moved by Cllr J Davidson and seconded by Cllr Evison –
That planning permission be refused for the following reasons –
The proposed development conflicts with policy S9 of the North Lincolnshire Local Plan in that the takeaway would be located outside of any defined town or district centre. Insufficient evidence has been provided to justify this conflict with the Development Plan.
The proposed development, due to its location outside of any town or district centre and in close proximity to residential properties, would result in an unacceptable loss of amenity to neighbouring properties due to noise, disturbance, litter and on-street parking. The proposed development is therefore contrary to policies DS1 and S9 of the North Lincolnshire Local Plan.
(ii) PA/2020/744 by Mr Anthony Northcote, Town-Planning.co.uk application for technical details consent (pursuant to permission in principle for residential development PA/2019/1117) for the erection of three dwellings at land adjacent to 61 Haxey Lane, Haxey, DN9 2ND
Resolved – That planning permission be approved in accordance with the recommendations contained within the officer’s report.
