63 REQUESTS TO SPEAK – STANDING ORDER 38(b) – It was reported that one request to speak had been received in accordance with Standing Order 38(b). However, the person making the request was not present.

64 MINUTES – Resolved – That the minutes of the proceedings of this sub-committee of 19 May 2000, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

65 APPLICATIONS DEFERRED FROM PREVIOUS MEETING FOR SITE VISITS – (minute 17 refers) – In accordance with the decisions at the last meeting, members had undertaken site visits earlier in the day. The Director of Environment and Public Protection submitted reports and updated them orally where appropriate.

(43) 00/0410 by Ben Bailey Homes Ltd for erection of 17 houses and 3 bungalows on land at Mulberry Drive, Crowle.

Councillor Mrs Metcalfe, attending the meeting under the provisions of Standing Order 40(b), spoke against this application on the ground that the dwellings on the site should be single-storey in keeping with surroundings and as proposed by the previous owner of the site. The Director of Environment and Public Protection reported that the applicant proposed to build three bungalows close to the boundary of the site to reduce the impact on existing properties.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

66 (44) 00/0262 by Mr D A and Mrs S A Able for outline planning permission to erect a detached bungalow on land adjacent to Oberland, Station Road, Scawby.

Resolved – That permission be refused in accordance with the recommendation contained in the report and subject to an additional reason relating to the restricted size of the plot.

67 (45) PLANNING APPLICATIONS – The Director of Environment and Public Protection submitted a report incorporating a schedule containing details of applications for determination by the sub-committee, including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. Officers updated the schedule orally in respect of late representations and other significant developments since its preparation.

Resolved – That the following applications be approved in accordance with the recommendations contained in the reports.

(Subject to an additional condition requiring the applicants to undertake the use in accordance with their letter of 26 May 2000 and not to change the working practices contained therein without the prior written consent of the Local Planning Authority).

The Director of Environment and Public Protection reported that the Parish Council had indicated that it was happy with the above proposal on the basis of the further details received from the applicants.

(xv) 00/0404 by Mr & Mrs C Allison for erection of a detached house and garage with associated access on land south of 4 Barnside, Hibaldstow.

(xvi) 00/0445 by Chartdale Homes Ltd for consent to carry out works to trees protected by a tree preservation order on land off Ferriby Road, Barton-upon-Humber.

(xvii) 00/0451 by Mr J A Billingsley for variation of Condition 5 of planning permission 00/0198 dated 31/3/00 to allow the display of two vehicles for sale on the forecourt at 120 Station Road, Keadby.

(xviii) 00/0466 by A V Ogden Holdings for variation of condition 5 of planning permission 98/1179 dated 17/11/98 to allow more than 35 dwellings to be erected on land adjoining and to the east of Station Road, Keadby.

Councillor Metcalfe, attending the meeting under the provisions of Standing Order 40(b), spoke against the above application and in support of the original condition. The Director of Environment and Public Protection reported that since the condition had been imposed there had been a change in government policy in favour of increased density in housing developments. Also the draft North Lincolnshire Local Plan indicated that the site was suitable for up to 60 dwellings.

(xix) 00/0638 by A J Birkett for erection of a ground floor domestic extension to front of dwelling (resubmission of application 00/0266) at 14 Cheltenham Close, Bottesford.

68 Resolved – That the following applications be refused in accordance with the recommendations contained in the reports.

(i) 00/0062 by J Townend & Sons (Hull) Ltd for Listed Building Consent to retain a non-illuminated fascia sign at Market Lane, Barton-upon-Humber

(and authority be given (i) for any necessary enforcement action to be taken to secure the removal of the unauthorised sign, and (ii) to issue instructions to take proceedings in the Magistrates’ Court in the event that any notice served in pursuance of (i) or any requisition served under Section 330 of the Town and Country Planning Act 1990 or Section 16 of the Local Government (Miscellaneous Provisions) Act 1976 is not complied with, subject to the Assistant Director (Legal and Administration) being satisfied as to the evidence available to support such action).

(v) 00/0315 by Mr M Nason for outline planning permission to erect a dwelling on land adjacent to 70 High Street, Belton.

(vi) 00/0360 by Ms C Todd for change of use of outbuildings to office premises and associated storage facilities in part of garage at 2 Highfield Crescent, Westwoodside.

(and authority be given to pursue the enforcement action authorised on 18 February 2000 allowing a six months period for compliance with the order to provide for a reasonable time period for alternative accommodation to be found).

(vii) 00/0367 by Mr M F Gray for continued use of land for the siting of a static caravan at Manor Farm, Coleby, West Halton.

Resolved – That consideration of this application be deferred.

71 Resolved – That consideration of the following applications be deferred until the next meeting and that members visit the sites prior to that meeting.

72 (46) APPLICATION FOR APPROVAL OF RESERVED MATTERS FOLLOWING THE GRANT OF OUTLINE PLANNING PERMISSION –

00/0365 by Merryvale Developments for approval of reserved matters in connection with permission 99/0542 on land corner of Carr Lane and West Street, West Butterwick – The Director of Environment and Public Protection submitted a report informing members about this application for approval of reserved matters which was ready for determination. Outline planning permission had already been granted and the development had therefore been agreed in principle.

Consideration was now required to the details of the siting, design, external appearance, means of access and landscaping of the development (excluding any of these matters which were expressly approved at the time outline permission had been granted).

Resolved – That approval be granted in accordance with the recommendation contained in the report.

73 (47) APPEALS – The Director of Environment and Public Protection submitted a report informing members of the outcome of an appeal against the refusal of application 99/0760 for erection of a four-bedroomed house and garage on Plot 2 Danns Hill, Saxby all Saints – The appeal had been allowed.

The Director updated the report informing members that the decision had now been received in respect of application 99/0937 for modification to existing conditions regarding infilling of disused quarries with inert waste at Kirton Quarry, Gainsthorpe Road, Hibaldstow.The appeal had been dismissed.

Resolved – That the report be noted.

74 ENFORCEMENT – The Director of Environment and Public Protection submitted reports on the following alleged breaches of planning control. Each report set out the planning history of the site; the nature of the alleged breach; details of attempts to secure a cessation of the breach or submission of a planning application, and the reasons why it was or was not considered expedient to take action.

(48) Non-Compliance with Conditions of Planning Permission – 98/1490 Reeds Hotel, Far Ings Road, Barton-Upon-Humber – Resolved – That authority be given (a) for any necessary enforcement action to secure compliance with the relevant condition, and (b) to issue instructions to take proceedings in the Magistrates’ Court in the event that any notice served in pursuance of (a) or any requisition served under Section 330 of the Town and Country Planning Act 1990 or Section 16 of the Local Government (Miscellaneous Provisions) Act 1976 is not complied with, subject to the Assistant Director (Legal and Administration) being satisfied as with the evidence available to support such action.

75 (49) Unauthorised Development/Non-Compliance with Conditions of Planning Permission – 102 Station Road, Keadby – Resolved – That authority be given (a) to take any appropriate enforcement action to secure a cessation of the unauthorised use and (b) to issue instructions to take proceedings in the Magistrates’ Court in the event that any notice served in pursuance of (a) or any requisition served under Section 330 of the Town and Country Planning Act 1990 or Section 16 of the Local Government (Miscellaneous Provisions) Act 1976 is not complied with, subject to the Assistant Director (Legal and Administration) being satisfied as with the evidence available to support such action.
