Councillor England attended the meeting under the provisions of Standing Order 40(b).

The sub-committee met at South Killingholme Community Centre.

442 DECLARATIONS OF PECUNIARY OR NON-PECUNIARY INTERESTS AND DECLARATIONS OF SIGNIFICANT CONTACT WITH APPLICANTS OR THIRD PARTIES – Councillor P Kirk declared a pecuniary interest in minute 402.

443 REQUESTS TO SPEAK – STANDING ORDER 38(b) – It was reported that two requests to speak had been received in accordance with Standing Order 38(b). The chair stated that the speakers would be able to address the sub-committee prior to consideration of the relevant application.

444 MINUTES – Resolved – That the minutes of the proceedings of this sub-committee of 2 February and 2 March 2001, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

445 APPLICATIONS DEFERRED FROM PREVIOUS MEETING (minute 389 refers) – In accordance with the decisions at the last meeting, members had undertaken site visits earlier in the day. The Director of Environment and Public Protection submitted reports and updated them orally where appropriate.

(318) 00/1535 by Houldsworth and Cooke for approval of reserved matters relating to the erection of a four-bedroomed house with detached double garage at Plot 2 Cadney Road, Brigg.

The Director of Environment and Public Protection reported that the Environment Agency had now withdrawn its objection to this application.

Resolved – That permission be granted in accordance with the recommendation contained in the report, subject to an additional condition requiring approval to be given to the finished floor level prior to commencement of development.

446 (319) 00/1497 by T D List for outline planning permission to erect a 10 bedroom extension to existing hotel at Giovannis, Vicarage Lane, North Killingholme.

Resolved – That permission be granted in accordance with the recommendation contained in the report, subject to an additional condition requiring the construction of a solid screen fence on the western boundary of the site, at the base of the trees adjacent to the car park.

447 (320) PLANNING APPLICATIONS – The Director of Environment and Public Protection submitted a report incorporating a schedule containing details of applications for determination by the sub-committee, including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. Officers updated the schedule orally in respect of late representations and other significant developments since its preparation.

Resolved – That the following applications be approved in accordance with the recommendations contained in the reports.

(i) 00/1272 by Pelham Homes Ltd for removal of condition 6 of 1999/1299, granted 19 July 2000 to allow development of the site without securing implementation of a programme of archaeological work on land south of St. David’s Crescent, Bottesford.

(ii) 00/1376 by Mrs J L Lee for change of use of a barn to a two-bedroomed dwelling with associated alterations at Whitehouse Farm, Castlethorpe, Brigg.

(Prior to consideration of this application an objector and a representative of the applicant addressed the sub-committee.

The objector reiterated his concerns which were summarised in the report.

The applicant’s representative responded to each of the objector’s concerns in turn.

The Director of Environment and Public Protection reported that the proposal was in line with national policies and with policies RD2 and RD8 of the Revised Deposit Draft of the North Lincolnshire Local Plan. The council’s Conservation Officer was satisfied with the revised design.)

(iii) 00/1391 by Mr A Harrison for change of use of a barn to a dwelling at rear of 59 Station Road, Epworth.

(iv) 00/1551 by Peter Ward Homes Ltd for erection of 11 houses (change of house type) at former Ropeworks, Maltkiln Road, Barton upon Humber.

(v) 01/0025 by 842 Project for change of use of part of existing car park to a skate park with associated equipment at Carlton Street Car Park, Carlton Street, Scunthorpe.

(vi) 01/0086 by Vodafone Ltd for erection of a 30 metre high lattice mast with 6 antennas, 3 communication dishes and associated equipment cabin on land west of Manby Sawmill, Ermine Street, Broughton.

(vii) 01/0110 by Mr S Davies for variation of condition 5 of planning permission 1999/1307 dated 18 February 2000 (no buildings, chattels or caravans shall be placed or parked on the land without the prior written approval of the Local Planning Authority) to retain buildings/shelter for livestock feed, bedding and parking for tractor and trailer on land at Brick Lane, North Killingholme.

(viii) 01/0123 by Mr A Middleton for creation of a new access to the highway and additional car parking areas at Forest Pines Hotel, Ermine Street, Broughton.

(ix) 01/0129 by Mrs L V Kelly-McKay for outline planning permission to erect a dwelling (renewal of 97/1275, granted 13.2.98) at Treath, St Martins Road, Scawby.

448 00/1525 by J Owen Day & Co for outline planning permission to erect a filling station and restaurant facilities (renewal of 98/0051, granted 20.3.98) at the junction of the B1206 and A15 Bypass, Redbourne.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

449 01/0058 by Mrs E L Cim for variation of condition 3 of 2000/0617, granted 25.7.00 to allow Sunday opening at Bellissimo Pizza, 103 Willoughby Road, Scunthorpe.

Prior to consideration of this application, the applicant addressed the sub-committee. She argued that most takeaways in Scunthorpe were open on Sundays. Not opening on Sundays led to a loss of business on other days of the week. There were no objections from residents or from other businesses.

The Director of Environment and Public Protection reported that the condition was in accordance with SPG10 of the Scunthorpe Borough Local Plan Supplementary Planning Guidance which was still relevant. In his view it would not be appropriate to vary the condition so soon after granting the permission.

Members nevertheless felt that the general location of the premises, in particular its proximity to a public house, meant that opening on a Sunday would not lead to any loss of residential amenity.

Resolved – That the condition be varied to permit Sunday opening between the hours of 4.30 p.m. and 11.00p.m.

450 99/0136 by Bernard Hicks for submission of details to satisfy condition 2 of planning permission dated 11 June 1999 (ref 99/0136) namely details of works required to convert a chapel to a dwelling at The Old Chapel, 51 West End, Winteringham.

Resolved – That the conversion details set out on the submitted drawings are acceptable and meet the terms of condition 2 imposed on planning permission 1999/0136 dated 11 June 1999 providing the six windows in the east facing elevation, together with the four Velux rooflights in the east facing roof slope, are obscure glazed at all times.

451 Resolved – That consideration of the following applications be deferred until the next meeting and that members visit the sites prior to that meeting.

(i) 00/1457 by Mr R H Dunford for outline planning permission to erect a single dwelling on land north west of Gillatts Close, Wrawby.

(ii) 00/1460 by Mr D P Portess for retention of a double garage and the creation of a new vehicular access off 28 O’Hanlon Avenue, Brigg,

(iii) 01/0062 by Mr G W Drury and Keigar Homes for outline planning permission to erect 3 dwellings (means of access not reserved for subsequent approval) at land south of Carr Lane, Redbourne.

452 (321) APPLICATIONS FOR APPROVAL OF RESERVED MATTERS FOLLOWING THE GRANT OF OUTLINE PLANNING PERMISSION – The Director of Environment and Public Protection submitted a report informing members about applications for approval of reserved matters which were ready for determination. Outline planning permission had already been granted and the developments had therefore been agreed in principle.

Consideration was now required to the details of the siting, design, external appearance, means of access and landscaping of the developments (excluding any of these matters which were expressly approved at the time outline permission had been granted).

(i) 00/0957 by Chappell Farms in respect of outline permission 97/0828 at Beechwood Farm, East Street, Hibaldstow.

(ii) 01/0049 by Mr G R Clarke in respect of outline permission 98/448 on land south of High Street, Wroot.

(iii) 01/0141 by Haslam Homes Ltd in respect of outline permission 00/1052 on land adjacent Priory Lane and Abbey Road, Scunthorpe.

453 (322) APPLICATION DETERMINED BY THE SECRETARY OF STATE – LAND TO THE NORTH OF THE A18 DONCASTER ROAD AND EAST OF THE 1077 NORTH-WEST ORBITAL ROAD, GUNNESS – TESCO STORES LTD – APPLICATION REF 1998/0452 – The Director of Environment and Public Protection submitted a report informing members about the decision on this application which had been ‘called-in’ by the Secretary of State. The Secretary of State had granted permission, subject to a number of conditions.

Resolved – That the decision be noted.

454 (323) APPEALS – The Director of Environment and Public Protection submitted a report informing members of the outcome of the following appeals:-

(i) Against refusal of application 99/1208 for outline planning permission for four detached dwellings to the rear of 7 Silver Street, Winteringham – Appeal dismissed.

(ii) Against enforcement notice against refusal to retain a caravan and bird hide at Littlewood, Marsh Lane, Winteringham (application 00/0009) – Appeal dismissed, notice upheld and varied.

(iii) Against refusal of application 00/0564 for outline planning permission for a dwelling on land to the rear of 28 West End Road, Epworth – Appeal dismissed.

(iv) Against refusal of application 00/0598 for outline planning permission for residential development on land adjacent to 42 Doncaster Road, Westwoodside – Appeal allowed subject to conditions.

Resolved – That the report be noted.

455 (324) TRAINING FOR TOWN AND PARISH COUNCILS IN DEVELOPMENT CONTROL – The Director of Environment and Public Protection submitted a report informing the sub-committee of recent training events and inviting members to determine future action.

Resolved – (a) That those parish and town councils who took part in the training be thanked for their interest; (b) that this report be circulated to all parish and town councils in an attempt to encourage greater participation next time; (c) that copies of the presentation notes be offered to those who did not attend, upon request; and (d) that further events be organised in 2001/02 dealing with topics to be determined after consultation with the councils.

456 (325) ENFORCEMENT UPDATE – The Director of Environment and Public Protection submitted a schedule giving details of progress of matters on which the sub-committee had authorised enforcement action.

Resolved – That the report be noted.

457 (326) SITE VISITS AND PUBLIC SPEAKING AT MEETINGS OF THE SUB-COMMITTEE – This item was considered after the chair had decided it was urgent because of the need to incorporate any changes to the sub-committee’s procedures in the council’s new constitution.

The Director of Corporate Affairs submitted a report inviting members to re-consider the way in which the sub-committee took decisions to hold site visits and suggesting an amendment to the procedure for public speaking at meetings of the sub-committee.

Resolved – (a) That approval in principle be given to the amendment of the procedure for public speaking at meetings of this sub-committee so as to permit persons who have given the appropriate period of notice to speak at the meeting at which the application is first considered and/or at the subsequent meeting, should the application be deferred, and (b) that the issue be addressed as part of the ongoing work on the Council’s new Constitution.
