45 REQUESTS TO SPEAK – PROCEDURE RULE 36(e) – It was report that seven requests to speak had been received in accordance with Procedure Rule 36(e). The chair stated that the speakers would be able to address the committee prior to consideration of the respective applications.

46 MINUTES – Resolved – That the minutes of the proceedings of the meeting held on 20 July 2001, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

47 APPLICATIONS DEFERRED FROM PREVIOUS MEETING (minutes 34, 37 and 38 refer) – In accordance with the decisions at the previous meeting, members had undertaken site visits earlier in the day. The Director of Environment and Public Protection submitted reports and updated them orally where appropriate.

(23) 01/0656 by Mr A Lindley for erection of six flats and construction of associated access at 15/17 Queen Street, Epworth.

Prior to consideration of this application an objector addressed the committee under the provisions of Procedure Rule 36(e).

The objector expressed concern at the possible overshadowing of a ground floor window.

She stated that the proposal was in contravention of policy guidelines as the site had always been an open space and was located within a conservation area. She also stated that policy H3 and PPG3 (previously used land and housing) were not relevant as this was not a “brownfield” site.

She also expressed concern at the potential increase in traffic due to the difficulties already experienced.

Resolved – That consideration of this application be deferred until the next meeting to enable further information from the applicant to be assessed.

48 (24) 01/0481 by Eastfield Developments Ltd for erection of 3 detached 4 -bedroomed dormer houses with garages and 1 detached 3/4 – bedroomed dormer house and detached garage on land adjoining 77 and Prospect House, High Street, Epworth.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

49 (25) 00/1530 by Mash Enterprises Ltd for retention of a sawdust storage silo, 4 galvanised steel storage bins and a chimney and reduction of the size of an existing lean-to storage building at Mash Enterprises, Humber Road, Barton-upon-Humber.

Prior to consideration of this application an objector addressed the committee under the provisions of Procedure Rule 36(e).

He stated that the application was for retrospective permission and that the use caused nuisance to nearby residents in the form of noise, smoke and smell and expressed concern about health and safety and the need for this to be monitored.

A representative of the council’s Pollution Team addressed the committee and outlined details of the permission in relation to requirements of the relevant Health and Safety legislation.

Councillor Appleyard, attending the meeting under the provisions of Procedure Rule 38(b), spoke against this application.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

50 (26) 01/0571 by Mr and Mrs D Cutts for retention of the use of farm outbuildings as a venue for the solemnisation of marriages, registrar room, a marquee with toilet, kitchen facilities and car parking area at Mill Farm House, Barrow Road, Goxhill.

Prior to consideration of this application, one of the applicants addressed the committee under the provisions of Procedure Rule 36(e).

He stated that the proposal would generate employment in the countryside and that no objections had been received. Neighbours supported the application. He also stated that he would operate for six months of the year only (April to October) although the premises needed to be available all year in order to get a licence.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

51 (27) 01/0389 LFC (Horkstow) Ltd for erection of a 3m high boundary fence to the rear of Plot 4 and the erection of a 4m high boundary fence to the rear of plots 1 and 2 on development off High Street, Wootton.

Prior to consideration of this application, an objector addressed the committee under the provisions of Procedure Rule 36(e).

She stated that her smallholding (Lindum Cottage) had been in existence for 50 years. The erection of a 4metre high fence would overshadow farm buildings and land causing sunlight to be blocked out. Property values in the area would also be affected.

Resolved – That permission be refused in accordance with the recommendation in the report subject to the amendment of the reason for refusal by the addition of the words “and a 3m high boundary fence to the rear of plot 4 ” after “…. plots 1 and 2”.

52 (28) PLANNING APPLICATIONS – The Director of Environment and Public Protection submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. Officers updated the schedule orally in respect of late representations and other significant developments since its preparation.

Resolved – That the following applications be approved in accordance with the recommendations contained in the reports.

(i) 01/0445 by Messrs William Blyth for determination of conditions for a mineral site under the Environment Act 1995 on land north side of Far Ings Road, Barton-upon-Humber.

(ii) 01/0446 by Messrs William Blyth for determination of conditions for a mineral site under the Environment Act 1995 on land (4.65 hectares) north side of Middle Pasture Lane, Barton-upon-Humber.

(iii) 01/0478 by Mr M J Beadle for removal of condition 3 of permission 2/96/0099, granted 7.5.96 for retention of dwelling to be used as ancillary accommodation and the provision of bed and breakfast accommodation at Sandhills Farm, Epworth Turbary, Epworth.

(iv) 01/0644 by Lamming Construction Ltd for erection of 5 detached bungalows and garages (plots 2 – 6) on land at Chancel Road/Cambridge Avenue, Bottesford.

(v) 01/0663 by Mr H Smith for erection of a ground floor extension to a dwelling to provide a conservatory, large dining room and kitchen, and erection of a 1.7m high boundary wall on north elevation at 1 Meadowvale, Scawby.

(vi) 01/0687 by Mrs O Cox for consent to prune an Ash tree protected by a Tree Preservation Order (T1) at Winterbourne House, Thorngarth Lane, Barrow-upon-Humber.

(vii) 01/0694 by Mr I Bruce for erection of a first floor extension and detached garage/workshop with games room above at Wheelhouse, South End, Goxhill.

(subject to the amendment of condition 5 to relate to a plan and clarify the distance as being 7 metres).

Prior to consideration of this application an objector and a representative of the applicant addressed the committee in accordance with the provisions of Procedure Rule 36(e).

The objector stated that he had not seen the amended plans but that the revised recommendations in the report seemed to be an acceptable compromise. He asked for clarification of condition 5 relating to the relocation of the garage workshop. A representative of the applicant pointed out that the proposal had been amended to reposition the garage/workshop.

(viii) 01/0704 by Mr M G Cann for erection of extensions to dwelling to provide garden room, kitchen, laundry room, study, wc, log store and garage at Ivy Cottage, Church Hill, Whitton.

(ix) 01/0747 by Mr J Westerman for erection of a detached 3 bedroomed house and garage on land opposite Kelholme, Kelfield, Owston Ferry.

(x) 01/0757 by Sunshine Fine Arts for outline planning permission for residential development on land forming part of property known as Sunshine Fine Arts, Humber Road, (west side/north side of Dam Road), Barton-upon-Humber.

(xi) 01/0857 by Mr A J Mortimer for erection of a two-storey extension including a conservatory, change of use of pasture land to garden land, and Section 73 application to vary condition 4 of Planning Permission 99/0362 in order to park a transit-type van in place of a removal van at Manor Barn, Mosswood, Belton.

53 Resolved – That the following applications be refused in accordance with the recommendations contained in the reports.

(i) 01/0729 by Mr D T Hunt for outline planning permission for residential development on land north of Hollyberries, west side of Grammar School Road, Brigg.

(ii) 01/0777 by T M Retail for change of use of vacant shop to a hot food takeaway at 17 King Street (formerly Martins Newsagents), Winterton.

Prior to consideration of this application an objector addressed the committee under the provisions of Procedure Rule 36(e).

The objector spoke on behalf of local residents and was also supported by the Town Council. He pointed out that the rear of his property was only 20 feet away from the proposal and voiced his concerns at the potential problems associated with smell from storage of waste food, cooking, flies and vermin. He also expressed concern at potential problems with litter generated and noise late at night.

Councillor Barkley attending the meeting under the provisions of Procedure Rule 38(b) spoke against this application.

He argued that the location was not suitable for this type of use. Neighbouring properties were mainly residential and a number were listed buildings.

54 Resolved – That consideration of the following applications be deferred until the next meeting and that members visit the sites prior to that meeting.

(i) 01/0196 by J and A Sargent for erection of one detached dwelling on land rear of 28 High Street (access from South Cliff Road), Kirton in Lindsey.

(ii) 01/0351 by Mr J North for outline planning permission to erect a detached replacement dwelling (siting not reserved for subsequent approval) at The Old Mill, Ings Lane, Hibaldstow.

55 APPLICATIONS FOR APPROVAL OF RESERVED MATTERS FOLLOWING THE GRANT OF OUTLINE PLANNING PERMISSION – The Director of Environment and Public Protection submitted a report informing members about applications for approval of reserved matters which were ready for determination. Outline planning permission had already been granted and the developments had therefore been agreed in principle. Consideration was not required to the details of the siting, design, external appearance, means of access and landscaping of the development (excluding any of these matters which were expressly approved at the time outline permission had been granted).

(29) 01/0624 by D J Prescott (Builders) Ltd in respect of 98/1417 for the erection of a detached 5-bedroomed house and garage at Plot 2, Sheepdyke Lane, Bonby.

Resolved – That approval be granted in accordance with the recommendation contained in the report.

56 01/0625 by D J Prescott (Builders) Ltd in respect of 98/1417 for the erection of a detached 4-bedroomed house and garage at Plot 3 Sheepdyke Lane, Bonby.

Resolved – That approval be granted in accordance with the recommendation contained in the report.

57 (30) APPEALS – The Director of Environment and Public Protection submitted a report informing members of the outcome of the following appeals:-

(i) Against the refusal of outline planning permission for erection of a filling station and restaurant facility (renewal of 98/0051 granted 20.3.98) at the junction of the B1206 and A15 bypass, Redbourne (application reference 00/1525 – Appeal allowed, subject to conditions.

(ii) Against the refusal to grant express consent for the erection of two free-standing static illuminated signs at 177 Scawby Road, Scawby (application reference 01/0056) – Appeal dismissed.

Resolved – That the report be noted.

58 (31) STATISTICS OF PLANNING APPLICATIONS APRIL – JUNE 2001 – The Director of Environment and Publication Protection submitted a report informing members of the council’s performance in handling planning applications in the second quarter of 2001.

Resolved – That the report be noted.

59 (32) TREE PRESERVATION (CHANTRY COTTAGE, PONDSIDE, WOOTTON) ORDER 2001 – The Director of Environment and Public Protection submitted a report inviting members to consider confirmation of a Tree Preservation Order (TPO) at Chantry Cottage, Pondside, Wootton.

Resolved – That the Order be confirmed.

60 (33) TREE PRESERVATION (LAND SOUTH OF 60 NORTH STREET, WINTERTON) ORDER 2001 – The Director of Environment and Public Protection submitted a report inviting members to consider confirmation of a Tree Preservation Order (TPO) on land south of 60 North Street, Winterton.

Resolved – That the Order be confirmed.

61 (34) ENFORCEMENT UPDATE – The Director of Environment and Public Protection submitted a schedule giving details of progress in respect of matters on which the committee had authorised enforcement action.
