351 DECLARATIONS OF PREJUDICIAL AND NON-PREJUDICIAL PERSONAL INTERESTS AND DECLARATIONS OF SIGNIFICANT CONTACT WITH APPLICANTS OR THIRD PARTIES (LOBBYING) –

352 REQUESTS TO SPEAK – PROCEDURE RULE 36(e) – It was reported that four requests to speak had been received in accordance with Procedure Rule 36(e). The chair stated that the speakers would be able to address the committee prior to consideration of the respective items.

353 MINUTESResolved – That the minutes of the proceedings of the meeting held on 7 March, 2003, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

354 (76) PLANNING APPLICATIONS – The Director of Environment and Public Protection submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. Officers updated the schedule orally in respect of late representations and other significant developments since its preparation.

Resolved – That the following applications be approved in accordance with the recommendations contained in the reports.

02/1404 by Miss S Hopkinson for the construction of a bank at the end of the practice area to prevent balls going over onto the 18th fairway at Normanby Hall, Normanby Park, Normanby

(Prior to consideration of this application the Director of Environment and Public Protection explained the application was made on behalf of the Council as the owners of the golf course. An objector then addressed the committee in accordance with the provisions of Procedure Rule 36 (e).

He stated that the bank would obscure the view of the fairway from the practice ground and vice – versa. Therefore it would actually increase the danger to golfers. The bank was of insufficient height to prevent balls from travelling over it.

The Director of Environment and Public Protection stated that health and safety considerations were not relevant issues for this committee when deciding the application. The relevant issue was whether or not the bank would be in keeping with its surroundings. In his opinion it would be.)

02/1588 by Mrs M Henley for the erection of 2 stables, a feed room and equipment store at Hedgehog House, College Road, Goxhill.

(The Director of Environment and Public Protection updated the report in respect of this application, advising members that the application had been amended to move the position of the stables further away from the objector’s property. The objector’s wished their objections to stand. However, the Director considered that the application, as amended, was acceptable.)

03/0013 by M Cooke for the erection of a domestic garage and the conversion of an existing garage into a bedroom at 21 Main Street, Worlaby.

03/0070 by Mr and Mrs A Shaw for the erection of a 4-bedroom detached house and garage on land of Westwood, Bracon, Belton.

(v) 03/0073 by Mr and Mrs P Jackson for the erection of extensions and making alterations to an existing dwelling at Belwood House, Woodhouse Lane, Belton

(vi) 03/0112 by A & G Duck for outline permission to erect a detached house and garage on land to the rear of Briar Garth, Ferry Lane, Winteringham.

(vii) 03/0145 by Mr G Evans for outline permission for the erection of a dwelling on site off Prospect Lane, Alkborough.

355 02/0993 by JG Staves Estates for the erection of a security fence at 116 Frodingham Road, Scunthorpe

(Prior to consideration of this application a representative of the applicant addressed the committee in accordance with the provisions of Procedure Rule 36 (e).

He maintained that a brick wall and gates previously erected on the site had been subject to vandalism and that the fence was necessary to protect the site. The premises were commercial, not residential, and there were several similar fences in the neighbourhood.

The Director of Environment and Public Protection stated that, whilst he accepted the need for security, the fence would be out of character with its surroundings.)

Resolved – That the application be refused in accordance with the recommendation contained in the report.

(Note: The voting being equal on the above matter (Minute 355 refers) the chair used his second and casting vote in favour of the proposal)

02/1655 by Mr A Kerr for the retention of three storage containers at 3 Godnow Road, Crowle.

Resolved – That consideration of this application be deferred to enable officers to give further consideration to the issue.

03/0035 by Mr and Mrs B Gravling for the erection of a detached bungalow with integral garage at rear of 16 Messingham Lane, Scawby

Prior to consideration of this application, an objector addressed the committee in accordance with the provisions of Procedure Rule 36 (e). He was concerned that, because the plot was shallow, traffic would have to reverse onto Messingham. He also made reference to the Village Design Statement for the village and argued that the bungalow would be out of keeping with the locality. The bungalow could be better situated within the site. If the development was allowed, some trees would have to be cut down.

The Director of Environment and Public Protection stated that, in his opinion there was enough space around the dwelling to meet current standards. Whilst traffic was a relevant consideration, he did not consider that one more dwelling would make a significant difference to the amount of traffic on the road. The existing trees would be protected by connditions.

Moved by Councillor Wood and seconded by Councillor Wardle –

That consideration of the application be deferred until the next meeting and that members hold a site visit prior to that meeting.

03/0088 by Mr and Mrs Tommasi for the retention of a front boundary wall and gates at 26 Avenue Vivian, Scunthorpe

Prior to consideration of this application, the applicant addressed the committee in accordance with the provisions of Procedure Rule 36 (e).

The applicant stated that the wall was necessary for the security of his premises. He had previously had a wall at the location but this had been destroyed by people congregating at the bus stop. He had also suffered several burglaries. There were similar walls in the locality. Neighbours did not object to the wall.

The Director of Environment and Public Protection stated that whilst the wall and railings were well constructed, they were not appropriate for the location.

That consideration of the application be deferred until the next meeting and that members hold a site visit prior to that meeting

359(77) APPEAL – The Director of Environment and Public Protection submitted a report informing members of the outcome of the following appeal: –

Against the refusal of permission for the change of use of premises to a commercial gymnasium at World of Pine, Ferriby Road, Barton – upon – Humber – Reference 02/0628492 – Appeal Allowed.

Resolved – That the report be noted.

360 (78) ENFORCEMENT UPDATE – The Director of Environment and Public Protection submitted a report informing members of recent enforcement action

Resolved – That the report be noted.

361 (79) TRAINING IN PLANNING FOR TOWN AND PARISH COUNCILS – The Director of Environment and Public Protection submitted a report informing members about recent training events and to determine future action.

Two evening seminars had been held during the current year, the first on 19 February, repeated on 11 March.

Resolved – (a) That those parish and town councils who took part in the training be thanked for their interest; (b) that further training be organised in 2003/04 in consultation with the councils, and (c) that this report is circulated to all parish and town councils in a further attempt to encourage greater participation next year.
