PRESENT: – Councillor Wardle in the chair.

Councillors Long (vice-chairman), Bunyan, Ellerby, England, Fordham, Holgate, Rocks, Waldron, Whiteley and Wood.

Councillors Appleyard, Clark, Eckhardt and Kirk attended the meeting in accordance with the provisions of Procedure Rule 38 (b).

The committee met at Pittwood House, Scunthorpe.

422 DECLARATIONS OF PREJUDICIAL AND NON-PREJUDICIAL PERSONAL INTERESTS AND DECLARATIONS OF SIGNIFICANT CONTACT WITH APPLICANTS OR THIRD PARTIES (LOBBYING) – The following members declared non-prejudicial personal interests –

Councillor Wardle declared that the objector and applicant in respect of application 2003/0409 had lobbied him.

423 REQUESTS TO SPEAK – PROCEDURE RULE 36(e) – It was reported that eighteen requests to speak had been received in accordance with Procedure Rule 36(e). The chairman stated that those speakers who were present would be able to address the committee prior to consideration of the respective applications.

424 MINUTES – Resolved – That the minutes of the proceedings of the meeting held on 18 July, 2003, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman.

425 (17) PLANNING APPLICATIONS – The Director of Environment and Public Protection submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. Officers updated the schedule orally in respect of late representations and other significant developments since its preparation.

Resolved – That the following applications be approved in accordance with the recommendations contained in the reports.

(i) 02/1134 by Biffa Waste Services Ltd for planning permission to vary condition 2 and 3 of planning permission 7/140/96 dated 10/06/1997 to allow revision of restoration contours and an increase in waste input – proposed disposal of an additional 3 million cubic metres of domestic, commercial and industrial waste thus enabling the site to be restored for use as a country park or similar use whilst improving the design of the water management system – amendment to condition 2 (personal permission).

(ii) 02/1816 by Crosby Healthy Living Partnership for planning permission to erect a multi-sports area with floodlighting at Sheffield Park, Ferry Road, Scunthorpe.

(iii) 03/0409 by Mr M Hall for planning permission to erect a dwelling at Plot 17, Middlegate Close, Barrow-upon-Humber.

(iv) 03/0519 by Mr Bassindale for planning permission to erect a pair of semi-detached dwellings, land adjacent to the Methodist School, Fieldside, Crowle.

(v) 03/0569 by G and A Sherwood for planning permission to erect a bed and breakfast accommodation with existing use at Yarborough Arms, Ulceby Road, South Killingholme.

(vi) 03/0606 by the Trustees of Epworth Baptist Church for planning permission to erect an extension to a chapel hall (resubmission of 2002/0160).

(subject to an additional condition to ensure that demolition of the building is completed before the extension is brought into use).

(vii) 03/0732 by Mr R Raby for planning permission to erect a single-storey extension to the front of a dwelling, 6 Kings Avenue, Brigg.

(Prior to consideration of this application, a representative of the applicant addressed the committee in accordance with the provisions of Procedure Rule 36 (e).

He considered that the design of the extension was sympathetic to its environment. The extension would enable the family to cater for their disabled son).

(viii) 03/0740 by Mr S J Bright and Mrs S M Bright for planning permission for change of use from mixed commercial/residential to children’s day nursery at Barrow Fisheries, 30 High Street, Barrow-upon-Humber.

(Prior to consideration of this application, an objector and one of the applicants addressed the committee in accordance with the provisions of Procedure Rule 36 (e).

The objector was concerned as to the impact that the application would have on the High Street.

The application would lead to the High Street being congested for long periods of the day. Parking spaces were currently at a premium, and the proposed car park to the rear of the property would be dangerous for cars leaving due to the poor visibility at the access of the car park. Congestion on High Street would put children’s lives at risk. Concern was also expressed to an increase in noise nuisance and a loss of privacy.

One of the applicants responded by stating that he had been in the childcare provision business for 14 years. There had been no neighbour complaints at the property. Trained staff would supervise all children. The service was desperately needed in Barrow and the application would redevelop a derelict building. The application was not for a playgroup whereby all children arrived and departed at the same time).

(ix) 03/0753 by Mr M R Bell for planning permission to site a temporary mobile home in connection with a poultry business, Grayingham Field Farm, Grayingham Road, Kirton-in-Lindsey.

(x) 03/0865 by Davenport Homes (Ltd) for planning permission to erect a detached house with garage, Plot 8, Advent Court, off Spruce Lane, Ulceby.

(Prior to consideration of this application, an objector addressed the committee in accordance with the provisions of Procedure Rule 36 (e).

The objector was concerned that the application would prevent sunlight entering his lounge. A brick wall would also obscure his view from the lounge bay and lounge side windows).

426 Resolved – That the following applications be refused in accordance with the recommendations contained in the reports.

(i) 03/0435 by Tony Hale and Paul Johnson for planning permission to retain change of use from agricultural to storage and sorting of used car tyres at Grange Farm, off A180, Croxton.

(Prior to consideration of this application, a representative of the applicant and an objector addressed the committee in accordance with the provisions of Procedure Rule 36(e). The applicant stated that the existing buildings were used for agricultural purposes. This application was an opportunity to re-use the existing buildings. Planning Policy Guidance encouraged the re-use of agricultural buildings to protect the buildings and provide employment. Planing officers had overlooked policy RD2 – criteria 5. Policy RD6 was appropriate as it related to reusing buildings for industrial and commercial use in the open countryside. The site would not be visible from Grange Farm or the highway. There was no highway objection and the site would be environmentally friendly.

An objector stated that the land had been used only for agricultural purposes for many years. The storing of tyres was very hazardous and dangerous. The applicants would only be entitled to access the site through Grange Farm.)

Often various delivery vehicles blocked the access. Grange Farm was rat infested).

427 Resolved – That consideration of the following applications be deferred until the next meeting and that members visit the sites prior to that meeting.

(i) 03/0329 by G Singh Hardy’s Cash and Carry for planning permission to erect a warehouse extension at Hardy’s Cash and Carry, 26 Hebden Road, Scunthorpe.

(Prior to consideration of this application, an objector and the applicant addressed the committee in accordance with the provisions of Procedure Rule 36 (e).

An objector stated that the council had purchased the land on a compulsory purchase order. Nearby residents had been informed that the land would form a 25-yard buffer zone between the factories and houses. However, the boundary had now changed and there was no buffer zone left. There was a sycamore tree to the rear of 24 Scotter Road which would be at threat from the application. Condition 2 would need to be enforced to ensure that there were no windows or air vents on the eastern elevation of the extension. The machinery should be installed before the planning permission is granted.

The applicant replied by stating that he was originally informed that he did not need planning permission for change of use to a cash and carry. The new development would create 13 jobs. No chemicals would be used on the site other than those used for cleaning equipment. The site had been broken into twice. The applicant stated that it was not his intention to affect his neighbour’s quality of life.)

(ii) 03/0708 by Mr G Singh for planning permission to change the use of part of a warehouse to a potato processing and packing plant with security guard’s accommodation at first floor level, 26 Hebden Road, Scunthorpe.

(Prior to consideration of this application, an objector addressed the committee in accordance with the provisions of Procedure Rule 36 (e).

An objector claimed that there were better sites available for this application. The applicant had been operating the potato processing and packing plant for three months without planning permission. Noise from the site was a major problem for local residents. Foul water from the plant had been discharged into the storm water culvert, polluting the environment. Potatoes were currently delivered and unloaded at the site late at night, disturbing local residents. There was no need for a security guard to live on the premises, as this would not prevent access to the site.

(iii) 03/0737 by Scawby Under 5s for planning permission to erect a nursery and out-of-school club, Scawby Primary School, West Street, Scawby.

(Prior to consideration of this application, an objector and a representative of the applicants addressed the committee in accordance with the provisions of Procedure Rule 36 (e).

The objector stated that they were not opposed to the nursery. However, they did object to building on the edge of the village green. The development would make children vulnerable when playing on the green. The proposal would create even greater traffic problems on West Street, especially at school times. There are also more appropriate sites to house the nursery and after school club.

A representative of the applicant stated that there was a demand for the nursery. The children would benefit from having the nursery and after school club on the school site. The site is not designated as parkland. The development is acceptable to the council’s education service. The DfES recommends that all nurseries and out of school clubs be situated on school land due to the improved security for the children. The traffic flow to the site will be regulated by staggering the times parents arrive to collect their children).

428 Resolved -That consideration of the following applications be deferred.

(i) 02/1555 by Able UK Ltd for planning permission to use land and erect warehouse and distribution units for port-related purposes on land to the north and north-east of Chase Hill Road, North Killingholme.

(ii) 02/1838 by Able UK Ltd for planning permission to retain part of site and change use of part of site from industrial land and farmland to vehicle distribution and storage facility on land to the east of Rosper Road, South Killingholme.

429 (18) APPEALS – The Director of Environment and Public Protection submitted a report informing members of the outcome of the following appeals: –

(i) Against the refusal of outline planning permission for residential development on land to the rear of Willow Tree Lodge, Low Street, Haxey – Reference 02/1074 – Appeal Dismissed.

(ii) Against the refusal of outline planning permission for the erection of a detached dwelling and garage on Plot 1 to the rear of 10 Windsor Lane, Crowle – Reference 02/1078 – Appeal Dismissed.

(iii) Against the refusal of outline planning permission to erect a dwelling on a site adjacent and to the rear of 34 Low Street, Haxey – Reference 02/1124 – Appeal Dismissed.

(iv) Against the refusal of outline planning permission for the erection of one dwelling at 242 Wharf Road, Ealand – Reference 02/1366 – Appeal Dismissed.

(v) Against the refusal to grant planning permission to erect a two-storey domestic extension at 12 Park View, Crowle – Reference 02/1660 – Appeal Allowed.

430 (19) STATISTICS OF PLANNING APPLICATIONS – APRIL – JUNE 2003 – The Director of Environment and Publication Protection submitted a report informing members of the council’s performance in handling planning applications in the second quarter of 2003.

Resolved – That the report be noted.

431 (20) ENVIRONMENT ACT 1995 – PERIODIC REVIEW OF MINERAL PERMISSIONS – The Director of Environment and Public Protection submitted a report on the Periodic Review process for mineral permissions and a programme of work and list of sites for review.

Resolved – (a) That the list of sites for review be approved, and (b) that the report be noted.
