PRESENT: – Councillor Wardle (Chairman in the chair ).

Councillors Long (Vice – Chairman), Barkworth, Bunyan, England, Fordham, Grant, Holgate, Kirk, Whiteley and Wood.

Councillors Briggs, Mrs Bromby and Smith attended the meeting in accordance with the provisions of Procedure Rule 37 (b).

The committee met at Pittwood House, Scunthorpe.

636 CHAIRMAN’S REMARKS – The chairman welcomed everyone to the meeting. He introduced Andrea Ellis, the recently appointed Environment Officer (Trees & Landscape)

He asked all members of the committee to stand and join him for a minute’s silence in memory of Councillor Vince Rocks who had recently died. Councillor Rocks was a former chair of the committee and had been a member of Scunthorpe Borough Council prior to local government reorganisation.

Members observed a minute’s silence in memory of Councillor Rocks.

638 MINUTESResolved – That the minutes of the proceedings of the meetings held on 3 November and 12 November, 2004, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman, subject to the correction of the numbering.

639 (60) APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decisions at the previous meeting, members had undertaken a site visit earlier in the day. The Head of Planning and Regeneration submitted reports and updated them orally.

(i) 04/1504 by Mr W McClean for the erection of a bungalow and garage (siting and means of access not reserved for subsequent approval) on land adjacent to 3 Shepherds Croft, Epworth

Prior to consideration of this application, the applicant addressed the committee in accordance with the provisions of Procedure Rule 35 (e). He explained his own and his wife’s ill – health. He referred to the statement in the report that the proposal would be out of character with its surroundings and stated that there were a number of dwellings on Shepherds Croft which were of a similar nature. There was adequate amenity space on the site.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

(ii) 04/1209 by Mr B Meakin for the erection of 3 dwellings including the demolition of existing dwelling at Imphal, High Street, Wroot

Prior to consideration of this application, the applicant addressed the committee in accordance with the provisions of Procedure Rule 35 (e). He stated that he had attempted to meet the relevant criteria contained in the Local Plan. The site was one of the few in the village that met all of the criteria. There was little housing available in the village and most of the houses currently for sale were very expensive. The bungalow currently on the site was in need of considerable work.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

640 (61) PLANNING APPLICATIONS – The Head of Planning and Regeneration submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. Officers updated the schedule orally in respect of late representations and other significant developments since its preparation.

(i) 02/1325 by Croftsdun Enterprises Ltd for the erection of 10 detached 4-bedroom houses and garages and 4 detached houses and garages being a substitution of house types approved under permission 2/0025/94 dated 02/10/1996.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

(ii) 03/1907 by Mr A Cliffe for the conversion of a barn into a dwelling at The Barn, Crofts Lane, Owston Ferry.

Prior to consideration of this application, the applicant addressed the committee in accordance with the provisions of Procedure Rule 35 (e). He stated that he had experienced problems with children getting into the barn, which was currently used for storage.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iii) 04/0473 by Mr and Mrs Cook for the amendment of permission for the erection of extensions to a bungalow to form a detached house and detached garage, to include the insertion of velux window in new roof slope at Horseshoe Cottage, North End, Goxhill.

Resolved – That the amendment be agreed.

(iv) 04/1196 by Trustees of the Lord St Oswald Deceased Residuary for the erection of a detached dwelling at land adjacent to 8 School Lane, Appleby

Prior to consideration of this application, the agent addressed the committee in accordance with the provisions of Procedure Rule 35 (e). He said that the issue was whether the proposed dwelling would have an impact on neighbouring properties in terms of overlooking and overshadowing. He stated that it would not have a significant impact.

The Head of Planning and Regeneration reported a late representation from objectors. This stated that all of the objector’s side garden would be removed rather than part of it as described in the report. Also the window referred to as a dining room window was actually a lounge window.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(v) 04/1431 by Mrs L Jackson for consent to fell two ash trees in group A1 covered by Tree Preservation (Messingham) Order 1955 at 6 Brigg Road Messingham

Resolved – That consent be granted in accordance with the recommendation contained in the report.

(vi) 04/1593 by Mr A Moore, Classic Developments Ltd for the erection of 2 dormer bungalows on land off Station Road, Hibaldstow

Prior to consideration of this application, the applicant addressed the committee in accordance with the provisions of Procedure Rule 35 (e). He stated that the proposal had been amended following discussions with planning officers. The position and size of the proposed bungalows had been amended. The parish council had objected on highway grounds but the Highways Unit had no objections.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vii) 04/1713 by North Lincs Net for advertisement consent to display three flagpoles and flags at Normanby Gateway, Lysaghts Way, Scunthorpe.

Resolved – That consent be granted in accordance with the recommendation contained in the report.

(viii) 04/1725 by Mr C Calladine for the erection of two semi-detached cottages on land adjacent to 20 Cross Street, Crowle

The Head of Planning and Regeneration reported a late representation. All points had been addressed in the report apart from a concern about the removal of asbestos from the site, which was not a planning consideration. A Flood Risk Assessment had now been received and was satisfactory. Therefore an additional condition was required.

Resolved – That permission be granted in accordance with the recommendation contained in the report, subject to an additional condition relating to the flood risk assessment and the insertion of “26 November 2004” in Condition 2.

(ix) 04/1724 by Mr C Calladine for conservation area consent for the demolition of a single-storey building on land adjacent to 20 Cross Street, Crowle.

Resolved – That consent be granted in accordance with the recommendation contained in the report.

(x) 04/1762 by Mr A Harrison for outline permission for the erection of 2 dwellings at 33 West End, Epworth.

Prior to consideration of this application, the agent addressed the committee in accordance with the provisions of Procedure Rule 35 (e). He stated that, whilst the site was outside the development limit, it was an infill plot. The proposed development would enhance its surroundings. A flood risk assessment had now been submitted. Whilst the development would be tandem development the dwellings would be at a right angle to the rear site boundary, therefore loss of privacy would not be an issue.

The Head of Planning and Regeneration advised the committee that the site was outside the development limit for Epworth. It would lead to overlooking of the existing dwelling on the site and noise nuisance from vehicles entering and leaving the site. The flood risk assessment was unsatisfactory.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(xi) 04/1764 by Birchwood Developments (Lincs.) Ltd for the erection of three detached bungalows with access off West Acridge on land adjacent to and to the rear of 36 West Acridge, Barton – upon – Humber.

Prior to consideration of this application, an objector addressed the committee in accordance with the provisions of Procedure Rule 35 (e). She was concerned that there was a lack of off-street parking and turning space and that the proposal would lead to an increased hazard.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(xii) 04/1797 by Mrs M Gilbey for outline permission for two dwellings on land adjacent to Rockywal, Vicarage Lane, North Killingholme

(xiii) 04/1864 by Mr Brumby for outline permission for the erection of a detached dwelling on land west of 51, The Nooking, Haxey

Prior to consideration of this application, the applicant’s agent addressed the committee in accordance with the provisions of Procedure Rule 35 (e).He stated that single dwellings could be “absorbed” in minimal growth settlements. This was an infill plot between existing dwellings and was currently in a state of neglect. There was a demand for housing in this area.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

(xiv) 04/1874 by P D Fencing for outline permission for the erection of a bungalow and office on land to the east of Station House, Station Road, Hibaldstow

Prior to consideration of this application, a representative of the applicant addressed the committee in accordance with the provisions of Procedure Rule 35 (e). He stated that there was a need for someone to live on the site for security purpose. The proposal would clear up the site and would create jobs.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

642 (63) ENFORCEMENT UPDATE – The Head of Planning and Regeneration submitted a schedule giving details of progress in respect of matters on which the committee had authorised enforcement action. He updated the report by advising the committee that an appeal had now been received against the notice issued in respect of the former Blue Circle Cement quarry at Gainsthorpe.

643 (64) CONFIRMATION OF A TREE PRESERVATION ORDER AT 28 STONE LANE, BURRINGHAMResolved – That consideration of this item be deferred to give the owners of the tree the opportunity to address the committee should they wish to do so.
