568 MINUTES – Resolved – That the minutes of the proceedings of the meeting held on 21 May, 2004, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman, subject to the amendment of numbering (563 to 566).

569 (8) APPLICATIONS DEFERRED FROM PREVIOUS MEETING –- In accordance with the decision at the previous meeting, members had undertaken a site visit the day prior to the meeting. The Head of Planning and Regeneration submitted reports and updated them orally.

(i) 04/0394 by A R Howe for the erection of 7 detached dwellings (resubmission of 2003/1898 refused 11/02/2004) on land off Ings Road, Kirton–in-Lindsey.

The Head of Planning and Regeneration reported a late representation regarding the retention of the hedgerow on the northern side of Ings Road. He referred to previous permissions granted on the site and showed the plans accompanying those applications and indicating the extent of the proposed walls associated with those applications.

Resolved – That permission be granted in accordance with the recommendation , subject to an amendment to condition 11 to require that the height and position of the existing boundary wall be amended to accord with the plan accompanying application 98/1555.

(2) 04/0551 by Mr and Mrs D Eaton for the replacement of an existing garage at Rose Cottage, Field Road, East Lound.

Prior to consideration of this application, an objector addressed the committee in accordance with the provisions of Procedure Rule 35 (e). She considered that the proposed garage would be too high and would block views from the objector’s property. She also believed that the garage could be used as living accommodation in the future.

The Head of Planning and Regeneration indicated that the garage would be smaller than in the original application. The speakers remarks about a residential use were pure speculation. The building would be screened by a conifer hedge between the properties.

Resolved – That permission be granted in accordance with the recommendation.

(iii) 04/0286 by Mr and Mrs Barnett for extension of a dwelling at 22 Tee Lane, Burton–upon-Stather.

Resolved – That permission be granted in accordance with the recommendation.

570 (9) PLANNING APPLICATIONS – The Head of Planning and Regeneration submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. Officers updated the schedule orally in respect of late representations and other significant developments since its preparation.

Resolved – That approval be granted in accordance with the recommendation contained in the report

(i) 04/0040 by Marishal Thompson & Co. for consent to fell two horse chestnut trees (Group A1) covered by Tree Preservation (Messingham) Order 1955 at Dalson House, 4 Brigg Road, Messingham.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(ii) 04/0173 by H Barker & Sons for outline permission for the erection of an agricultural dwelling on plot adjacent to Hook House Farm, B1392, Amcotts.

Resolved – That consideration of this application be deferred at the request of the applicant.

(iii) 04/0298 by Mr A Riggall for outline permission for five dwellings on land south of Wayside Ferry Road, Barrow Haven, Barrow–upon–Humber.

Prior to consideration of this application, the applicant and an objector addressed the committee in accordance with the provisions of Procedure Rule 35 (e).

The objector was concerned that the application was inappropriate in a rural hamlet and would cause road safety problems as it would add three accesses to Wayside Ferry Road. It stated that the development would make it impossible to clean out the beck.

The applicant referred to a permission granted on the site in 1993. He stated that he had carried out works required by the NRA. There was a local demand for housing which this proposal would help to meet.

The Head of Planning and Regeneration advised that the earlier permission on the site predated the adoption of the North Lincolnshire Local Plan in which the site was defined as open countryside. There were no reasons why the application should be considered as a departure from the plan.

Resolved – That permission be refused in accordance with the recommendation.

(iv) 04/0357 by OCA Ltd for consent to fell a Lime tree in group A1 of Tree Preservation (Messingham) Order 1955

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(v) 04/0465 by Mr and Mrs Palmer for outline permission for the erection of a single-storey dwelling at Mount Royale, Front Street, Ulceby.

Prior to consideration of this application, an objector addressed the committee in accordance with the provisions of Procedure Rule 35 (e). He was opposed to the application on the grounds of access, safety, drainage and the effect on wildlife. The proposal was opposed by the parish council and was not in accordance with the village plan.

The Head of Planning and Regeneration stated that the objections were dealt with fully in the report. The site was “brownfield”. The key issues were access and the relation of the site to the village. He had had further discussions with the Highways Team who had now requested an additional condition requiring access to be taken via Mount Royale Close.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(vi) 04/0471 by Mr and Mrs N Prescott for the erection of an extension and carrying out of improvements to an existing cottageat The Fort, New Street, Elsham.

Resolved – That permission be granted in accordance with the recommendation.

(vii) 04/0587 by Mr A H Arnold for the erection of ground floor extensions to the front and rear of a dwelling at 63 St Barnabas Road, Barnetby

Prior to consideration of this application, an objector addressed the committee. He was concerned that the proposal would lead to a loss of privacy and enjoyment of his own property. The Head of Planning and Regeneration stated that the proposed conditions would help to alleviate the situation.

Resolved – That permission be granted in accordance with the recommendation

(viii) 04/0593 by Mr and Mrs S Clayton for the erection of an extension,, garage and boundary walls at 321 Messingham Road, Bottesford.

Resolved – That permission be granted in accordance with the recommendation.

(ix) 04/0601 by Mr A Kaye for the erection of a first floor extension to a dwelling at Oatlands House, 44 West End, Winteringham.

Resolved – That permission be granted in accordance with the recommendation.

571 (10) APPEAL – The Head of Planning and Regeneration submitted a report on the outcome of the following appeal.

Against the refusal to grant outline permission for two detached dwellings at the rear of 11 Main Street, Worlaby (Application 2003/0781)

The appeal had been dismissed.

Resolved – That the report be noted.

572 (11) ENFORCEMENT UPDATE – The Head of Planning and Regeneration submitted a schedule giving details of progress in respect of matters on which the committee had authorised enforcement action.
