The committee met at Pittwood House, Scunthorpe.

706 MINUTES – Resolved – That the minutes of the proceedings of the meetings held on 25 May, 2005, and 10 June 2005 (Policy Meeting) having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman, subject to their correction by recording that Councillor England declared a personal interest in applications 04/2149 (knew former owner of land) and 05/0367 (knew applicant) and that he had been lobbied in respect of application 04/2149 by various objectors.

707 (11) APPLICATIONS DEFERRED FROM PREVIOUS MEETING FOR SITE VISITS – In accordance with the decisions at the previous meeting, members had undertaken site visits earlier in the day. The Head of Planning and Regeneration submitted reports and updated them orally.

(Councillor Eckhardt, having declared a personal and prejudicial interest in the following application, 05/0367, left the meeting at this point)

(i) 05/0367 by Mr W Eckhardt for the erection of 3 town houses (means of access not reserved for subsequent approval) (resubmission of 2004/2213, withdrawn 22/02/2005) at 2 The Nooking, Haxey.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(Councillor Eckhardt returned to the meeting at this point)

(ii) 05/0460 by Mr and Mrs Russell for the erection of a replacement detached house and outbuildings at Cleatham Cottage, Cleatham.

Resolved – That permission be granted in accordance with the recommendation contained in the report, subject to additional conditions removing “permitted development” rights and the use of natural clay pantiles for the roof.

708 (12) PLANNING APPLICATIONS – The Head of Planning and Regeneration submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. Officers updated the schedule orally in respect of late representations and other significant developments since its preparation.

(i) 04/1414 by E.On UK for the erection of 15 wind turbines and ancillary equipment on land north of Elsham Industrial Estate, Elsham.

Prior to consideration if this application, an objector and a representative of the applicants addressed the committee in accordance with the provisions of Procedure Rule 35 (e).

The objector was concerned that the proposal would generate low frequency noise, would be visually intrusive and would constitute a risk to public safety arising from the site’s proximity to Humberside International Airport.

The applicant’s representative stated that there had been a lack of co-operation from the airport over the safety issues. The turbines would be seen from less than ten per cent of the Wolds scarp slope area. There would be little visual impact as indicated by the lack of any objection from the Council for the Protection of Rural England. There was strong support for the proposal locally. The applicant would be happy to meet with council officers to arrange additional tests for noise levels.

Councillor Briggs, attending the meeting in accordance with the provisions of Procedure Rule 37 (b) spoke against the application. He reminded the committee of the council’s resolution in respect of PPS2 (Minute 954 refers) where it had adopted the following position in relation to renewable energy. The area should take no more than its “fair share” of such developments.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

(ii) 04/1114 by Truelove Property and Construction Ltd for the erection of 48 dwellings with garages and associated works on land off Palmer Lane, Barrow-upon-Humber.

Prior to consideration if this application, an objector and a representative of the applicants addressed the committee in accordance with the provisions of Procedure Rule 35 (e).

The objector was concerned that the development would remove a green space that had been used as informal public open space for 25 years and which met a need in the village. It would lead to more traffic and more pollution.

The applicants’ representative stated that the proposed development was in accordance with the requirements of the local plan. The site was committed brownfield land with infrastructure already in place.

Resolved – (a) That the committee is mindful to grant permission for the development; (b) that the Head of Planning and Regeneration be authorised to grant permission subject to the completion of a formal agreement under Section 106 of the Town and Country Planning Act 1990 requiring plots 40-46 inclusive to be retained in perpetuity for occupation by persons local to Barrow or the surrounding area as low-cost affordable homes, the provision of open space as specified on drawing no. 224T-05E received on 31 May, 2005 , the provision of a Local Area of Play within the northern area of open space as shown on drawing no. 224T-05e received on 31 May, 2005 and the payment of a commuted sum of £30,131.60 for the adoption/maintenance of the open space to the council, and to the conditions set out in the report, and (c) that if the obligation is not completed by 1 November, 2005 the Head of Planning and Regeneration be authorised to refuse the application on the grounds that the requirements of policies H12 and H10 of the North Lincolnshire Local Plan have not been fulfilled.

(iii) 05/0160 by Mr and Mrs Hind for the erection of two dwellings (resubmission of 2004/1159) at corner of High Street and Chapel Street, Epworth.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iv) 05/0506 by Mr and Mrs T M Jobson for the change of use of bed and breakfast accommodation into 4 individual self – contained flats at Wish U Well, Brigg Road, Wrawby.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iv) 05/0527 by Tesco stores Ltd for consent to display 1 internally illuminated fascia sign, 1 externally illuminated projecting sign and 1 externally fascia sign at One Stop Convenience Store, 13 – 19 High Street, Crowle.

Resolved – That consent be granted in accordance with the recommendation contained in the report.

(v) 05/0539 by Mr and Mrs Paton for the erection of a two -storey extension at 12 Low Street, Haxey.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vi) 05/0572 by J & M Associates for the erection of a dwelling and garage with new access at Abbey Road, Ulceby.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vii) 05/0573 by Mr S Ahmed for the erection of a two-storey extension to the rear and conversion of first floor accommodation to guest rooms at The Loco, 31 – 33 Church Street, Haxey.

Prior to consideration if this application, the applicant addressed the committee in accordance with the provisions of Procedure Rule 35 (e). He stated that he had consulted with officers prior to submitting his application. None of the objectors lived in the vicinity of the site. The development would create employment.

Resolved – That permission be granted in accordance with the recommendation contained in the report

(ix) 05/0616 by Mr and Mrs D Smith for the conversion of a garage into a games room and construction of a bedroom extension over, and erection of a sun lounge and detached garage at 9a School Lane, Appleby.

Resolved – That permission be granted in accordance with the recommendation contained in the report

(x) 05/0639 by Mr and Mrs Lee for the erection of a detached house and garage on land to the rear of Holly House, North Street, Barrow-upon-Humber.

Prior to consideration if this application, an objector and one of the applicants addressed the committee in accordance with the provisions of Procedure Rule 35 (e).

The objector was concerned that the proposal would lead to noise and a loss of privacy. It would be too close to the objector’s house and would overlook her garden. A 200 year old barn had been removed to make room for access. A fence should be erected between the two properties of the development was to go ahead. There were no turning facilities or footpaths in place.

The applicant stated that he would be happy to erect a fence between the two properties. The development would not lead to any more noise than any other family house. The design had been amended several times to address the objector’s concerns. The proposed house would not overlook the objector’s property.

Resolved – That permission be granted in accordance with the recommendation contained in the report, subject to an amendment to condition 6 to require the erection of a fence on the northern boundary.

(xi) 05/0688 by Mr L Crapper for the erection of a two -storey extension to the side and a second – storey extension to the rear of 8 Colleywell Close, Westwoodside.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(xii) 05/0709 by Mr and Mrs C Dickerson for the erection of a single-storey side extension and detached double garage, form rooms in roof space with associated rear balcony, and alteration of vehicular access including new boundary wall at 71 Haxey Lane, Haxey.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(Prior to consideration of the following matter, application 05/0765, Councillor Kirk declared a personal interest in the matter as he knew the objector’s wife)

(xiii) 05/0765 by Mrs C and Mr D Gossop for the erection of a conservatory to rear of 28 Newland Drive, Scunthorpe.

Prior to consideration if this application, an objector and one of the applicants addressed the committee in accordance with the provisions of Procedure Rule 35 (e). They both indicated that they had resolved the objection and that the applicant would address the objector’s concerns regarding gutterings and drainage.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

709 (13) ENFORCEMENT UPDATE – The Head of Planning and Regeneration submitted a schedule giving details of progress in respect of matters on which he had taken enforcement action under delegated authority.

Resolved – That the report be noted.
