94 MINUTES – Resolved – That the minutes of the proceedings of the meeting held on 30 March, 2006 having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman.

795 (94) APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decision at the previous meeting, members had undertaken a site visit the day prior to the meeting. The Head of Planning and Regeneration submitted reports and updated them orally.

(i) 05/1893 by Mr and Mrs Stephenson for the retention of an existing wall and provision of new timber gates at Annelton House, Cherry Lane, Barton–upon–Humber.

That permission be refused on the grounds that the wall is too high and not in keeping with the character of the area.

(ii) 05/1809 by Playing Fields Association for replacement play equipment and erection of a multi – sports court with floodlighting at Westwoodside Playing Field, Akeferry Road, Haxey.

Prior to consideration of this application an objector addressed the committee. She was concerned that access to a farm would be blocked and that there were no toilet facilities proposed for the development. The use would create nuisance in the form of noise and anti–social behaviour.

Resolved – That permission be granted in accordance with the recommendation contained in the report, subject to the amendment of the description by the deletion of the word “floodlighting” and its replacement by “four 8 metre high floodlight columns”

796 (95) PLANNING APPLICATIONS – The Head of Planning and Regeneration submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 03/0852 by Singleton Birch Limited for the extension of a quarry with restoration to agriculture, woodland and nature conservation on land to the north and east of Melton Ross Quarries, north and east of Melton Ross Quarries. North side of the A18, Melton Ross.

Prior to consideration of this application, a representative of the applicants addressed the committee. He stated that the company supplied chalk to the local steelworks. The proposed extension would provide for continued quarrying for a period of approximately 25 years. The site would be restored to agriculture use after work was completed. The archaeological issues could be addressed by means of a Section 106 agreement and conditions.

The head of Planning and Regeneration reported that an amended plan had now been received indicating that there would be no quarrying in the part of the south eastern quadrant closest to the Scheduled Monument. An extra condition could be imposed to enforce this.

(iv) 06/0065 by Mr R Shaw for outline permission for the erection of 2 pairs of semi – detached bungalows (means of access not reserved for subsequent approval) at 21 Wharf Road, Crowle.

Prior to consideration of this application the applicants’ agent addressed the committee. She stated that that the proposal would replace an existing dwelling on the site frontage with affordable homes to the rear of the site. They would be suitable for retired people.

The Head of Planning and Regeneration advised the committee that the proposed development was not affordable housing. It was backland development.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

(v) 06/0066 by Mr R Shaw for outline permission for the erection of a detached house and a detached bungalow (means of access not reserved for subsequent approval) at 21 Wharf Road, Crowle.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

(vi) 06/0073 by Mr and Mrs Dunworth for the erection of cattery units and staff area with accommodation in association with a change of use to a commercial cattery at Tara, Holme lane, Holme

Prior to consideration of this application an objector addressed the committee. He stated that the development would constitute two houses on a single plot. It would be a brick and tile building in contrast to the existing wooden building on the site. It would be a commercial use in open countryside.

The Head of Planning and Regeneration advised the committee that it was not uncommon for this type of business to be located in this sort of area. There was a need for residential development to be provided on the site for animal welfare purposes.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vii) 06/0108 by M Daw for the erection of a two-bedroom detached house (resubmission of application 2005/1709 dated 20/12/2005) at rear of 22 Mill Road, Crowle.

Prior to consideration of this application the applicants’ agent addressed the committee. He stated that the proposal was for one small detached house. The application addressed the grounds for the previous refusal on the site. The access already served six dwellings and one additional house would not generate significant additional traffic.

Resolved – That consideration of this application be deferred and that members undertake a site visit.

(viii) 06/0148 by Mr D Sturman for the erection of an extension and associated alterations at 54 Old Brumby Street, Scunthorpe

Resolved – That it be noted that this application has been withdrawn.

(ix) 06/0149 by Mr D Cutts for the removal of condition 4 of permission 1999/0884 to allow the unfettered residential use of holiday cottages and to make amendments to the approved internal layout in order to create 3 residential units instead of 4 at Mill Farm House, Barrow Road, Goxhill

(x) 06/0219 by Mr and Mrs Prince for the retention of a detached garage on land adjacent to 1 Derrythorpe Road, Crowle Bank Road, Althorpe.

Resolved – That consideration of this application be deferred and that members undertake a site visit.

(xi) 06/0250 by Mr A Dibdin for the retention of a two –storey store and games room at 19 Malvern Road, Scunthorpe

Prior to consideration of this application an objector addressed the committee. He stated that whilst permission had originally been granted for a building to be occupied by elderly relatives of the applicant, it was more industrial in character and was not in keeping with the submitted plans. The east facing frontage had large windows and external balconies.

Councillor Gosling, attending the meeting in accordance with the provisions of Procedure Rule 37 (b) spoke against the application. In addition to the points raised by the objector he stated that trees and shrubs had been removed from the site. An additional building was also being constructed to the east of the site.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

(xii) 06/0257 by C Stapleton for outline permission to erect a detached dwelling on land adjacent to Cedar Croft. Upperthorpe Hill, Westwoodside, Haxey.

Prior to consideration of this application the applicant addressed the committee.

He stated that the site was the one remaining plot on the south side of Upperthorpe Road. It was an infill plot. The applicant and his wife had health problems and hoped that their daughter would be able to move back to the area.

Councillor Holgate, attending the meeting in accordance with the provisions of Procedure Rule 37 (b) spoke in support of the application. He stated that, whilst the plot was technically outside the development limit, it was effectively an infill plot and would cause no demonstrable harm.

The Head of Planning and Regeneration advised the committee that health issues were not material planning considerations. The plot was clearly shown as outside the development limit in the adopted local plan.

Members of the committee considered, however that the site was an infill plot.

Resolved – That permission be granted subject to standard outline conditions and conditions relating to highways, surface and foul water disposal, landscaping and the protection of a public right of way adjacent to the site during construction.

(xiii) 06/0290 by Mr H Hameed for the erection of a detached two–storey building incorporating a single fast – food outlet with storage at first floor on land east of Lidl, Doncaster Road, Scunthorpe.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(xiv) 06/0354 by Redworth House Developments Ltd for the variation of condition 4 of planning permission 2004/0980 to allow the boundary wall to be built without using reclaimed bricks and not the full length as required by that condition.

Resolved – That permission be granted in accordance with the recommendation contained in the report and to two conditions imposed on the original permission relating to provision of car parking and no loose material from the access to be deposited onto the highway.

(xv) 06/0425 by Mr S Thompson for outline permission to erect a detached bungalow (siting and access not reserved for subsequent approval) on land adjacent to Holmefield, 41 Rectory Street, Epworth.

Prior to consideration of this application an objector addressed the committee.

Resolved – That permission be granted in accordance with the recommendation contained in the report and to an additional condition as requested by the internal drainage board.

(xvi) 06/0438 by Mr and Mrs D Clifton for the variation of condition 6 of 2005/1617 to allow the existing conifer hedge to be removed and replaced with a border consisting of trees and shrubs.

Prior to consideration of this application an objector addressed the committee.

Resolved – That permission be refused on the grounds that there has been no significant change in circumstances since the condition was imposed.

796 (96) CONSULTATIONS BY OTHER PUBLIC BODIES – Retrospective planning application for the use of long stay and transit site for 16 gypsy families (4 long stay and 12 transit pitches, 2 caravans per pitch) and use of existing buildings for amenity block and storage (Ref. M05/P/0916) at kettleby Caravan Park, Kettleby Lane.

The Head of Planning and Regeneration submitted a report informing the committee of an application to the West Lindsey District Council on which the council had been consulted.

Resolved – That West Lindsey District Council be advised that North Lincolnshire Council has no objections in principle to this development providing: (i) it is satisfied that the site will have no adverse impact on the living conditions of nearby residents; (ii) that the site is appropriately landscaped; (iii) that the retention of this site on a permanent basis should be treated as a substantial departure from the provisions of the approved development plan; and, (iv) that the number of long stay and transit pitches are restricted to prevent the further intensification of the use in this open countryside location.

797 (97) NORTH LINCOLNSHIRE LOCAL DEVELOPMENT FRAMEWORK – STATEMENT OF COMMUNITY INVOLVEMENT – ADOPTION – The Head of Planning and Regeneration submitted a report informing Members about the outcome of the Independent Examination into the Statement of Community Involvement (SCI) and recommending its adoption.

The Council was required to prepare an SCI as part of the Local Development Framework. Its purpose was to inform the community and key stakeholders about how the Council intended to involve them in the process of preparing the Development Plan Documents which would constitute the North Lincolnshire Local Development Framework.

The SCI had been subject to two periods of public consultation and had been submitted to the Secretary of State for Independent Examination on 26tOctober 2005. An Independent Examination had been conducted by the Planning Inspectorate and the Inspector’s report had now been received. The SCI was considered to have met all the Tests of Soundness and only minor amendments were required.

The Council was now required to amend the SCI as per the recommendations in the Inspector’s report and adopt it. The Council must also then publish the amended SCI as well as the Inspector’s report.

Recommended to Council – that the Statement of Community Involvement be adopted with effect from 28 April 2006.

798 (98) PUBLIC PATH CLOSURE ORDER – PUBLIC FOOTPATH 32 – BARTON–UPON–HUMBER – Further to Minute 654, the Head of Planning and Regeneration submitted a report seeking approval to send a public path closure order to the Secretary of State.

The committee had, on 5 January 2005, approved the making of a public path closure order under section 257 of the Town and Country Planning Act 1990 to close a section of Public Footpath 32 at Barton upon Humber.

Following the making of the order, two objections had been received, on of which had not subsequently been withdrawn.

The report set out the nature of the objection and addressed the issues raised.

Resolved – (i)That the public path order be submitted to the Secretary of State with a recommendation that the order be confirmed as made; and (ii) that if the order is confirmed a further order be made under section 53 of the Wildlife and Countryside Act 1981 to modify the definitive map in consequence of the closure.
