850 MINUTES – Resolved – That the minutes of the proceedings of the meeting held on 1 September (Policy Meeting) and 13 September, 2006 having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman subject to the correction of the minutes of 13 September by Councillor Phillips being recorded as having declared a personal interest in application 06/0700 and Councillor Grant being recorded as having declared a personal interest in application 06/0790 as he knew the applicant rather than having been lobbied by the applicant.

851 APPLICATIONS DEFERRED FROM PREVIOUS MEETING –In accordance with the decisions at the previous meeting, members had undertaken site visits on the morning of the meeting. The Head of Planning and Regeneration submitted reports and updated them orally.

(i) 07 by Mr and Mrs M Riley for the erection of a detached dwelling and integral garage at rear of Village Hall, Main Street, Bonby.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ii) 6 by Howe Renovation (Yorks) for the conversion of existing barn no.6 into residential use at White Hart Farm, Access road to Chapel Farm, Barton–upon–Humber.

Prior to consideration of this application, the applicant addressed the committee. He stated that the development would provide accommodation for people on housing benefit. He referred to policies HE11, HE12 and HE13 of the North Lincolnshire Local Plan which he considered should apply.

Resolved -That permission be refused in accordance with the recommendation contained in the report.

(iii) 06/0700 by Mr G A Wraith for the erection of a detached dwelling at Ivy House Farm, Main Street, Crowle.

Prior to consideration of this application the applicant’s wife addressed the committee. She stated that the site was just outside the development limit. She considered that the development limit was arbitrary and indefensible. The barn which was to be demolished had structural cracks and could be demolished without the need for planning permission. It was intended to use materials from the barn in the construction of the proposed dwelling. The proposal would help to maintain the existing structure of the building.

Resolved – That permission be granted subject to standard conditions and to either a condition or a Section 106 Agreement providing for the re-use of materials from the barn to be demolished in the new dwelling.

852 (41) PLANNING APPLICATIONS – The Head of Planning and Regeneration submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 06/0597 by Techrete UK Ltd for the erection of an extension to an existing building to provide a finishing hall, erection of a new building to provide a finishing hall and the construction of new storage bins at Techrete, Station Road, Hibaldstow.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ii) 06/0756 by Mr J Gibbons, Epworth Equestrian Ltd for the conversion of an existing utility block to form a dwelling for a period of three years at Epworth Equestrian Ltd, Scawcett Lane, Epworth.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iii) 06/0782 by Haslam Homes Ltd for the erection of 45 dwellings with associated garages and allocated parking areas on land at Barrow Road, Barton–upon–Humber.

Resolved – (a) That the committee is mindful to grant permission for the development; (b) that the Head of Planning and Regeneration be authorised to grant permission subject to the completion of a formal agreement under Section 106 of the Town and Country Planning Act 1990 (or other appropriate legislation) providing for an education commuted sum payment, play area provision and affordable housing, and (c) that if the obligation is not completed by 31 March 2007, the Head of Planning and Regeneration be authorised to refuse the application on grounds of inadequate provision for education facilities, public open space and affordable housing in accordance with local plan policy.

(iv) 06/0906 by Brinkley Homes for the revision of a detached dwelling on Plot 1 (currently under construction), previously approved under application 1997/0703 for erection of 3 dwellings on land adjacent to 84 Westgate Road, Belton.

Prior to consideration of this application, a representative of the applicants and an objector addressed the committee.

The applicant’s representative stated that the footprint of the building would remain the same. Entrance arrangements would be improved. There would be no adverse effects on the neighbouring property. The design had been improved. The principle of the development had already been agreed.

The objector stated that a previous application had been approved only after amendments had been made to address objections. The site was in an area of special landscape value. He referred to other applications on Westgate Road having been refused.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(v) 06/1051 by Mrs E I Hill for the erection of a detached dwelling on land adjacent to 7 Meggitt Lane, Winteringham.

Prior to consideration of this application the applicant and an objector addressed the committee.

The applicant stated that her present house was too large for her to manage but she did not wish to move.

The objector stated that the parking and access provision were inadequate. The development would have an adverse impact on the character of the area. A house would not be appropriate for an area where existing buildings were predominantly bungalows.

Councillor Smith, attending the meeting in accordance with the provisions of Procedure Rule 37(b) spoke against this application.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vi) 06/1121 by Mr and Mrs P Leach for the erection of a detached house and 6 mews terrace houses and refurbishment of attached cottage and adjoining retail shop (to include demolition of garage workshop and stores (to include demolition of garage workshop and stores and derelict house in rear yard) at 42 – 44 Chapel Street, Epworth.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(vii) 06/1122 by Mr and Mrs P Leach for conservation area consent to demolish existing commercial garage, service and repair workshops and detached dwelling and workshop and store buildings in the rear yard at 42 – 44 Chapel Street, Epworth.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(viii) 06/1150 by Rev R Westfield, Trustees of New Life Church for change of use to a mixed use as a church for public worship and as a concert and conference venue and associated activities at New Life Church, Brumby Wood Lane, Scunthorpe.

Prior to consideration of this application an objector and the applicant addressed the committee.

The objector claimed that there were some properties that should have been consulted and had not been. The use was inconsistent with that as a church. This was a residential area to which Policy RS13 of the Local Plan applied. The current use for concert and conference facilities was occasional. Increasing the frequency of this use would increase noise and traffic problems.

The applicant stated that the church had been established in Brumby Wood Lane for 30 years. The building was already well used. The proposal would mainly involve day time conferences. The main hall had no opening windows.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ix) 06/1154 by Mr R K Ackroyd for outline permission for living accommodation, a low level stable block, a small animal breeding centre and smallholding with land adapted to strip farmingon Plot south of Belton Fields Lane, Westgate, Belton.

Prior to consideration of this application the applicant addressed the committee. He stated that the proposal complied with all relevant requirements. It was unlikely that the land would otherwise ever be returned to strip farming.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

(x) 06/1215 by Mr A Barker for the erection of a two–storey extension, including demolition of existing garage at 65 Greenfield Drive, Hibaldstow.

Prior to consideration of this application an objector addressed the committee. She was concerned that the extension would obscure 2 of her windows. It would lead to noise, environmental pollution and highways problems. The extension would be right up to her boundary and would cause maintenance problems.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(Note: Councillor Grant, having previously declared a personal and prejudicial interest in the following application, 06/1247) left the meeting at this point)

(xi) 06/1247 by Dave Rylatt Motors for the erection of 10 dwellings, comprising 2 blocks of 4 three–storey terraced houses and a pair of semi–detached bungalows, with car parking and means of access (resubmission of 06/0876) at Chancel Road, Bottesford.

Prior to consideration of this application an objector and the applicant’s agent addressed the committee.

The objector stated that contrary to the report, the site was not currently used as a petrol filling station. The proposed development would not be in keeping with the surrounding area and would extend to within 1 metre of the boundary of his property. This would lead to a loss of privacy for the objector. It would constitute over development of the site. It would create car parking problems.

The applicant’s agent stated that the proposal was for small starter homes. The proposal had altered substantially since the previous application had been submitted. The current use was contrary to local amenity, The application would improve the appearance of the locality. The access would be from the rear. The site was “brown field” in the heart of an urban area.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(xii) 06/1265 by Mr P Evans for the erection of a detached single–storey building for children’s nursery at 7 Park Lane, Westwoodside, Haxey.

Prior to consideration of this application an objector addressed the committee. He questioned whether there was any demand for the proposal. There were other nurseries nearby with vacancies. There was insufficient car parking space and thereforeclients would park on the street.

Resolved – That permission be refused in accordance with the recommendation contained in the report.

(xiii) 06/1274 by Intech Environmental for the change of use of vacant land for storage purposes for vehicles, plant and equipment at Intech Environmental, Normanby Road, Scunthorpe.

Prior to consideration of this application the applicant’s agent addressed the committee. He stated that the company needed to expand the site due to the expansion of the business. There was a racetrack outside the development limit. The proposal was a logical extension to the existing use and would bring substantial environmental benefits.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(xiv) 06/1280 by Enterprise Inns PLC for the erection of a single–storey extension to the rear and the extension of a car park at Marrowbone and Cleaver, High Street, Kirmington.

Prior to consideration of this application a representative of the applicant and an objector addressed the committee.

The applicants’ representative stated that due to the decline in beer sales, the business was increasingly reliant on food sales. The extension was required for a kitchen. Permission had been granted six years ago but the company had been unable to implement it at that time.

The objector lived next door to the site. He was concerned that the proposal would lead to overlooking/ overshadowing of her property. The 1.5 metre high wall would be insufficient to screen noise from the building.

Resolved – That permission be granted in accordance with the recommendation contained in the report, subject to Condition 3 being amended by the deletion of 1.5m and the substitution of 2m.

(xv) 06/1284 by Mr R Smith for the change of use from a butcher’s shop (A1) to a mixed use of retail shop (A1), with sale of hot food off the premises (A5) and seating inside for consumption of hot and cold food (A3) at 49 High Street, Messingham.

Prior to consideration of this application the applicant addressed the committee. He was concerned at the proposed hours restriction as he needed to open between 7am and 6pm.

Resolved – That permission be granted in accordance with the recommendation contained in the report, subject to Condition 5 being amended by the deletion of 8.30am and the substitution of 8am.

(xvi) 06/1308 by Mr R Bowers for the creation of a new vehicular access onto Brumby Wood Lane (resubmission of 2006/0967) at 8 Jubilee Cottages, Brumby Wood Lane, Scunthorpe.

Councillor Simpson, attending the meeting in accordance with the Provisions of Procedure Rule 37(b) spoke in support of this application.

The committee considered that the application would reduce on-street car parking and would be more convenient and an asset to the property.

Resolved – That permission be granted subject to standard conditions and conditions requested by the Highways team.

(xvii)06/1325 by Mr and Mrs R Johnson for the change of use of existing outbuildings and making of alterations and extensions to form a farm shop and café with associated farm displays and walking areas (resubmissions of 2006/0768) at Medley Farm, Carrhouse Road, Belton.

Prior to consideration of this application an objector and the applicant’s agent addressed the committee. The objector stated that the site would not lend itself to passing trade. There were already plenty of cafes and a farm shop in the village of Belton. Any employment created would be seasonable. It would be contrary to local amenity.

The applicant’s agent stated that the family had been farming for 70 years. The proposal would benefit the local economy by creating employment. It was in accordance with government policies on rural diversification and would reduce “food miles” for local people. It would add to, rather than conflict, with the existing agricultural use in the area. It involved the re–use of derelict farm buildings.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(xviii) 06/1335 by Mr R Sutton for a certificate of lawfulness in respect of the proposed use as a storage and distribution centre (Class B8) at Priory Lodge, access to Mosswood Manor, Belton.

Resolved – That a certificate of lawfulness be granted for the proposed development confirming that the proposed use is within the use permitted by 2/94/0254.
