827 MINUTES – Resolved – That the minutes of the proceedings of the meeting held on 19 July, 2006 having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman, subject to their correction by the recording of Councillor Collinson declaring a personal interest in application 06/0809.

828 (21) APPLICATIONS DEFERRED FROM PREVIOUS MEETING – in accordance with the decisions at the previous meeting, members had undertaken site visits on the morning of the meeting. The Head of Planning and Regeneration submitted reports and updated them orally.

(i) 06/0809 by Mr and Mrs C Roche for the conversion of an existing barn to a house with extensions at first floor, erection of a detached house and construction of an access at barn adjacent to Westlands, 33 Main Street, Horkstow.

Prior to consideration of this application an objector and the applicant addressed the committee. The objector was concerned that the proposal would increase the roofline, infringe on his privacy and have a detrimental effect on the setting of his home.

The objector stated that the proposal would have only a small visual impact. It would prevent the site from becoming an eyesore. There would be no loss of privacy for the neighbour. There was no intention to remove the hedge. Therewould be no substantial increase in noise. There was no objection from the Highways Team.

The Head of Planning and Regeneration advised the committee that the elevation plan submitted with the application did not show 3 velux roof lights that were indicated on the main application plan. This had been pointed out to members on the site visit.

Resolved – That the application be granted in accordance with the recommendation contained in the report, subject to additional conditions requiring the retention of trees and hedges on the northern boundary and that the roof lights be obscure glazed.

(ii) 06/0832 by Mr and Mrs Drury for the erection of a dwelling, including demolition of existing barns at Braiton Cottage, Bracon, Belton.

Councillor Holgate, attending the meeting in accordance with the provisions of Procedure Rule 37(b), spoke on this application.

The committee considered that the site was surrounded by other buildings. The proposal would improve the environment and remove any contamination from the land.

Resolved – That permission be granted subject to standard outline conditions and conditions relating to landscaping, highways and contaminated land.

829 (22) PLANNING APPLICATIONS – Head of Planning and Regeneration submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 05/1747 by Mr and Mrs J North for the erection of a detached dwelling (re-submission of 04/1939) on land off Ings Lane, Hibaldstow.

The Head of Planning and Regeneration advised the committee that English Heritage had now submitted a detailed objection.

Prior to consideration of this application the applicant’s agent addressed the committee. He stated that there were no substantive points raised in the objection by English Heritage that could not be addressed.

Resolved – (a) That the committee is mindful to grant permission for the development; (b) that the application be referred to the Secretary of State for Communities and Local Government in accordance with statutory procedures to enable her to consider whether or not she wishes to intervene, (c) that, in the event of the Secretary of State deciding not to intervene, the Head of Planning and Regeneration be authorised to grant permission subject to the completion of a formal agreement under Section 106 of the Town and Country Planning Act 1990 to ensure that the agreed schedule of works to the listed mill are carried out within the agreed times scale, and to the conditions set out in the report, and (d) that if the obligation is not completed within three months of the Secretary of State’s notification that she does not intend to intervene, the Head of Planning and Regeneration be authorised to refuse the application on grounds that the proposal would be detrimental to the character and appearance of the listed mill and mill pond and scheduled ancient monument.

(ii) 06/0261 by Amara Care Ltd for development of land into a holiday and activity centre, including the erection of two holiday chalets, a camping area site shop and craft centre, and the siting of two static caravans at Woodbine Farm, Marsh Lane, New Holland.

Resolved – That it be noted that this application has been withdrawn.

(iii) 06/0447 by Watkins Gray International for the erection of 3 dormer bungalows at Coach Depot, Cocketts Lane, Hibaldstow.

Prior to consideration of this application a representative of objectors addressed the committee. He indicated that if the conditions recommended in the report were to be applied the objectors would withdraw their objections

Resolved – That the application be granted in accordance with the recommendation contained in the report, subject to the amendment of condition 11 to read” Before the dwelling on Plot 12…….”

(iv) 06/0530 by Q Hotels for the retention of existing temporary access being constructed to form a permanent access for use of the golf club and leisure centre at Forest Pines Hotel , Ermine Street, Broughton.

Resolved – That the application be granted in accordance with the recommendation contained in the report.

(v) 06/0602 by RH Stephenson & Sons for the erection of a two–storey hotel with associated facilitries and car parking (re –submission of 2005/1110) on land opposite junction of Falkland Way and Barrow Road, Barrow–upon–Humber.

Prior to consideration of this application an objector addressed the committee. He stated that the development was on a green field site on an already over–used road. It would to impaired access for emergency vehicles.

Councillor Holgate, attending the meeting in accordance with the provisions of Procedure Rule 37(b), spoke on this application.

The Head of Planning and Regeneration advised that the issues which had led to the recommended conditions10 – 14 had been addressed and these could be deleted. He also advised that as the application was contrary to the provisions of the North Lincolnshire Local Plan, it should be referred to the Secretary of State.

(a) That the committee is mindful to grant permission for the development; (b) that the application be referred to the Secretary of State for Communities and Local Government in accordance with statutory procedures to enable her to consider whether or not she wishes to intervene, (c) that, in the event of the Secretary of State deciding not to intervene, the Head of Planning and Regeneration be authorised to grant permission subject to the conditions contained in the report with the exception of conditions 10 –14.

(vi) 06/0700 by Mr G A Wraith for the erection of a detached dwelling at Ivy House Farm, Main Street, Ealand, Crowle.

Resolved – That consideration of this application be deferred in order that the concerns of the applicant regarding inaccuracies in the report can be addressed.

(vii) 06/0746 by Mr G E Spencer for the erection of a single–storey extension to include a garage at 21 Estate Avenue, Broughton.

Prior to consideration of this application an objector addressed the committee. He raised concerns regarding the arrangements for sewerage.

Resolved – That the application be granted in accordance with the recommendation contained in the report.

(viii) 06/0790 by Mr and Mrs I Crosbie for the erection of a two–storey extension to the front elevation at 28 Staniwells Drive, Broughton.

Prior to consideration of this application an objector addressed the committee. He was concerned that the proposal would have an adverse effect on the amenity of his property. He claimed that the owners of some nearby properties had not been notified of the application.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(ix) 06/0946 by Amanda Jacques for the change of use and conversion of a residential care hometo 3 separate self–contained residential flats (1 on part of ground floor for disabled use and 2 on first floor) and the use of the remainder of ground floor for communal day activity at Woodbine Farm, Marsh Lane, New Holland.

Resolved – That it be noted that this application has been withdrawn.

(x) 06/0986 by Mr and Mrs Hall for the erection of a conservatory at 21 Devonshire Road, Scunthorpe

Resolved – That the application be granted in accordance with the recommendation contained in the report.

(xi)06/1052 by Mr A Torn for the retention of a boundary wall at 29 Church Street, Messingham.

Prior to consideration of this application an objector and the applicant addressed the committee.

The objector was concerned that the wall obscured her view of oncoming traffic when exiting her driveway by car.

The applicant stated that he had been advised by a builder that planning permission was not necessary. There were no objections from the Highways Team.

The Head of Planning and Regeneration corrected the report by informing the committee that the Highways team had not advised the imposition of conditions. Also as the wall had already been built, the standard time limit conditions would not be appropriate.

Resolved – That permission be granted without conditions.

(xii) 06/1063 by Mr M Jenkinson for the erection of a two–storey extension (re–submission of 06/0603) at 4 West End Road, Epworth.

Prior to consideration of this application an objector and the applicant’s agent addressed the committee.

The objector was concerned that the proposal would drastically reduce sunlight to his garden. The extent of the proposal exceeded the “20 per cent” rule in Policy RD10 of the Local Plan.

The agent stated that the reasons for refusal of the earlier application had been addressed in the present plans.

Resolved – That the application be refused in accordance with the recommendation contained in the report.

Prior to consideration of the following item (Minute 830) Mr S Whittemore, having declared a non–pecuniary interest in the matter left the meeting for the consideration and voting thereon.

830 (23) CONSULTATIONS BY OTHER PUBLIC BODIES – 06/1135 and 06/1234 by Waste Recycling Group for construction of an Energy from Waste (EfW) facility and associated buildings/works on land west of BP Chemicals site, Saltend Lane, Preston – The Head of Planning and Regeneration submitted a report informing the committee of two applications to East Riding of Yorkshire and Hull City Councils on which the council had been consulted.

Resolved – That no objection be made, subject to the imposition of conditions to ensure that there are no adverse environmental effects from the proposal.

831 (24) ENFORCEMENT UPDATE – The Head of Planning and Regeneration submitted a schedule giving details of progress in respect of matters on which he had taken enforcement action under delegated authority.
