872  MINUTESResolved – That the minutes of the proceedings of the meetings held on 6 December, 2006, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman.

873 (54) APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decisions at the previous meeting, members had undertaken site visits on the morning of the meeting. The Head of Planning and Regeneration submitted reports and updated them orally.

Prior to consideration of the following application, 06/1643, Councillors Kirk and Glover having each declared a personal and prejudicial interest in the application left the meeting.

(i) 06/1643 by Havelok Homes for the erection of 6 affordable starter dwellings on land between Giblin Cottages and Mallalieu Court, Scunthorpe.

Prior to consideration of this application an objector and a representative of the applicants addressed the committee.

The objector was concerned that the accommodation for young people would be very close to existing elderly persons’ homes. There had been inadequate consultation on the application. The application was contrary to a number of policies in the Local Plan. The site was not well located in relation to existing infrastructure. It was not in keeping with the character of the area as the existing elderly person’s accommodation adjacent to the site were single storey. There were no proposals to replace the play space that would be lost as a result of the proposed development.

The applicant’s representative stated that the proposal would provide much needed affordable housing. It was supported by the Housing Corporation and Yorkshire Forward.

The Head of Planning and Regeneration advised that the site description in the report was misleading and that it should be amended to read as above.

Resolved – That permission be granted in accordance with the recommendation contained in the report, subject to an additional condition requiring a tree survey to be carried out.

Councillor Kirk returned to the meeting at this point. Councillor Glover having declared a personal and prejudicial interest in the following application 06/1497 remained outside.

(ii) 06/1497 by Hanover Housing Association for the erection of a development comprising 45 flats with a restaurant/café, shop, hair and beauty salon, offices and landscaping works on land off Kenilworth Road, Scunthorpe.

Prior to consideration of this application an objector and a representative of the applicants addressed the committee.

The objector was concerned at the potential loss of privacy arising from the proposed development. The proposed layout would constitute over development incompatible with its surroundings. Extra traffic would filter into Warwick Road which was already obstructed by parked cars. This would become worse. The site was a green area used for various community activities and by local children. It should be designated as a town green.

The applicant’s representative stated that the site was unallocated land. There was other housing on Kenilworth Road that was closer together then that proposed.

Members were concerned that the three–storey element of the scheme would be inappropriate and out of scale.

Resolved – That permission be refused on the grounds that the incorporation of three-storey development on this site would be inappropriate.

Councillor Glover returned to the meeting at this point.

874 (55) PLANNING APPLICATIONS – The Head of Planning and Regeneration submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 06/1404 by Allison Homes Eastern Limited for the erection of 40 dwellings on land off Axholme, Epworth.

Prior to consideration of this application an objector and a representative of the applicants addressed the committee.

The objector was concerned at the density of the proposed development, its proximity to existing properties, the access onto Studcross and the loss of hedgerows.

The applicant’s representative stated that the applicants had worked closely with officers on the application. It complied with all the relevant policies on the local plan and was consistent with national guidance.. Work was already taking place on a Section 106 Agreement. The proposed development would be in keeping with its surroundings and would integrate into the street scene.

Resolved – That consideration of the application be deferred until the next meeting and members undertake a site visit prior to that meeting.

(ii) 06/1569 by Chartdale Developments Ltd for the erection of a residential development comprising 14 dwellings on land at Marsh Lane, Barton-upon–Humber.

Resolved – That it be noted that this application has been withdrawn.

(iii) 06/1657 by Littlefield Properties Ltd for the erection of 3 detached dwellings and garages on land off Church Lane, Ulceby.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iv) 06/1670 by Mr and Mrs Athwal for erection of a two–storey motel and parking facilities to include the demolition of existing building at 101 –110 Scotter Road, Scunthorpe.

Prior to consideration of this application an objector addressed the committee. He was concerned that the proposal would lead to a loss of natural light to adjacent bungalows and their gardens. It would lead to a loss of privacy and would be out of character with the nature of the area. There was no need for the development. It would lead to an increase in traffic and cause disruption during the period of construction.

Resolved – That consideration of the application be deferred until the next meeting and members undertake a site visit prior to that meeting.

(v) 06/1686 by Mr and Mrs G B Baker for the erection of a dwelling with integral garage (including demolition of existing buildings) at 29 Queen’s Road, Barnetby–le-Wold.

Resolved – That consideration of the application be deferred until the next meeting and members undertake a site visit prior to that meeting.

(vi) 06/1705 by Mr S A Smith for outline permission for the erection of a residential development comprising 3 detached dwellings at Manor Farm, Kelsey Lane, Althorpe, Keadby.

Prior to consideration of this application a representative of the applicants addressed the committee. He stated that the development boundary for Althorpe had deliberately been drawn to exclude the site, a farmstead in the centre of the settlement. This boundary was irrational.

Resolved – That consideration of the application be deferred until the next meeting and members undertake a site visit prior to that meeting.

Prior to consideration of the following application, 06/1770, Councillors Bunyan and Glover having each declared a personal and prejudicial interest in the application left the meeting.

(vii) 06/1770 by A & K Edgell for the retention of the change of use of a domestic garage to an office, domestic garden sheds to a store, and the use of part of a domestic curtliage to park a lorry – mounted cherry picker at 1 Town Hill Drive, Broughton.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

Councillors Bunyan and Glover returned to the meeting at this point.

(viii) 06/1781 by Birchwood Developments (Lincs) Ltd for the erection of a detached cottage on land off Church Street, Goxhill.

Prior to consideration of this application a representative of the applicants addressed the committee. He stated that the Highways team was happy with the application. The wall between the hilltop and the site would be retained. The development would tidy up the area.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ix) 06/1830 by Dr P A Booth and Ms J S Hayes for the erection of a detached bungalow and integral garage on land to the rear of 48 Eastfield Road, Barton–upon–Humber.

Prior to consideration of this application one of the applicants addressed the committee. He stated that the application was a modest single – storey house to replace an existing building. Objectors had raised concerns about potential noise nuisance but the nearest house was 70 metres away and on the other side of a 6foot high wall.

Resolved – That permission be refused in accordance with the recommendation contained in the report, subject to an additional condition relating to the protection of trees.

875 (56) ENFORCEMENT UPDATE – The Head of Planning and Regeneration submitted a schedule giving details of progress in respect of matters on which he had taken enforcement action under delegated authority.
