864 MINUTES – Resolved – That the minutes of the proceedings of the meeting s held on 27 October, (Special Meeting), 3 November (Policy Meeting) and 8 November, 2006, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman.

865 (43) APPLICATION DEFERRED FROM PREVIOUS MEETING – 06/1473 by Mr and Mrs Smithson for the erection of an extension to an existing barn conversion at Barn Stable, Old Village Street, Gunness – In accordance with the decision at the previous meeting, members had undertaken a site visit on the morning of the meeting. The Head of Planning and Regeneration submitted a report and updated it orally.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

866 (44) PLANNING APPLICATIONS – The Head of Planning and Regeneration submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 06/1291 by Grosvenor Healthcare UK Ltd for the erection of a three-storey extension to provide 30 bedrooms and a conservatory link to first floor between existing buildings at Redholme, Vicarage Road, Wrawby.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ii) 06/ 1323 by Janet Stennett for the retention of use of storage of 20 caravans (resubmission of application 2006/0669) on land adjacent to Brockhampton, Ruard Road, Goxhill.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iii) 06/1360 by Mr J G McGuiness for the continued use of land for the parking of two articulated tractor units and trailers at Holly Tree Farm, Sandtoft Road, Epworth.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iv) 06/1482 by Mr and Mrs R Robinson for outline permission to erect a dwelling and garage and construction of a new access (layout and access not reserved for subsequent approval) at Southlands, Church Town, Belton.

Resolved – That it be noted that this application has been withdrawn.

(v) 06/1497 by Hanover Housing Association for a development comprising 45 flats with a restaurant/café, shop, hair and beauty salon, offices and landscaping works on land off Kenilworth Road, Scunthorpe.

Prior to consideration of this application, an objector addressed the committee. He stated that the site was a green space which provided a valuable resource for local residents. The development would lead to additional vehicles visiting for which there were inadequate parking spaces. It would lead to an increase in on–street parking. The proposed three–storey buildings would not be in keeping with the neighbourhood.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(vi) 06/1503 by Mr and Mrs T G Clark for the erection of a single–storey extension to form a sunroom and extended dining/kitchen at Rivendell, Trentside, Derrythorpe, Keadby.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vii) 06/1532 by Vectair Aviation Ltd for the change of use of part of existing touring park to static holiday caravan park at 7 Lakes Country Park, Wharf Road, Ealand, Crowle.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(viii) 06/1548 by Mr A D Powell for outline permission for two building plots (including demolition of existing industrial building) with access not reserved for subsequent approval on land at the rear of 91 High Street, Belton.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ix) 06/1561 by Mr and Mrs M Sherwood for alterations and a two–storey extension to the front elevation at 7 School Drive, Messingham.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(x) 06/1570 by Keigar Homes Ltd for consent to fell an ash tree (T3) covered by Tree Preservation (Ulceby) 1995 Order on land north of Spruce Lane, Ulceby.

Prior to consideration of this application, a representative of the applicant addressed the committee. He stated that the tree had been damaged by extensive grazing and suffered from extensive rot and fungal infection and major dieback of crown .

Resolved – That consent be granted in accordance with the recommendation contained in the report.

(xi) 06/1596 by Keigar Homes Ltd for consent to fell an ash tree (T1) covered by Tree Preservation (Ulceby) 1995 Order on land north of Spruce Lane, Ulceby.

Prior to consideration of this application, a representative of the applicant addressed the committee. He stated that having drained the pond next to the tree it had been discovered that the tree’s roots had developed unevenly. The tree was therefore lacking in stability and could therefore become dangerous to the public.

Resolved – That consent be granted in accordance with the recommendation contained in the report.

(xii) 06/1620 by Mr E Bones for the erection of extensions to form a two–storey detached house at Ruard’s Lodge, Ruard Lane, Goxhill.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(xiii) 06/1643 by Havelok Homes for the erection of six affordable starter dwellings at former children’s play area, Mallalieu Court, Scunthorpe.

Prior to consideration of this application, an objector addressed the committee. She stated that that the consultation on this application had been inadequate. It was inappropriate to mix young and older people in the same locality.

Councillor O’Sullivan, attending the meeting in accordance with the provisions of Procedure Rule 37(b), spoke on this application.

Resolved – That consideration of this application be deferred until the next meeting and that members visit the site prior to that meeting.

(xiv) 06/1645 by Mr R Winter for the erection of a carport at 3 Weir Close, Westwoodside, Haxey.

Prior to consideration of this application, an objector and the applicant addressed the committee.

The objector had concerns regarding the impact on a soak away running along his boundary with the site and the asbestos roof.

The applicant stated that there would be no impact on the soak away. The roof would be built to British Standards specifications.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

867 (45) ENFORCEMENT UPDATE – The Head of Planning and Regeneration submitted a schedule giving details of progress in respect of matters on which he had taken enforcement action under delegated authority.

Resolved – That the report be noted.

868 (46) PUBLIC FOOTPATH 156A, WINTERTON – The Head of Planning and Regeneration submitted a report seeking determination of an application to modify the “County of Lincoln – Parts of Lindsey (Glanford Brigg) Definitive Map and Statement”.

Two applications had been made to the council under Section 53(5) of the Wildlife and Countryside Act 1981, firstly by a Mrs Panitz to add a 436-metre-long public footpath between the north-western end of Mill House Lane and West Street, Winterton to the “County of Lincoln – Parts of Lindsey (Glanford Brigg) Definitive Map and Statement”, and secondly by a Mr Chidwick to add a further 83-metre-long footpath running from the top of the north-west corner of number 19 Mill House Lane to Newport Drive, Winterton.

Evidence had been collected. It was considered that there was sufficient evidence to support the first application, but not the second.

Resolved – (a) That the application by Mrs Panitz be determined in her favour; (b) that an order be made under Section 53 of the Wildlife and Countryside Act 1981 to add the route shown in Appendix 1 to the report to the “County of Lincoln – Parts of Lindsey (Glanford Brigg) Definitive Map and Statement as a public footpath; (c) that if no objections are received to the order the Head of Planning and Regeneration be authorised to confirm the order, otherwise the matter be referred back to this committee, and (d) that the request by Mr Chidwick be declined on the basis of there being insufficient evidence.

869 (47) TOWER HILL TO CROSS HILL, HAXEY – The Head of Planning and Regeneration submitted a report seeking a determination of an application to modify the “County of Lincoln – Parts of Lindsey (Isle of Axholme) Definitive Map and Statement” by Haxey Parish Council.

The parish council had requested that a public footpath be added between Tower Hill and Cross Hill. However the only supporting evidence (two evidence-of–use forms) did not suggest that the route was in frequent use by the public on foot. In view of the lack of supporting evidence the parish council had written to withdraw its application.

Resolved – That the application be declined and the parish council informed accordingly.

870 (48) PUBLIC RIGHT OF WAY APPEAL – The Head of Planning and Regeneration submitted a report notifying the committee of a recent decision made by the Secretary of State for the Environment, Food and Rural Affairs in respect of a disputed definitive map modification order.

The order added Crook o’ Moor Road in the Parish of Crowle to the “West Riding of Yorkshire (Thorne Rural District) Definitive Map and Statement”.

Objections had been made to the order following which the Secretary of State had modified the order to increase the width of the byway from 8 to 12.19 metres. This modification had attracted further representations by parties who disputed the status of the path.

Following further written representations the Inspector had now published his decision which was to confirm the order as modified.

The full decision was appended to the report.

Resolved – That the report be noted.
