954  MINUTESResolved – That the minutes of the proceedings of the meeting held on 15 August 2007, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman.

955  (32) APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decisions at the previous meeting, members had undertaken site visits on the morning of the meeting. The Service Director Highways and Planning submitted reports and updated them orally.

Councillor B Briggs, having declared a personal and prejudicial interest left the meeting for consideration of the following item application 07/0644.

(i) 07/0644 by Mr A Bruce for outline permission for the erection of four retail units for general retail use and/or restaurant use with four units of domestic accommodation above (layout, scale, external appearance and access not reserved for subsequent approval) at 40 Chapel Street, Epworth.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

Councillor B Briggs returned to the meeting.

(ii) 07/0813 by Mr S Knowles for the erection of extensions to create a two – storey dwelling and associated detached garage at 24 High Street, Haxey.

Prior to consideration of this application the applicant’s agent addressed the committee. He stated that the current bungalow on the site dated from the late 1970s. The proposal would not have a detrimental impact on the street scene. The garage was of an appropriate size for its location and was within the domestic curtilage.

Policies RD1 and RD10 of the Local Plan did not apply as the site was not in open countryside.

Members considered that the development would not be inappropriate for its location and would not cause any overshadowing of neighbouring properties.

Resolved – That permission be granted subject to conditions requiring the usual time limit and the development to be built in accordance with the approved plans and materials etc.

956(33) PLANNING APPLICATIONS – The Service Director Highways and Planning submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 07/1045 by Mr K Wyman for the siting of two polytunnels at Merry Meadows, off Station Road, Graiselound.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ii) 07/1076 by Mr T King for the retention of a boundary wall and erection of an orangery, garden store and gateway at Kings Lynn, Melton Road, Wrawby.

Prior to consideration of this application the applicant and an objector addressed the committee.

The applicant stated that the site was within his garden. He had sought to comply with the planning requirements for the development but had initially been wrongly advised that he did not require planning permission. The development would not cause any overshadowing of neighbouring properties.

The objector stated that the development was contrary to policy DS1 of the Local Plan. It would cause a loss of neighbours’ amenities and would be an overpowering structure. The submitted plans did not accurately show the relationship between the development and other properties.

Resolved – That consideration of this application be deferred and that members undertake a site visit.

(iii) 07/1099 by Mr and Mrs P Oliver for the erection of a two – storey extension and detached double garage at Laurel Cottage, 30 Commonside, Westwoodside.

Prior to consideration of this application  an objector addressed the committee. He stated that the proposal  could not be regarded as an extension as it was a separate two–storey residence with its own access. It would be too close to the objector’s boundary to allow for maintenance.

Resolved – That consideration of this application be deferred and that members undertake a site visit.

(iv)  07/1104 by Barton Town Football Club for the erection of 2 spectator stands and retention of a turnstile housing at Barton Town Football Club, Marsh Lane, Barton-upon-Humber.

Prior to consideration of this application a representative of the applicants addressed the committee. He stated that the development would be for the benefit of the local community. It would be the fourth stage of the redevelopment of the ground.

The Head of Planning advised the committee of a late representation from an objector. He indicated that the main issue was whether or not the proposal would have an adverse impact on road safety or the amenity of neighbours. He requested an amendment to proposed condition 4.

Resolved – That permission be granted in accordance with the recommendation contained in the report subject to an amendment to condition 4 to read “ No development shall take place until the existing vehicular access to the site from Marsh Lane has been effectively closed ….”

(v) 07/1115 by Mrs C Rhoades for the raising of existing garage roof at 8 Maple Close, Messingham.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vi) 07/1123 by G & W Developments Ltd for the erection of one block of 101 apartments, with 50 car parking spaces and 4 cycle stores at 44-54 Dunstall Street, Scunthorpe.

Prior to consideration of this application the applicant’s representative addressed the committee. He stated that the current proposal had been drawn up to meet the concerns of the committee when it had refused a previous application on the site. There was a  reduction of residential units by 10 per cent and an increase in car parking provision.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vii) 07/1130 by O2 (UK) Ltd for the erection of a 30 m high lattice tower with 4 antennas located at the top together with equipment cabin and ancillary equipment enclosed by a 1.2 m timber fence at Telecommunications mast, Ermine Street, Broughton.

Prior to consideration of this application, an objector addressed the committee. She was concerned that the bat survey carried out had been inadequate and that the proposal would have an adverse impact on an area of high landscape value.

Resolved – That consideration of this application be deferred pending a reassessment of the submitted bat survey and a Biodiversity Management Plan.

(viii) 07/1147 by Mr S Fullwood for the enlargement of an existing fishing pond, creation of a new public car park and toilet facilities on land off West End Road, Sandtoft Road, Epworth.

Resolved – That consideration of this application be deferred and that members undertake a site visit.

(ix) 07/1242 by Miss D Burwell for the retention of a 1.8 metre fence to the side elevation at 18 Hillcrest Drive, Burton-upon-Stather.

Prior to consideration of this application an objector addressed the committee. He was concerned that the fence was out of character in an “open plan” estate where fences were prohibited by covenants.

Councillor Smith, attending the meeting in accordance with the provisions of Procedure Rule 37 (b) spoke on this application.

Resolved – That approval be granted in accordance with the recommendation contained in the report.

957  (34) APPLICATION FOR APPROVAL OF RESERVED MATTERS FOLLOWING THE GRANT OF OUTLINE PERMISSION – 07/0809 by Keigar Homes Ltd in relation to outline permission 05/0392 for the erection of 23 dwellings, access and associated parking (re-submission of 07/0389) at The Depot, Weest Acridge, Barton-upon-Humber – The Service Director Highways and Planning submitted a report informing members about an application for approval of reserved matters which was ready for determination. Outline planning permission had already been granted and the development had therefore been agreed in principle.

Consideration was now required to the details of the siting, design, external appearance, means of access and landscaping of the developments (excluding any of these matters which were expressly approved at the time outline permission had been granted).

Resolved – That permission be granted in accordance with the recommendation contained in the report.

958  (35) ENFORCEMENT UPDATE – The Service Director Highways and Planning submitted a schedule giving details of progress in respect of matters on which he had taken enforcement action under delegated authority.

Resolved – That the report be noted.

959  (36) PUBLIC FOOTPATH 5, ALKBOROUGH – The Service Director Highways and Planning submitted a report asking the committee to consider its position in relation to a definitive map order which had been the subject of unresolved objections. He informed the committee that he had become aware shortly before the start of the meeting of apparent discrepancies between the plan forming part of the report and the plan in the order.

Resolved – That consideration of this issue be deferred to seek clarification of the alleged discrepancies in the plans.
