Councillor Sidell attended the meeting in accordance with Procedure Rule 37 (b).

The committee met at the Kingsway Centre, Scunthorpe.

938  MINUTESResolved – That the minutes of the proceedings of the meeting held on 20 June 2007, having been printed and circulated among the members, be taken as read and correctly recorded and be signed by the chairman.

939  (21) APPLICATIONS DEFERRED FROM PREVIOUS MEETING –In accordance with the decisions at the previous meeting, members had undertaken site visits on the morning of the meeting. The Service Director Highways and Planning submitted reports and updated them orally.

(i) 07/0689 by Keith Ready and Co for planning permission to erect four linked dwellings, at rear of 3-4 Market Place, Barton on Humber.

Prior to consideration of this application an objector addressed the committee.

The objector stated that the status of the land was in serious doubt. It had been adopted as a highway by Barton Urban District Council and therefore should not be built on. There was correspondence to prove that the land had been recognised as part of the highway. The proposed access to the land was not adopted highway and was owned by a third party and this issue should be resolved before permission was granted.

Councillor Sidell, attending the meeting in accordance with the provisions of Procedure Rule 37 (b) spoke against this application.

The Head of Planning advised that the objector was correct in so far as the proposed access was on private land and was not included in the footprint of the build. Satisfactory access to the site could not be gained unless the right of way was maintained by the applicant and it should therefore be shown within the proposal.

Resolved – That the permission be refused, due to inadequate access provision within the application site, the fact that the development would be out of character with existing development in the conservation area and insufficient off-street parking.

(ii) 07/0501 by Advocate Development Ltd for planning permission to erect three dwellings, at The Orchard adjacent The Nutshell, Chapel Lane, Scawby.

Prior to consideration of this application the applicant’s agent addressed the committee.

The applicant’s agent wished to clarify that the footpath and verge were part of the highway, therefore owned by North Lincolnshire Council. Care had been taken to ensure that overlooking and loss of privacy were minimised, and a proposed, extensive landscaping scheme would assist with this.

Members of the committee were concerned about the destruction of part of a dry stone wall on the proposed site.It was stated that alternative access to the site existed.

Resolved – That permission be refused, since the development would result in the demolition of part of the front boundary wall and an alternative access to the site was available.

940  (22) PLANNING APPLICATIONS – The Service Director Highways and Planning submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 07/0316 by Wroot Parish Council for planning permission to remove an existing basketball pitch and build a replacement multi-use games area, including floodlights, at rear of Village Hall, off High Street, Wroot.

Prior to consideration of this application the applicant and an objector addressed the committee.

The applicant stated that although Wroot had excellent community spirit, there was little in the way of leisure facilities for children aged 8 to 16.Feedback from consultation on the application had been positive. If permission were to be granted, the village school and local football teams would make of the facilities, as well as children in the community.

The objector stated that his bungalow adjoined the football field.  He expressed concern over possible drug users being attracted by the floodlighting at night, the height of the lighting columns and the detrimental effect of the site to wildlife.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ii) 07/0449 by Keigar Homes Ltd for planning permission to erect 26 dwellings, associated garaging, pumping station and compound, on land at Brathill Farm, off Staindale Road, Scunthorpe.

Members were concerned about access to the southern part of the site and that the present access road would become unreasonably muddied due to deposits from the wheels of the vehicles travelling to and from the site.

The Head of Planning stated that it would be possible to impose conditions regarding wheel cleaning and vehicular access to land to the south of the site.

Resolved – That permission be granted subject to the completion of a section 106 agreement and conditions contained in the report, and to extra conditions relating to wheel cleaning facilities and preventing vehicular traffic entering the site along any part of its southern boundary.

(iii) 07/0657 by Dr G R Bhorchi for planning permission to erect a single storey extension to doctor’s surgery and erect security perimeter fence, at The Surgery, Town Street, South Killinghome.

Prior to consideration of this application an objector addressed the committee.

The objector stated that his own property was adjacent to the application site and he already encountered problems with privacy and parking in front of his dwelling and the proposed extension would only exacerbate this. He also expressed concern over access to his garage and driveway.

Resolved – That consideration of this application be deferred and that members undertake a site visit.

(iv) 07/0817 by Mr and Mrs Barratt for planning permission to erect a two storey dwelling and domestic detached garage, at land at 32 West Street, Hibaldstow.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(v) 07/0824 by Mr T Rust for outline planning permission to erect a dwelling with shared access to existing drive, provide parking and turning space for no. 76 and access also for no. 78 (siting and landscaping not reserved for subsequent approval) (resubmission of 2007/0336), at Plot 1, 76 High Street, Belton.

Prior to consideration of this application the applicant’s agent addressed the committee.

The applicant’s agent stated that he agreed with the report and its recommendations and that as the dwelling was to be situated behind a tree its impact would be minimal.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vi) 07/1014 by Mr J Camplin for planning permission to erect a rear extension to include bedroom in roof space (resubmission of 2007/0730), at 3 Reapers Rise, Epworth.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

941  (23) ENFORCEMENT UPDATE – The Service Director Highways and Planning submitted a schedule giving details of progress in respect of matters on which he had taken enforcement action under delegated authority.

Resolved – That the report be noted.

942  (24) CONFIRMATION OF TREE PRESERVATION ORDER – The Service Director Highways and Planning submitted a report inviting the committee to decide whether to confirm a Tree Preservation Order made on a Plane tree within the property of the Old White Farmhouse, Green Lane, Belton.

The Head of Planning informed the Committee that the objection to the making of the order had now been withdrawn.

Resolved – That the Tree Preservation Order be confirmed.
