978 MINUTESResolved – That the minutes of the proceedings of the meetings held on 7 November 2007 having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair, subject to the correction of Minute 972 by the addition of the following “ Councillor Poole, attending the meeting in accordance with Procedure Rule 37 (b) declared that he had been lobbied in relation to application 07/1588 .”

979 (49) APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decisions at the previous meeting, members had undertaken site visits on the morning of the meeting. The Service Director Highways and Planning submitted reports and updated them orally.

(i) 07/1572 by Mr and Mrs Smith for the change of use of a dwelling to provide a cattery with associated alterations (resubmission of 2007/1108) at 26 Abbey View, Mill Lane, East Halton

Resolved – That permission be granted in accordance with the recommendation subject to an additional condition prohibiting delivery of animals or goods associated with the cattery between the hours of 8.30 am – 9.30 am and 2.30 pm and 4.00 pm each weekday during school term-time.

(ii) 07/1544 by Mr L Harris for retention of a single-storey rear extension at 7 Well Street, Messingham

Resolved – That permission be refused on the following ground “ The design of the rear extension is considered unacceptable due to the size of the existing window in the east-facing elevation. In the opinion of the local planning authority the maximum size window that would be appropriate should not exceed that approved under planning permission 2001/1434. Any window larger than that already approved will result in a significant loss of residential amenity contrary to the provisions of policies DS1 and DS5 of the North Lincolnshire Local Plan.”

(iii) 07/1341 by Mr R Murgatroyd for the change of use of land to form an extension to a caravan park (to provide an additional 35 caravan pitches, including a maximum of 15 static) create a new vehicular access and visitor car parking, siting of an additional mobile unit for use as a reception/administration office and erection of a 1.8 metre high fence at Brookside Caravan Park, Stather Road, Burton-upon-Stather.

Prior to consideration of this application an objector addressed the committee. He welcomed the proposed additional six conditions. He accepted that there were a number of comments on the applicant’s web site praising the caravan site, however most of these were on the basis that the site was relatively small. The objector believed that the total size of the site should be limited to no more than 50 pitches. No static caravans should be permitted. Proposed Conditions 5 and 6 should apply to the entire site There should be no overnight parking. All vehicular parking between 8 pm and 8 am should be behind the barriers. The hedgerow running from east to west should be protected.

Councillor Smith, attending the meeting in accordance with Procedure Rule 37 (b), spoke on this application.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

980 (50) PLANNING APPLICATIONS – The Service Director Highways and Planning submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) 07/1130 by O2 (UK) Ltd for the erection of a 30m high lattice tower with 4 antennas located at the top together with equipment cabin and ancillary equipment enclosed by a 1.2 m timber fence at Ermine Street, Broughton.

The Head of Planning advised of a late representation regarding this application from an objector, who had asked to speak on the application for a third time. The Service Director Legal and Democratic Services explained the Procedure Rule provisions on speaking at the committee and why it was not possible for the objector to speak again on the application. The Head of Planning responded to the other issues referred to in the letter.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ii) 07/1354 by Mrs S Brydon for outline permission for the erection of 2 detached dwellings with detached domestic garages (access and siting not reserved for subsequent approval ) to replace existing dwelling to be demolished (re-submission of application no. PA/2007/0164) at 85 High Street, Belton.

Prior to consideration of this application an objector addressed the committee. He had no objection in principle but there was a problem with the access. An alternative and better access was available. There were also problems with drainage and overlooking.

Resolved – That consideration of this application be deferred and that members undertake a site visit.

(iii) 07/1410 by Beal Developments Ltd for the construction of a new vehicular access off Eastoft Road at 42 Eastoft Road, Crowle

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iv) 07/1483 by Mr and Mrs A Cresswell for the change of use of three existing bedrooms for bed and breakfast accommodation (re-submission of application no.PA/2007/1082) at Homelands, Humber Road, South Killingholme

Prior to consideration of this application the applicant addressed the committee. He stated that there was an area of grass adjacent to the site that was privately maintained. The road was a dead end with no through traffic. He had operated a fish and chip shop on the site for 15 years without any problems occurring.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(v) 07/1515 by Mr T Smith for the retention of a change of use to operate a landscaping contractor business, erection of a replacement garage and provision of a parking area for a commercial vehicle at 254 Wharf Road, Ealand, Crowle.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vi) 07/1559 by North Lindsey College for the change of use of commercial warehouse to educational workshops/classrooms at Global House, Ridge Way, Scunthorpe.

The Head of Planning advised that it had been alleged that an incorrect certificate of ownership may have been submitted with the application.

(xiii) 07/1681 by Dr G R Bhorchi for the erection of a single-storey extension to an existing doctor’s surgery at The Surgery, Town Street, South Killingholme
