Councillors Mrs Sidell and Waltham attended the meeting in accordance with the provisions of Procedure Rule 1.37 (b)

The committee met at Pittwood House, Scunthorpe.

1260 MINUTESResolved – That the minutes of the proceedings of the meeting held on 30 June 2010, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

At this point the Service Director Legal and Democratic reminded members and members of the public of the provisions of and application of Procedure Rule D1.35 (f), in particular the time limits to be applied to speakers and the need for speakers to refer only to material planning considerations when addressing the committee.

1261 (11) APPLICATION DEFERRED FROM PREVIOUS MEETING – In accordance with the decision at the previous meeting, members had undertaken a site visit on the morning of the meeting. The Head of Planning submitted a report and updated it orally

(i) 10/0406 by MJH Engineering Ltd for the erection of a pair of semi-detached dwellings and detached domestic garages (re-submission of PA/2009/0825) on land at corner of Butts Road, Barton-upon-Humber.

Prior to consideration of this application the applicant addressed the committee. She stated that the proposal would improve the amenity of neighbours and remove road safety problems. The only objection put forward was on flood risk grounds. There was a site close by with a similar classification of flood risk for which permission had been granted. In response to questions from members the Head of Planning indicated that five of the ash trees the subject of a Tree Preservation Order were to be felled, the remaining five were to be pruned. The felling of any further trees would require a separate application.

Councillor Mrs Sidell, attending the meeting in accordance with Procedure Rule 1.37 (b), spoke on this application

Members felt that an exception should be made to the application of the sequential test in the interests of amenity.

Resolved – That permission be granted subject to conditions relating to highways access and visibility, a flood risk assessment and materials.

1262 (12) MAJOR PLANNING APPLICATION – The Head of Planning submitted a report incorporating a schedule containing details of major applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. The Head of Planning updated the reports orally where appropriate. Other officers attending gave advice and answered members’ questions as requested.

Councillor C Sherwood having declared a personal and prejudicial interest in the following application, 10/0405, left the meeting prior to its consideration.

(i) 10/0405 by CLS Civil Engineering for the erection of industrial units within use classes B1 (a) Business Office, B2 General Industrial and B8 Storage or distribution, with associated external works and drainage on land at Europa Way, Brigg.

Prior to consideration of this application a representative of the applicants and an objector addressed the committee.

The applicant’s representative stated that the proposal was for a small industrial development on an allocated industrial site. It was similar in appearance and scale to other units on the estate. Most traffic to and from the site would be outside school hours.

The objector was concerned that the development would be very close to a school and would constitute a road safety hazard. She was also concerned that the exact use proposed was unspecified..

Councillor Waltham, attending the meeting in accordance with Procedure Rule 1.37 (b), spoke on this application.

Moved by Councillor Grant and seconded by Councillor N Sherwood –

That consideration of this application be deferred until a future meeting and that members visit the site prior to that meeting.

The voting being equal on the above motion the Chair used his second and casting vote against it.

Moved by Councillor Whiteley and seconded by Councillor England –

That permission be granted in accordance with the recommendation contained in the report, subject to amendments to Condition 2 to update plan numbers and to the deletion of Conditions 4 and 7.

1263 (13) PLANNING AND OTHER APPLICATIONS – The Head of Planning submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. The Head of Planning updated the reports orally where appropriate. Other officers attending gave advice and answered members’ questions as requested.

(i) 08/0932 by Mr M Taylor for outline permission to erect a dwelling and garage (access not reserved for subsequent approval) (re-submission of PA/2007/1989) on plot adjacent to Animal Farm, North End, Goxhill).

Resolved – That permission be granted in accordance with the recommendation contained in the report subject to the deletion of Conditions 10 and 11 and the substitution of a condition relating to a watching brief.

(ii) 08/1530 by Mr and Mrs Burton for a detached bungalow (re-submissin ofPA/2007/1636) on land to the rear of Ye Olde Blacksmiths, The Square, Goxhill.

Prior to consideration of this application an objector addressed the committee. He stated that he had no fundamental objections to the proposed development but he did have concerns about the surface water disposal arrangements.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iii) 10/0366 by Trust Care Ltd for the erection of an 8-bedroomed extension to the rear of an existing care home and an independent single-storey special care unit to the rear at Wrawby Hall Care Home, Vicarage Road, Wrawby.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iv) 10/0402 by Mr A McKinlay for the felling of a lime tree protected by Tree Preservation (Crowle) Order.

Members considered that the tree was detrimental to the amenities of the neighbouring property.

Resolved – That consent be granted subject to a condition requiring the planting of a suitable replacement tree.

(v) 10/0443 by Mr A Smith for the retention of a single-storey extension (resubmission of PA/2010/0315) at 45 Fulford Crescent, New Holland.

Prior to consideration of this application an objector and the applicant’s agent addressed the committee. The objector stated that permission had previously been refused on the site. The present proposal was not significantly different to that which had been refused. The extension would lead to a loss of light to the objector’s conservatory.

The agent stated that the extension only marginally infringed the 45° rule. It would have a glazed poly carbonate roof. The application was consistent with Local Plan policies DS1 and DS5.

Resolved – That consideration of this application be deferred until a future meeting and that members visit the site prior to that meeting. The reason for the site visit is to determine the impact of the extension on the neighbour’s property.

(vi) 10/0462 by Mrs D Revill for the erection of a detached bungalow and a detached domestic garage on land to the rear of 12 Mill Road, Crowle.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(vii) 10/0470 by Mr R Wilson for the erection of a detached dwelling including demolition of existing and change of use to garden land at Medley Cottage, Carrhouse Road, Belton.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(viii) 10/0578 by Mr A Ellison for the erection of a single-storey and two-storey extension to the rear at Jalna, Barton Road, Wrawby.

Prior to consideration of this application an objector addressed the committee. She was concerned that the extension would lead to a loss of light to her property. It would also be out of keeping with its surroundings.

Resolved – That consideration of this application be deferred until a future meeting and that members visit the site prior to that meeting. The reason for the site visit is to determine the impact of the extension on neighbouring properties.

(ix) 10/0598 by Mr J and Mrs C Gibbons for the erection of a dwelling in connection with an equestrian centre and livery at Farscawcett Farm, Scawcett Lane, Epworth.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(x) 10/0632 by Mr and Mrs M Bell for the erection of a detached house and demolition of an existing bungalow and garage at The Gardens, Sluice Road, South Ferriby.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(xi) 10/0706 by Mr S Holmes for the felling of a sycamore tree situated within a conservation area at 50 Fleetgate, Barton-upon-Humber.

Resolved – (a) That no Tree Preservation Order be made, and (b) that the works be allowed to proceed.
