Councillors J Briggs, Mrs Redfern and Waltham attended the meeting in accordance with the provisions of Procedure Rule 1.37 (b).

The committee met at Pittwood House, Scunthorpe.

Mr S Whittemore (Regulatory Support Officer) declared a non-pecuniary interest in application 10/1242 (Minute 1314 (i)) as he knew two of the supporters.

1313 MINUTES – Resolved – That the minutes of the proceedings of the meeting held on 12 January 2011, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chair.

1314 (45) MAJOR PLANNING APPLICATION – The Head of Planning submitted a report incorporating a schedule containing details of a major application for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. The Head of Planning updated the report orally where appropriate. Other officers attending gave advice and answered members’; questions as requested.

Mr S Whittemore, having declared an interest in the following application, left themeeting.

(i) 10/1242 by Grange Wind Farm Ltd for the siting of six wind turbines and associated hardstanding, tracks, anemometry mast, switchgear house and underground cables on land adjacent to Flixborough Grange Farmhouse, Flixborough.

Prior to consideration of this application five objectors, a representative of the applicant, and two supporters addressed the committee.

The objectors were concerned that the proposed turbines would be too close to residential properties. The turbines could have an adverse effect on the health of the children of one of the objectors who had a medical condition that could be exacerbated by them. The development would be of an inappropriate scale. One objector referred to Policy LC7 of the Local Plan which related to landscape protection. The proposed development would have an adverse impact on the character and amenity of the area and on Burton Woods. A speaker referred to PPS 22 and questioned the figures submitted by the applicants in relation to the amount of electricity that would be generated. He felt that the benefits of the scheme were overstated. Another objector expressed concerns regarding potential noise nuisance and questioned the validity of the submitted data.

The applicants’; representative stated that the reasons for refusal of the previous application had now been addressed. The company had reached an agreement with the family of the two children that would have been adversely affected. It had also agreed to accept a condition preventing the building of the turbine nearest to Burton. The company’;s nearby windfarm had already provided a number of benefits for the residents of Dragonby. The company intended to work with the local community. The production of the turbines could provide an opportunity for local companies. The company would also be happy to accept a condition protecting Burton woods.

The supporters referred to the need for an alternative to the use of fossil fuels for energy in view of their rapid depletion and climate change. They considered that the turbines would be a positive feature in the local landscape. The proposal would benefit the local economy by providing jobs. The issues in relation to the earlier application had now been addressed. One of the supporters addressed the health issues and stated that there would be no impact on the population at large.

Councillors J Briggs and Regan, attending the meeting in accordance with Procedure Rule 1.37 (b), spoke on this application.

Resolved – That permission be refused for reasons relating to landscape which will be clarified at the next meeting.

Mr Whittemore returned to the meeting.

(ii) 10/1437 by T G Sowerby Developments Ltd. for permission to erect 12 affordable dwellings on land off Burton Road, Flixborough.

Prior to consideration of this application three objectors and a representative of the applicants addressed the committee.

The objectors were concerned that access to the site would be via a narrow and dangerous road with blind bends. There were no suitable amenities in the village and therefore potential occupiers would be forced to use a car. They were also concerned about drainage. The development would not be in keeping with the locality. There was no demand for this type of housing in the village. It was suggested that a more suitable site would be in the Ferry Road West area of the parish.

The applicants’; representative stated that the development would be a mix of high quality affordable housing, all built to a minimum of Code Level 3 of the Code for Sustainable Housing. There was unmet need for Affordable Housing a year in the parish.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

1315 (46) PLANNING AND OTHER APPLICATIONS – The Head of Planning submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. (i) 10/1196 by Mr J Lennox for the retention of a two-storey timber summer house, sauna hut and chiminea at 77 Victoria Road, Barnetby-le-Wold.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ii) 10/1245 by Mr K Clark for the erection of a replacement detached dwelling at Klemperer, Woodside Lane, Wroot.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iii) 10/1267 by Mr S Ellis for the raising of the roof of an existing bungalow to create a two-storey dwelling at Oakville, 5 Mill Lane, Westwoodside, Haxey.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(iv) 10/1293 by Mrs P Aked for the replacement of an extant permission (PA/2007/2068 dated 23/04/2008) to erect a two-storey dwelling with associated double garage on land adjoining The Old Vicarage, Church Street, Crowle.

Resolved – That permission be granted subject to the same conditions as PA/2007/2068.

(v) 10/1306 by Shelly’;s Deli for the siting of a mobile catering van at Cross Keys Inn, 6 Top Road, South Killingholme.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

Cllr B Briggs, having declared a personal and prejudicial interest in the following application,10/1317, left the meeting.

(vi) 10/1317 by Brinkley Homes for the erection of a block of 9 apartments on land north of The Gables, Belton Road, Epworth.

Prior to consideration of this application an objector addressed the committee. She was concerned at the height of the proposed dwelling which would lead to a loss of light to her property and that of her neighbours. The proposal failed the 30° test. It would have an unacceptable overbearing and oppressive impact on neighbouring properties.

Councillors Mrs Redfern, attending the meeting in accordance with Procedure Rule 1.37 (b), spoke on this application

Resolved – That consideration of this application be deferred until a future meeting and that members visit the site prior to that meeting. The reason for the site visit is that there is significant public interest.

(vii) 10/1352 by Gunness Village Hall Fund for the erection of a village hall, sports changing facilities and associated car parking and lighting at The Old Playing Field, Old Village Street, Gunness.

Prior to consideration of the following application a supporter addressed the committee. She stated that a lot of effort had been put into this application. The facility would help the sustainability of the community.

Councillors Waltham, attending the meeting in accordance with Procedure Rule 1.37 (b), spoke on this application.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(viii) 10/1413 by Mr and Mrs M Device for the conversion of a barn to a dwelling at barns at Woodlands Farm, Woodhouse Farm, Woodhouse, Belton.

Resolved – That permission be granted in accordance with the recommendation contained in the report.

(ix) 10/1530 by Mr B Brinkley for consent to crown – lift and prune a horse chestnut tree (T3) protected by Tree Preservation (The Paddock) Order 1998 on land north of the Steer Arms, High Street, Belton

Resolved – That consent be granted in accordance with the recommendation contained in the report.

1316 (47) APPLICATION FOR APPROVAL OF RESERVED MATTERS FOLLOWING THE GRANT OF OUTLINE PERMISSION – 10/1256 by Mr N Smith for approval of reserved matters following the grant of outline permission PA/2007/1657 relating to the erection of eight dwellings to the rear of 294-302 Ashby High Street, Scunthorpe.

Resolved – That approval be granted in accordance with the recommendation contained in the report.

1317 (48) ENFORCEMENT UPDATE – The Head of Planning submitted a schedule giving details of progress in respect of matters on which he had taken enforcement action under delegated authority.
