The committee met at the Civic Centre, Scunthorpe.

1568  MINUTES – Resolved – That the minutes of the proceedings of the meeting held on 15 January 2014, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the chairman.

1569  (27)  APPLICATIONS DEFERRED FROM PREVIOUS MEETING – In accordance with the decision at a previous meeting, members had undertaken a site visit prior to the meeting. The Head of Development Management submitted a report and updated it orally.

(i)  2013/0108 by Mr M & Mrs A White, Haxey Study Centre to extend the existing lecture room facility to accommodate an animal room and classroom/office and WC, and relocate the existing study centre from Rose Cottage.

An objector to the application addressed the Committee and explained how residents in Haxey had expressed concerns over increased traffic along Turbary Road and the impact that this would have on the environment and people living in Haxey Carr and the surrounding area.

Concerns were expressed over the increase in traffic on a road that was a designated Bridleway and popular with local residents for other activities such as cycling and walking.  Members of the Committee were asked to take into consideration how the business had grown, how this could potentially develop into a much larger business if permission was given to use the Lupine Woods site.

It was explained that further development was not in keeping with the local history as the area was a Site of Significant Scientific Interest (SSSI) and policies had been put in place to protect it.

Councillor Allcock spoke on this application and expressed concerns over the development being within or outside a Site of Specific Scientific Interest (SSSI).  It was considered that the development was inappropriate for the area and as such objections had been made by the Parish Council and also neighbours.

Comment was made to the poor condition of the access road and how increased traffic would exacerbate the deterioration.

Councillor Grant and Councillor Collinson both spoke on this application and about the two sites.

Resolved – That permission be refused as the development represented inappropriate further expansion of the buildings and operations in a remote and sensitive countryside location. The proposal, if approved, would be likely to result in increased use of the facility in an unsustainable location with poor access arrangements. This would be harmful to the character of the area and the amenities of local residents. As such the proposal was contrary to policies RD2 and LC14 of the North Lincolnshire Local Plan and policies CS2, CS3 and CS13 of the North Lincolnshire Core Strategy.

1570  (28)  MAJOR PLANNING APPLICATION – The Head of Development Management submitted a report containing details of major applications for determination by the committee including a summary of policy context, representations arising from consultation and publicity and assessment of the applications. In accordance with Procedure Rule D1.35 (i) (a), members had previously undertaken a site visit.

(i)  2013/1388 by North Lincolnshire Homes to erect 13 two-bedroom, three person bungalows on the site of Hallcroft Close, Blackmoor Road, Haxey.

Councillor Eckhardt, attending the meeting in accordance with Procedure Rule 1.37 (b) spoke on this application and confirmed there was local support for the application.  A request was made that an additional condition be applied to prioritise the allocation of these properties to residents within a 5 mile radius.

The Head of Development Management advised that it would be difficult to apply such conditions through the remit of the Planning Committee.

Members engaged in discussions over the proposal.

Guidance was sought from the Head of Legal who confirmed that if this condition was applied, it could not be enforced.

Resolved – That planning permission be granted in accordance with the recommendations contained within the report.

(ii)  2013/1505 by North Lincolnshire Council for outline planning permission for residential development (appearance, landscaping, layout and scale reserved for subsequent approval) on the former allotment site, off Roman Way, Scunthorpe.

An objector to the application addressed the Committee and explained how residents of Roman Way believed that they were purchasing properties in a quiet area, and that this would not be a through road.

The committee members were advised that she spoke on behalf of all residents of Roman Way.  Concerns had been raised over the potential of an additional 160 vehicles using Roman Way, and that the increased noise and pollution would be unacceptable and would affect residents’ quality of life.  Specific concerns were raised over the safety of children, congestion and building work traffic using Roman Way to access the site, how the proposed access road would be crossing over a public right of way and why alternative access points to the site had been disregarded.

Councillor L Foster, attending the meeting in accordance with Procedure Rule 1.37 (b) spoke on this application and thanked the committee members for taking the time to visit the site and also Roman Way.

The committee members were asked to consider the impact on the residents of Roman Way and that alternative means of access and egress be considered.  Councillor Foster asked the committee to reject the application.

Councillor Collinson spoke on the applications and expressed his concerns over the development of a large cul de sac and considered the access to be unsuitable.

Moved by Councillor Collinson and seconded by Councillor Grant –

That the application be refused.

The Head of Development Management and Officers from the Highways team were invited to respond to further questions from members of the Committee.

1571  (29) PLANNING AND OTHER APPLICATIONS – The Head of Development Management submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. The Head of Development Management updated the reports orally where appropriate. Other officers attending gave advice and answered members’ questions as requested.

(i)  2013/0895 by Mr K Hall to erect a dwelling (all matters reserved for subsequent approval) on land adjacent to 93 Godnow Road, Crowle.

Resolved – That planning permission be refused in accordance with the recommendations contained within the report.

(ii)  2013/1333 by Mr R Jarosiewicz to erect a two-storey side extension on Sunset Cottage, access road to Warpings Farm, Medge Hall, Crowle.

Resolved – That planning permission be granted in accordance with the recommendations contained within the report.

(iii)  2013/1344 by Mr & Mrs Wood to erect a single-storey rear extension on Goosewood, Scotter Road, Messingham.

Resolved – That planning permission be granted in accordance with the recommendations contained within the report.

(iv)   2013/1369 by Mr N Yates for outline planning permission with all matters reserved to erect a detached single-storey dwelling with associated access and parking facilities, including demolition of an existing detached garage at land adjacent to 4 Glanford Court, Brigg.

Resolved  – That consideration of this application be deferred to a future meeting and that members visit the site, prior to that meeting.

(v)   2013/1447 by a Mr M Watson for outlined planning permission to erect a single-storey dwelling (all matters reserved for subsequent approval) at land at Glanford Court (rear of 43 and 45 Grammar School Road), Brigg.

Resolved  – That consideration of this application be deferred to a future meeting and that members visit the site, prior to that meeting.

(vi)   2013/1385 by Mr and Mrs C Baker to erect a rear extension and raise the height of the roof to facilitate a loft conversion at 1 Regent Drive, Crowle.

Resolved – That planning permission be granted in accordance with the recommendations contained within the report.

(vii)  2013/1404 by Mr R J and Mrs A Neave an application to amend condition 2 of planning permission 7/430/94 to ‘The bungalow known as Poplars Farm/workshop/yard to be re-classified as a live/work unit’, Soff Lane, Goxhill.

Resolved – That planning permission be granted in accordance with the recommendations contained within the report.

(viii)  2013/1413 by Mr D Horner to erect a detached domestic garage at 50 West End, Winteringham.

Following a request to speak in writing the Chair invited an objector to address the Committee.

The objector addressed the Committee and expressed his concerns about the development being outside the building line and contrary to North Lincolnshire’s Local Plan, the potential for misinterpretation over the dimensions of the property and also usage.

The Head of Development Management responded to questions accordingly.

The Chair, asked if the applicant was in attendance and offered the right to reply.

Resolved – That consideration of this application be deferred to a future meeting and that members visit the site, prior to that meeting.

(ix)   2013/1519 by Mr and Mrs A Harvey for outline planning permission to erect a detached dwelling and garage on a plot adjacent to 5 West End Road, Epworth.

The agent for the application spoke of his concerns that the application was recommended for refusal based on the open countryside policy, and that officers had considered it to be contrary to the North Lincolnshire Local Plan and also the North Lincolnshire Core Strategy.

An objector to the application addressed the Committee and expressed his concerns that the new dwelling would have a detrimental impact on the setting of his property and also lead to a loss of light in 2 habitable rooms.

Councillor L Redfern, attending the meeting in accordance with Procedure Rule 1.37 (b) spoke on this application.

Councillor Grant and Councillor Collinson spoke on this application and the Head of Development Management responded to questions accordingly.

Resolved – That consideration of this application be deferred to a future meeting and that members visit the site, prior to that meeting.

(x)   2013/1591 by Mr D Bradley for outline planning permission to erect six dwellings (all matters reserved for subsequent approval) on land off Dudley Road, Scunthorpe.

Councillor T Ellerby, attending the meeting in accordance with Procedure Rule 1.37 (b) spoke on this application and confirmed his support for the officers recommendation to refuse planning permission.

Committee members engaged in discussions and reference was made to a previous similar application for Dudley Road that had been refused, concerns of air quality in the area were discussed and also the possibility that this development may lead to further development on the Dudley Road site if approved.

Resolved – That planning permission be refused in accordance with the recommendations contained within the report.

1572  (30)  PLANNING STATISTICS – OCTOBER TO DECEMBER 2013 –  The Head of Development Management submitted a report which outlined the number of applications received and determined, and provided comparatives against national performance indicators and also the previous two administrative years.

It was noted that the number of applications received in 2013/14 had increased comparative to the previous year.

It was requested that further information be brought to a future meeting which outlined details of appeals that had been dealt with.  The Head of Development Management confirmed that this could be provided.

Resolved – (a)  That the information be noted, and (b) that information on appeals be brought to a future meeting.

1573  (31) PROPOSED DIVERSION OF PUBLIC FOOTPATH 93, SOUTH KILLINGHOLME – The Director of Places submitted a report which sought consideration of a request from North East Lincolnshire Council for the proposed diversion of a section of Public Footpath 93 (PF93) within South Killingholme as part of a longer diversion within their area.

The affected length of FP93 was approximately 200 metres long (details were outlined in appendix 1 to the report).  It was explained that the footpath ran east-west through the Mayflower millennium wood adjacent to North East Lincolnshire.

The purpose of the diversion was to link up with a proposed diversion of FP13 in North East Lincolnshire which was being relocated from crossing Immingham Golf Club to a safer, more user friendly line.

It was considered that the new proposed routes would provide a more pleasing walk and clearly defined line and enable walkers to walk unimpeded from South Killingholme to Immingham.

Resolved – (a) That North Lincolnshire Council consent to North East Lincolnshire Council including part of Public Footpath 93, South Killingholme, in their proposed order to be made under section 119 of the Highways Act 1980. Furthermore, that North Lincolnshire Council not object to the order when notice of its making is publicised, providing (1) it is as described in this report and (2) the width ascribed by the order to FP93 is not less than two metres, and (b) that if the order is confirmed, the “County of Lincoln, Parts of Lindsey (Glanford Brigg)” definitive map and statement be modified in consequence as soon as practicable.
